PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
August 14, 2018

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held August 14, 2018 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Gary Guyle, Richard Wielage and Rodney Wimer. Absent was Trustee Jason Felty. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Library Director Laurie VanAckeren, and Assistant Library Director Lori Moseman. Guests were Ed Schroeder, Paulette Mayfield, Viki Miller, Brad Sloup, Scott and Karen Little, Mandy Craig, Craig Reinsch, Mike Chvatal, and Kent and Linda Sweet.

The posting of the Open Meetings Law was noted.

Motion by Wielage, second by Wimer, to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

The minutes of the July 10 regular meeting and July 30 special meeting were accepted as presented.

Motion by Guyle, second by Wielage, to approve the Treasurer’s Report showing $685,920.51 total checking/savings balance ending July 31, 2018. Vote: Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes; motion carried 4-0.

Motion by Wielage, second by Guyle, to approve the claims of $134,711.27 for payment. Vote: Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes, with Wimer abstaining on check #3998; motion carried 4-0. Claims being:

PUBLIC HEARING:
The hearing was called to order at 6:05 p.m. with the following board members answering roll call: Chairman Havelka; Trustees Guyle, Wielage and Wimer. Absent was Trustee Felty.

Motion by Guyle, second by Havelka, to adopt the agenda. Vote: Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 4-0.

Havelka stated the purpose of the hearing was to address an application from Scott and Veronica Subbert to rezone real estate located at 1012 Co Rd M, Mead. The board reviewed the application.

Havelka called for public input.

Motion by Havelka, second by Wielage, to reconvene to regular session at 6:10 p.m. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

Havelka introduced and motioned to waive three readings and adopt Ordinance No. 717, Rezone real estate located at 1012 Co Rd M, Mead, Saunders County, Nebraska, from Agricultural District to Commercial District. The motion was seconded by Wimer. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.

Motion by Havelka, second by Wimer, to enter a Budget Workshop at 6:10 p.m. Vote: Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.

BUDGET WORKSHOP:
A Budget Workshop was called to order at 6:10 p.m. with the following board members answering roll call: Chairman Havelka; Trustees Guyle, Wielage and Wimer. Absent was Trustee Felty.

Motion by Wielage, second by Wimer, to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

Village Accountant, Ed Schroeder, presented the proposed October 1, 2018 through September 30, 2019 fiscal year budget. Discussion was held.

Havelka called for public input.

Motion by Havelka, second by Wimer, to reconvene to regular session at 6:50 p.m. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.

SCHEDULED GUESTS:
Craig Reinsch, Olsson Associates, presented an update on the water project with discussion centering on the water tower, fencing, and pilot test.

Bids were presented for the contractor for the water tower and fencing. Bids were opened on August 9 from four contractors. The low bid of $675,000.00 was received from Maquire Iron from Sioux Falls, South Dakota. Craig’s recommendation is to approve this bid along with an additional $30,000.00 to include inclusion of a Tower Mixing System. Additional bids of $5,000.00 were presented for the inclusion of “Mead Map” or $15,000.00 for the inclusion of “Mead Raiders” as an alternate exterior painting system on two sides of the tower. The additional painting option will be covered by the village, not by the USDA grant and grant.

Motion by Havelka, second by Wimer, to approve a bid from Maquire Iron to erect the water tower and install a barbed wire fence and control access gate to include bid sections I, II, III, IA and IC “Mead Map” for a total of $710,000.00. Vote: Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes; motion carried 4-0.

Discussion was held on the status of the pilot test by AdEdge. AdEdge had issues completing the testing, therefore it is the engineer’s recommendation to seek a contract with the second lowest bidder, Tonka/US Water, to complete a second pilot test. Tonka/US Water would plan to begin the testing by October 1.

Motion by Wimer, second by Havelka, to offer a contract to Tonka/US Water to complete a second pilot test. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

The USDA has recommended to the engineers that they either seek public bids or amend their engineering contract to complete construction testing and staking.

Motion by Havelka, second by Wielage, to approve Amendment #4 for construction and staking services for the water tower and building. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.

Mandy Craig, Jones Insurance Agency, presented a bid for insurance coverage from Prague Insurance.

Mike Chvatal, Inspro Insurance, presented a bid for insurance coverage.

Kent Sweet presented concerns about water pressure and a damaged curb stop.

UNSCHEDULED GUESTS: Karen and Scott Little expressed concern over the colored water at their residence. Karen brought several photographs of water in her washing machine.

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
The Monthly Police Report was reviewed. The report noted the removal of the shed at 307 S. Cedar Street but Jerry still has concerns with objects sitting outside of the buildings as required to be removed in Nuisance Abatement Ordinance No. 17-16.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported necessary repairs on the pump at the sewer plant, concrete replacement on streets, completion of redirecting the water line east of N. Vine Street, ordered two pallets of tar for street repairs, condition of water within the water tower, and call to SECO due to the generator not working at the wellhouse.

PLANNING COMMISSION REPORT:
The minutes of the July 23 Regular Meeting and Public Hearing were accepted.

Motion by Havelka, second by Wimer, to approve Building Permit 18-19 to Security Rentals, 1048 Sunburst Lane, to erect a fence. Vote: Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 4-0.

LIBRARY REPORT:
The minutes of the July 16 Library Board Meeting and July 24 Special Meeting were accepted.

CLERK REPORT:
Moline reported water meters that need repair and direct deposit option offered by Thoroughbred Systems for a one-time fee of $300.00.

UNFINISHED BUSINESS:
Motion by Havelka, second by Wimer, to approve second reading of Ordinance No. 717, amend Section 3-109, Water Rates and Ordinance No. 716, amend Sections 3-116.01, 3-116.02, 3-218, 3-219, and 3-901, Water and Sewer Requirements. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

NEW BUSINESS:
Discussion was held on pursuing a paving project along N. Oak Street. It was agreed at the July 10 meeting that cost of the project would be shared 50-50 between the homeowners and the village. A question was put forth from a potential buyer for the school property, offered north of the project, as to whether the village would share the cost of the project if concrete was required. It was decided that the entire paving cost would be at the homeowner’s expense.

Wielage introduced and motioned to waive three readings and adopt Ordinance No 718, Create Street District 2018-1 to pave N. Oak Street from N. First Street to the Mead Public Schools school grounds. The motion was seconded by Wimer. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.

ORDINANCE NO. 718

AN ORDINANCE CREATING PAVING DISTRICT NO. 2018-1 IN THE VILLAGE OF MEAD, NEBRASKA, ORDERING THE CONSTRUCTION OF STREET IMPROVEMENTS THEREIN AND ORDERING THE PUBLICATION OF THE ORDINANCE IN PAMPHLET FORM.

BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF THE VILLAGE OF MEAD, NEBRASKA, as follows:

Section 1. That there be and hereby are created in the Village of Mead, Nebraska, paving District to be known and designated as Paving District No. 2018-1 of the Village of Mead, Nebraska.

Section 2. That the outer boundaries of Paving District No. 2018-1 shall include, in addition to the street to be improved, all of the property within the following boundaries:

and within which District, the following street shall be improved by paving with all necessary appurtenances thereto:
Oak Street, from the intersection at First Street, north to the border of Mead Public Schools Subdivision.

Section 3. Said street shall be improved and said improvements shall be made in accordance with the plans, specifications and estimate prepared by the special engineers for the Village and to be approved by the Chairperson and Board. The cost of such paving excepting street intersection shall be assessed against the property within said district specifically benefited thereby in proportion to benefits.

Havelka introduced and motioned to adopt, second by Wimer, Resolution 18-06, Set date for hearing on objections to street project. Vote: Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes; motion carried 4-0.

RESOLUTION NO. 18-06

BE IT RESOLVED BY THE CHAIRPERSON AND BOARD OF THE VILLAGE OF MEAD, NEBRASKA, as follows:

The Chairperson and Board hereby find and determine that the Chairperson and Board will meet on the 9th day of October, 2018, at 6:00 o’clock P.M. at the regular meeting place of the Board, at which time a hearing will be held as to the sufficiency of the written objections filed objecting to the creation of Paving District No. 2018-1 of the Village and as to the existence of the required facts and conditions relative to the creation of the District.

Wimer introduced and motioned to approve first reading of Ordinance No. 719, Library Board members. Guyle seconded the motion. Vote: Wimer-yes, Felty-absent, Guyle-yes, Havelka-no, Wielage-yes; motion carried 3-1.

Motion by Havelka, second by Wimer, to approve a bid of $2,840.00 from Fud and Tracy’s for replacement of the air conditioning unit at the village office. Vote: Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.

Discussion was held on increasing the rate of pay for the Board of Trustees attendance at meetings. A survey was presented by the clerk of numerous rates from villages / first class cities with populations similar to Mead that are within the Three Rivers Clerk’s Association.

Motion by Havelka, second by Guyle, to approve a Special Designated Liquor License to Cornhusker Beverage Mart to serve alcohol at a wedding reception on August 10 at the Mead Community Building. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.
