PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
March 13, 2018
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held March 13, 2018 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle, Richard Wielage, and Rodney Wimer. Also present were Clerk June Moline and Police Chief Jerry Carlson. Guests were Jody Weible, Tyler Bukaske, Terral Brabec, and Josh Girmus.
The posting of the Open Meetings Law was noted.
Motion by Wielage, second by Havelka, to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
The minutes of the February 13 Regular Meeting and Public Hearing were accepted as presented.
Motion by Wielage, second by Guyle, to approve the Treasurer’s Report showing $590,779.86 total checking/savings balance ending February 28, 2018. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
Motion by Wimer, second by Wielage, to approve the claims of $30,211.92 for payment. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0. Claims being:

The board entered a public hearing at 6:18 p.m. Present were Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle, Richard Wielage, and Rodney Wimer.
Motion by Havelka, second by Felty, to adopt the agenda. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
Havelka stated the purpose of the hearing was to address a request from Scott Selko to replat lots 1 and 3 in Mead Public Schools Subdivision No. 2.
Havelka called for public input.
Motion by Havelka, second by Guyle, to adjourn at 6:22 p.m. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
Discussion was held on findings from the public hearing.
Wimer introduced and motioned to waive three readings and adopt Ordinance No. 707, Replat Lots 1 and 3 in Mead Public Schools Subdivision No. 2. The motion was seconded by Guyle. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
ORDINANCE NO. 707
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA TO APPROVE THE REPLAT OF LOTS 1 AND 3, MEAD PUBLIC SCHOOLS SUBDIVISION NO. 2, AN ADDITION TO THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, SAID REAL ESTATE DESCRIBED AS:
LOTS 1, 2 AND 3, MEAD PUBLIC SCHOOLS SUBDIVISION NO. 2, VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA.
TO AUTHORIZE THE CHAIR OF THE BOARD OF TRUSTEES TO SIGN SAID REPLAT PURSUANT TO THIS ORDINANCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH.

PUBLIC HEARING:
Roll call at 6:23 p.m. showed the following board members present: Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle, Richard Wielage, and Rodney Wimer.
Motion by Havelka, second by Wielage, to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
Havelka stated the purpose of the hearing was to act on a recommendation from the Planning Commission to amend and add language to the Zoning Regulations.
Havelka called for public input.
Motion by Havelka, second by Wielage, to reconvene to regular session at 6:29 p.m. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.
Discussion was held on the amendments and additions to the zoning regulations.
Havelka introduced and motioned to waive three readings and adopt Ordinance No. 700, amend Chapter 11, Zoning Regulations, Sections 11-202, 11-305, 11-306, 11-307, 11-308, 11-314, and 11-416. Felty seconded the motion. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.

CONDITIONAL USES; SECTION 11-306 (R-1) SINGLE FAMILY RESIDENTIAL, C. PERMITTED CONDITIONAL USES; SECTION 11-307 (R-2) MULTIPLE FAMILY DISTRICT C. PLANNING COMMISSION REPORT:
The minutes of the February 26 Regular Meeting and Public Hearings and Building Permit 18-01 to Lyle and Keshia Havelka to construct a house, attached garage and fence at 116 N. Vine St. were accepted.
Motion by Havelka, second by Wielage, to approve Building Permit 18-02 to Josh Girmus to erect a chain-link fence at 1067 Sunburst Lane. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
LIBRARY REPORT:
The minutes of the February 19 Library Board Meeting were accepted.
CLERK REPORT:
Moline noted that the board may consider installation of meter reader add-on’s in the future and vacation request for June 21, 22, and 25. The annual letter to be sent to residents was reviewed.
UNFINISHED BUSINESS:
Motion by Havelka, second by Wielage, to approve third reading and adopt Ordinance No. 703 to amend Section 3-109, Municipal Water Department; Minimum Rates. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
ORDINANCE NO. 703
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 3, DEPARTMENTS; ARTICLE 1, WATER DEPARTMENT; SECTION 3-109, MUNICIPAL WATER DEPARTMENT; MINIMUM RATES; OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT OF WATER RATES; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE.
Havelka motioned to approve second reading of Ordinance 704, No. 705, and No. 706, Non-exclusive franchise to collect and dispose of garbage to the residents of Mead to Waste Connections, Roadrunner Transportation and S2 Recycling and Refuse. The motion was seconded by Wielage. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
Motion by Havellka, second by Wielage, to approve Agreement #3 with Olsson Associates for engineering services for the water project. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
NEW BUSINESS:
Moline reported Zoning Regulations regarding occupation taxes charged on towers as regulated in Municipal Codes 10.501 and 11-415.
Wimer introduced and motioned to waive three readings and adopt Ordinance No. 708 to amend Section 3-104, 3-105, and 3-116.02 of the water regulations. A second was made by Felty to adopt. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.
ORDINANCE NO. 708
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR THE MANDATORY HOOKUP OF WATER SERVICES WITHIN THE VILLAGE’S CORPORATE LIMITS OR ONE MILE THEREOF WHO ARE WITHIN THREE-HUNDRED (300’) FEET OF A WATER MAIN AND PREVENTION OF CONTAMINATION.
Felty introduced and motioned to adopt with a second by Wielage, Resolution 18-04, Lien on property located at 243 N. Elm St. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
Discussion was held on dump hours remaining the same although no dump personnel will be present, Jason Jacob (amended 4/10/18) Felty is willing to prepare the ballfields again this summer, Terry Miller plans to bale hay near the lagoons on property belonging to the village again this year, and a letter has been received from Roberta Havelka indicating that Kids Corner Day Care will not be renewing their lease of the depot building after March 31, 2018. The condition of the depot building was discussed. The board asked Clerk Moline to seek the rate charged by local municipalities for dumping of waste products into their lagoon system. Mead Clean-up Day was set for May 26 and Clerk is to seek bids for roll-offs from Roadrunner Transportation and S2 Refuse and Recycling.
