PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

August 11, 2020

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held August 11, 2020 at the Mead Community Building.  Chairman Thorson called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson, Trustees Jason Felty, Gary Guyle, Richard Wielage, and Rodney Wimer.  Also present were Clerk June Moline and Utility/Maintenance Superintendent Nick Raver. Guests were Todd and Kim Clark, Gene Janecek, Greg and Laura Clark, Rick Miller, J.P. Hannan, Steve Mayfield, Shari Else, Ed Schroeder, Lisa Flesner, and Don Anderson.

The posting of the Open Meetings Law was noted.

Motion by Wimer, second by Felty, to adopt the agenda.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

The minutes of the July 14 Regular Meeting and Public Hearings (3) were accepted.

Motion by Wielage, second by Thorson, to approve the Treasurer’s Report showing $821,402.45 total checking/savings balance ending July 31.  Vote: Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

Motion by Guyle, second by Wielage, to approve Change Order #1 to Neuvirth Construction to decrease contract by $9,235.18.  Vote: Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

Motion by Thorson, second by Guyle, to approve Pay Certificate #1 to Neuvirth Construction for $59,400.00 for mobilization, grading & foundations.  Vote:  Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes; motion carried 5-0.

Motion by Guyle, second by Wielage, to enter a Budget Workshop at 6:05 p.m..  Vote:  Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

BUDGET WORKSHOP

Thorson called the workshop to order at 6:05 p.m. with roll call.  Present were Felty, Guyle, Thorson, Wielage, and Wimer.

Motion by Guyle, second by Wielage, to adopt the agenda.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

Village Accountant, Ed Schroeder, presented the proposed October 1, 2020 through September 30, 2021 budget.  Discussion was held, followed by the call for public input.

Motion by Felty, second by Wimer, to adjourn at 6:30 p.m.  Vote:  Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

SCHEDULED GUESTS:

J.P. Hannan inquired on possible purchase of approximately 35’ of property located at 110 E. First Street which would allow him to erect a garage on his property.  A concern expressed was utility lines running through that particular piece of property.  They agreed that Raver will have the property located and see if any utilities lie beneath.

Don Anderson addressed the board regarding a sidewalk in need of repair on the east side of his property located at 419 S. Vine Street.  A concern has also been made regarding a tree root that has uprooted a sidewalk slab on the south side of the same property.  Don agreed to repair the east sidewalk and sought permission to remove the sidewalk on the south since it ends at an abandoned property to the west.

Motion by Wimer, second by Wielage, to allow Don Anderson to proceed with removal of the sidewalk on the south side of his property located at 419 S. Vine Street.  Vote:  Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes; motion carried 5-0.

 

UNFINISHED BUSINESS:

Motion by Guyle, second by Thorson, to remove from the table, discussion seeking a variance to place a modular house at 421 S. Cedar Street.  Greg Clark presented a diagram of placement of the modular house and future construction of a garage.  Due to the size of the lot it is not possible to meet zoning setbacks.

Discussion was held.  Noted was the size of the lots in the older section of Mead that cannot meet setbacks.  Planning Commission Chairman Rick Miller reported Sections 11-106 Nonconforming Lot of Record and 11-401 Lot of Record addresses the concern of the older, smaller lots in town.

Thorson called for public input.  Steve Mayfield reported that if a house is placed on the lot it would be a detriment to his property to the west.  The four lots were intentionally split into two with the greater distance running north and south so that no one could build in the future.  In the past few years, he has invested in remodeling the old barn on his property.  Mr. Clark stated that he didn’t feel a residence would affect Steve’s property.

The board feels the benefit to the village would be in the form of dollars generated through taxes and water/sewer usage.

Guyle introduced and motioned to adopt Resolution 20-06, Variance of lot size and front-yard, rear-yard and side-yard setbacks to place a modular home and future garage on property described as 421 S. Cedar Street to Greg and Laura Clark.  The motion was seconded by Wimer.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

 

RESOLUTION 20-06

 

            WHEREAS, The Village of Mead authorizes the variance request from Greg and Laura Clark of the following described real estate to wit:

 

as E ½ S 4’ Lot 13 E ½ Lots 15, 17, 19, and 21, Block 32, Original Town Mead, Mead, Saunders County, Nebraska also known as 421 S. Cedar St., Mead, Nebraska.

 

PLANNING COMMISSION REPORT:

The minutes of the July 27 regular meeting and public hearing and Building Permit 20-15, Thomas Ellis to erect a 6’ cedar privacy fence were accepted.  Moline reported documentation from NDEE for clearance for individual septic systems on lots located at Girmus Subdivision.  It was noted that permit applications must provide locations of where the wells / septic systems are going to be installed and must be approved by the village engineer, at applicant cost, prior to receipt of Building Permit and thereby installation.

Motion by Felty, second by Thorson, to approve James P. Hannan as a member of the Planning Commission.  Vote:  Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

Motion by Thorson, second by Wielage, to void Building Permit 19-06 to Shawn Havelka for an addition to a garage.  Vote:  Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes; motion carried 50.

Motion by Guyle, second by Wimer, to adjourn to a public hearing at 7:00 p.m.  Vote:  Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

 

PUBLIC HEARING:

Thorson called the hearing to order at 7:00 p.m. with roll call.  Present were Felty, Guyle, Thorson, Wielage, and Wimer.

Motion by Thorson, second by Felty, to adopt the agenda.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

Thorson stated the purpose of the hearing was to review a recommendation from the Planning Commission to amend language to the zoning regulations.

Thorson called for public input.

REGULAR SESSION

NEW BUSINESS:

Thorson introduced and motioned to waive three readings and adopt Ordinance No. 754, Amend Chapter 11, Article 3, Sections 11-304 A1 Agricultural and Article 4 Additional Regulations 11-412 Signs.  Wimer seconded the motion.  Vote:  Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

 

ORDINANCE NO.  754       

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 11 SUBDIVISION REGULATIONS; ARTICLE 3 DISTRICTS, SECTION 11-304 (A-1) AGRICULTURAL AND ARTICLE 4 ADDITIONAL REGULATIONS, SECTION 11-412 SIGNS; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE.

 

The One- and Six-Year Street Plan was reviewed.

Felty introduced and motioned to waive three readings and adopt Ordinance No. 755, Set wage for Library Substitutes at $9.00 per hour.  The motion was seconded by Thorson.  Vote:  Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes, Wielage-no; motion carried 4-1.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR AMENDMENT OF THE WAGE OR SALARY OF THE LIBRARY SUBSTITUTE OF THE VILLAGE OF MEAD, NEBRASKA.

POLICE REPORT:  Jerry Carlson

The monthly police report was reviewed.  Two nuisance reports were discussed.

Felty introduced and motioned to adopt Resolution 20-10, Nuisance declared on Lots 11, 13, 15, 17, 19 and 21, Block 31, Original Town Mead.  The motion was seconded by Thorson.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

RESOLUTION No. 20-10

 

            The Board of Trustees of the Village of Mead, Nebraska, in Regular Session assembled at the Mead Community Building in Mead, Nebraska on this 11th day of August, 2020, hereby make the following findings:

 

            WHEREAS, the Nuisance Officer has presented a report setting forth alleged nuisance violations on property legally described as: Lots 11-12 BLK 5 Anderson & Carlson’s Addition Mead, Mead, Saunders County, Nebraska and known as 105 E. Fifth  Street, Mead, Nebraska, which is located within its village limits and within its zoning jurisdiction, identifying  that in his opinion a nuisance exists as defined by Village Ordinance; said report contains photographs and other evidence pertinent to the situation, and the report was presented at a regular meeting for confirmation that a nuisance exists, a copy of said report is attached hereto,  and

 

WHEREAS, a review by the Board of Trustees of the Village of Mead was made at a Regular Meeting held on the 11th day of August, 2020, and

           

WHEREAS, the Board of Trustees, after review of the report and the accompanying photographs and evidence desires to declare the conditions found therein as Nuisances pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-302(A) NUISANCE, 4-302(B 11).

Discussion was held on residents residing within a Commercial Zoning District and declared the library budget for the October 1, 2020 through September 30, 2021 fiscal year shall remain as the current fiscal year budget is.  Clerk to contact Accountant Schroeder regarding the recommendation.

A delinquent water/sewer bill was presented.

LIBRARY REPORT:

The July 20 Library Board meeting minutes were accepted.

Motion by Thorson, second by Felty, to approve Laurie Van Ackeren, Lori Moseman, and Rachelle Laurizen as Library Substitutes.  Vote:  Guyle-yes, Thorson-yes, Wielage-no, Wimer-yes, Felty-yes; motion carried 4-1.
