PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

May 8, 2018

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held May 8, 2018 at the Village Office.  Chairman Havelka called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty and Rodney Wimer.  Absent were Trustees Gary Guyle and Richard Wielage.  Also present were Clerk June Moline and Utility/Maintenance Superintendent Nick Raver.  Guests were Jody Weible, Josh Girmus and Cort Silliman.

 

The posting of the Open Meetings Law was noted.

 

Motion by Havelka, second by Wimer, to adopt the agenda. Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.

 

The minutes of the April 10 Regular Meeting and two Public Hearings were accepted as presented.

 

Motion by Havelka, second by Wimer, to approve the Treasurer’s Report showing $616,729.66

total checking/savings balance ending April 30, 2018.  Vote: Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent; motion carried 3-0. 

 

Motion by Wimer, second by Havelka, to approve the claims of $33,177.40 for payment.  Vote:  Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes; motion carried 3-0.  Claims being:

Motion by Havelka, second by Wimer, to enter a public hearing at 6:05 p.m.  Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.

 

PUBLIC HEARING

Havelka stated the purpose of the hearing was to review the Preliminary Plat filed by Girmus Investments LLC to subdivide 45.24 acres to create Girmus Subdivision.  Discussion was held on the recommendations from Engineer Ben Day and approval of the plat by the Planning Commission regarding drainage easement and graphic scale.

 

Motion by Havelka, second by Felty, to reconvene to regular session at 6:11 p.m.  Vote:  Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent; motion carried 3-0.

 

Motion by Havelka, second by Felty, to approve the Preliminary Plat to create Girmus Subdivision with recommended changes from the village engineer.  Vote:  Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes; motion carried 3-0.

 

Motion by Havelka, second by Felty, to enter a public hearing at 6:12 p.m.  Vote:  Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent; motion carried 3-0.

 

PUBLIC HEARING:

Havelka reported the purpose of the hearing was to review a Final Plat submitted by Ray Kucera, Jr. to subdivide property to create Subbert Subdivision with the sale of one acre to Scott Subbert.  Discussion was held along with the document submitted from Engineer Ben Day and the Planning Commission all recommending the subdivision.  Also discussed was the requirement of Subbert to rezone the property from agriculture to commercial as the other two acres are zoned commercial.

 

Motion by Havelka, second by Wimer, to reconvene to regular session at 6:15 p.m.  Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.

 

Havelka introduced and motioned to waive three readings and adopt Ordinance No. 709, Subdivide one acre of property from Ray Kucera, Jr. to create Subbert Subdivision.  The motion was seconded by Wimer. Vote:  Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent; motion carried 3-0.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA TO APPROVE AN APPLICATION FROM RAYMOND KUCERA, JR. AND JULIE KUCERA TO SUBDIVE PROPERTY DESCRIBED AS:

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT:  Jerry Carlson

The Monthly Police Report was reviewed.  A review of the properties with declared nuisances described in Resolutions 17-16 and 17-17 were reviewed.  Mr. Sladek had reported he has contacted a contractor to demolish the shed in question in June and has been working on clearing the property.  Carlson reported he has reinspected the Barris property and his recommendation is that the nuisance complaints be satisfied on both properties.

 

Motion by Havelka, second by Wimer, to remove the declared nuisances from the properties described in Resolutions 17-16 and 17-17.  Vote:  Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent; motion carried 3-0.

 

Motion by Havelka, second by Wimer, to table discussion on a trailer parked on a street.  Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.

 

SCHEDULED GUEST:

Cort Silliman with First National Capital Markets, presented three options for funding construction of improvements for the water project.  The options discussed were a Variable Rate Draw Down Loan, Variable Rate Draw Down Loan (50 bps increase), or General Obligation Bonds.  The process to collect the funds was discussed.  The board agreed to proceed with the Variable Rate Draw Down Loan as approved on an earlier date.

 

ORDINANCE NO. 712

 

AN ORDINANCE AUTHORIZING THE ISSUANCE, SALE, AND DELIVERY OF GENERAL OBLIGATION WATER BONDS, SERIES 2018, OF THE VILLAGE OF MEAD, NEBRASKA IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $2,600,000 TO PAY THE COSTS OF CONSTRUCTING IMPROVEMENTS TO THE WATER SYSTEM OF THE VILLAGE; PRESCRIBING THE FORM AND CERTAIN DETAILS OF THE BONDS AND PROVIDING FOR THE FIXING AND ESTABLISHING OF OTHER DETAILS OF THE BONDS; PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL TAX FOR THE PURPOSE OF PAYING THE PRINCIPAL OF AND NTEREST ON THE BONDS AS THY BECOME DUE; DESIGNATING THE BONDS AS QUALIFIED TAX EXEMPT OBLIGATIONS; ADOPTING CERTAIN POST-ISSUANCE TAX COMPLIANCE AND DISCLOSURE POLICIES AND PROCEDURES WITH RESPECT TO THE BONDS; AUTHORIZING CERTAIN OTHER DOCUMENTS AND ACTIONS IN CONNECTION THEREWITH; AND PROVIDING FOR THE PUBLICATION OF THE ORDINANCE IN PAMPHLET FORM.

 

UTILITY/MAINTENANCE SUPERINTENDENT REPORT:  Nick Raver

Raver reported pump maintenance at the wellhouse and a light tower that fell at the baseball field.  Plans are to roto-till the area where the glass is contained, fill with dirt and top with sod.  Raver reported that following an inspection by the village engineer it was found that the additional three light towers are deemed unsafe due to corrosion and wind damage. 

 

Motion by Wimer, second by Havelka, to remove the remaining three light towers at the baseball field.  Vote:  Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent; motion carried 3-0.

 

PLANNING COMMISSION REPORT:

The minutes of the April 23 Regular Meeting and Building Permits 18-05, Adam and Jessica Miller to erect a 6’ wood privacy fence; 18-07, Richard Kuhr to construct a pole building, and 18-08, Mead Public Schools to erect two fences and Demolition Permit 18-06, Richard Kuhr to demolish a garage were accepted.  Building Permit 17-15 to Steve and Mary Mayfield to replace an existing chain-link fence was voided.

 

LIBRARY REPORT:

The minutes of the April 16 Library Board Meeting were accepted.

 

CLERK REPORT:

Moline reported topics covered at Clerk Academy and the sale of forty-two pet licenses to date.

 

NEW BUSINESS:

Moline reported the village attorney’s opinion that the option for authorizing private well fees be in the form of a permit fee following the opinion of our engineer (at applicant’s cost) and application and approval of a Building Permit.  Review was held on the requirements of the Conditional Use Permit for AltEn to have waste material spread.

 

Motion by Havelka, second by Felty, to approve an Interlocal Agreement with the  City of Wahoo to spray mosquitoes for 2018 at a rate of $310.00 per application.  Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.

 

Havelka introduced and motioned to waive three readings and adopt Ordinance No. 711, Amend Section 9-201, Building Permits with the addition of required costs to be paid by the applicant pertaining to Variance, Zoning, Subdivision and Permitted Conditional Use permits.  Vote:  Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-absent; motion carried 3-0.

 

ORDINANCE NO.  711

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 9, BUILDING REGULATIONS; ARTICLE 2 BUILDING PERMITS; SECTION 9-201, BUILDING PERMITS; OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, WITH THE ADDITION OF THE REQUIRED PUBLICATION COST IN THE NEWSPAPER AND ALL COSTS ASSOCIATED WITH REVIEW BY THE VILLAGE ENGINEER ARE TO BE PAID BY THE APPLICANT.

 

Options to accept tires during Mead Clean-up Day were reviewed:  Konecky Oil $5.00 car, $13.00 tractor/semi; Roadrunner Transportation $5.00 car, $6.00 – $8.00 pickup, $10.00 – $14.00 truck, $16.00+ tractor.  The board agreed that after collection and payment by the owners, the tires will be hauled to Konecky Oil.

 

The condition of the depot building was discussed.  A motion was made by Felty, second by Wimer, to table discussion until the June 12 board meeting.  Vote:  Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent; motion carried 3-0.

 

Marilyn Jensen has volunteered to maintain the median at the north entry into Mead for 2018, discussion on a business involving fireworks was held, and noted was Mead Clean-up Day on May 26 from 9:00 a.m. until 12:00 p.m.  The garbage dumpsters provided to the churches at no cost was discussed due to availability of dumpsters from a contractor.  Clerk Moline is to notify Alma Lutheran, Mead Covenant, and St. James Catholic Churches that the dumpsters will no longer be available on a free basis.  The churches shall contract with any of the three contractors that have a non-exclusive trash removal agreement with the village.  The carriers are S2 Refuse and Recycling, Roadrunner Transportation, and Waste Connections.

 

Motion by Havelka, second by Wimer, to approve a Special Designated Liquor License be issued to Sprits by Beckman to host a wedding reception at the Mead Fire Hall on June 30, 2018.  Vote:  Felty-yes, Guyle-absent, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.
