VILLAGE OF MEAD – PLANNING COMMISSION MEETING MINUTES – February 28, 2022

The Village of Mead Planning Commission met Monday, February 28, 2022, at 6:34 pm. The meeting was called to order by Chairman Levi Durnal with roll call.  Present were Levi Durnal, Robert Morin, James Hannan, Connie Schliffke, Jim Halbmaier and Wyatt Swartz.

 

Chairman states: “The Village of Mead makes available at least one current copy of the Open Meetings Act posted in the meeting room at a location accessible to members of the public. The Act is posted in the front entry of the Community Building.”

 

Jim motioned, and Connie seconded the motion to approve the agenda.  All members present agreed.

 

Jim motioned, and James seconded to approve the November 22, 2021, meeting minutes.  All members present agreed.

 

SCHEDULED GUESTS: No Scheduled Guests.

 

UNSCHEDULED GUESTS IN ATTENDANCE: Josh Girmus, Andy Jackson, Jillian Spencer, June Moline and Mark Boschult.

 

NEW BUSINESS

 

Jim motioned and Connie seconded to adjourn to public hearing. All members present agreed.

 

Robert motioned and Connie second to adopt the hearing agenda. All members present agreed.

 

Chairman called the hearing to order at 6:36 pm with roll call.  Answering roll call were Levi Durnal, Robert Morin, James Hannan, Connie Schliffke, Jim Halbmaier and Wyatt Swartz.

 

Chairman states the purpose of the hearing is to hear testimony of support, opposition, criticism, suggestions, or observations with regard to the following:

 

A petition from Girmus Investments to rezone property described as:

 

THE SOUTH HALF OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER AND THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER IN SECTION 1, TOWNSHIP 14 NORTH. RANGE 8 EAST OF THE SIXTH

PRINCIPAL MERIDIAN, SAUNDERS COUNTY. NEBRASKA.

 

Girmus Investments is seeking approval to have the property rezoned from Agricultural to Light Industrial.

 

Chairman calls for public input.

 

Josh Girmus stated that he did not feel this was an example of spot zoning and the site would bring additional income into local businesses and dollars into the school district and fire department as agriculture is the lowest taxed property.

 

Mark Boschult owns the property to the north, south, and east of the property. His property is zoned Agricultural and used for farming.  He feels that since the property located on the west side is also zoned Agricultural, that these ten acres should remain Agricultural at this time due to a lack of specific information related to the intended user of the property.

 

At Jim motioned, and Robert seconded the motion to suspend the public hearing to allow other new business to advance.  All members present agreed.

 

Review and discuss permit application from Thomas and Jillian Spencer, 703 S. Oak – Building Permit Application to install a fire pit (R-1).

 

Following discussion of the application James motioned, and Jim seconded to recommend approval of the permit to the Village Board. All members present agreed.

 

At James motioned and Jim seconded to return to the suspended public hearing regarding the rezoning request by Girmus Investments.  All members present agreed.

 

Following additional review and discussion of the matter, Wyatt motioned, and Jim seconded to adjourn to Regular Session.  All members present agreed.

 

At 7:55 Jim motioned, and Connie seconded to adjourn to public hearing. All members present agreed.

Chairman calls for public input.

 

No individuals present expressed opposition to the subdivision of the property is question pending the approval of the associated rezoning request by the Village Board.

 

At 7:58 Jim motioned, and Connie seconded the motion to adjourn to Regular Meeting.

Following a discussion by the board of the rezoning request from Girmus Investments.  The chair called for a motion to recommend approving the application to the Village Board.   No members made the requested motion.   Robert motioned to recommend against recommending the rezoning application to the Village Board, Jim seconded the motion. All members present agreed.

Following a discussion by the board of the application from Girmus Investments to subdivide the specified property, the chair called for a motion to recommend approving the application to the Village Board contingent on the Village Boards approval to rezone said property.  Jim motioned and Robert seconded the motion.   All members in attendance agreed.

The Planning Board reviewed and discussed the permits report for the year 2021.

The Planning Board reviewed and discussed recommended amendments to section 11-309, 11-311 and 11-414 of the village ordnances.  Following the discussion, Robert motioned to table the discussion until additional information could be reviewed.  Wyatt seconded the motion.    All members in attendance agreed.

 

At 8:45 pm, the Chair called for an adjournment.  James motioned, and Jim seconded.  All members present agreed.
