PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

October 14, 2014

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held October 14, 2014 at the Village Office.  Chairman Guyle called the meeting to order at 6:00p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Present were Chairman Gary Guyle; Trustees Shawn Havelka, Adam Miller, Richard Wielage and Rod Wimer. Also present were Clerk June Moline, Utilities/Maintenance Superintendent Nick Raver and Police Chief Jerry Carlson.  Guests present were Gus and Layla Giorgakopoulos and Tanner Shaw.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Wimer to adopt the agenda.  Vote: Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

 

The minutes of the September 9 Regular Meeting, September 9 Budget Hearing and September 29 Special Meeting stood approved as presented.

 

Motion by Wielage, second by Miller to approve the Treasurer’s Report showing $651,042.19 total checking/savings balance ending September 30, 2014.  Vote: Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0. 

 

Motion by Wielage, second by Havelka to approve the claims of $87,086.43 for payment.  Vote:  Miller-yes, Wielage-yes, Wimer-yes, abstain on Ck # 3129, Guyle-yes, Havelka-yes; motion carried 5-0. Claims being:

SCHEDULED GUESTS: 

Gus and Layla Giorgakopoulos introduced themselves as owners of  G & L Café.  They hope to open sometime in November.  They explained some of the remodeling projects they have undertaken, business hours and why they elected to locate their new business in Mead.

 

Tanner Shaw, AltEn, reported plans for reopening the ethanol plant in the near future.  Improvements were noted as well as processing plans.  The plant will have a capacity of 8.4 million bushels and plans are to process corn and milo.  He indicated an agreement will be drawn up between the village to purchase water for potable water to serve the 40-45 employees.  The water will be transported by a truck mounted tank.  Because AltEn does not have a certified water operator, the village Utility Superintendent will do the testing for them. 

 

Motion by Miller, second by Havelka to adjourn to a Public Hearing at 6:30p.m.  Vote:  Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes; motion carried 5-0.

 

PUBLIC HEARING:

Motion by Miller, second by Wielage to adopt the agenda.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes; motion carried 5-0.

 

Review of a request from Frontier Coop to rezone property located at 1555 Co Rd 10 took place.  The request is to amend the zoning from Multiple Family Residential (R-2) District to Light Industrial (M-1) District.  It has been indicated by coop staff that plans are to use the property for additional parking.

 

Guyle called for public input.

 

Miller introduced, motioned to waive three readings, and adopt Ordinance No. 653, Amend Zoning at 1555 Co Rd 10 from Multiple Family Residential (R-2) District to Light Industrial (M-1) District.  Second by Wimer.  Vote:  Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

 

ORDINANCE NO. 653

 

AN ORDINACE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA TO AMEND THE OFFICIAL ZONING MAP OF THE VILLAGE OF MEAD, NEBRASKA, BY CHANGING THE FOLLOWING LEGALLY DESCRIBED REAL ESTATE, TO WIT:

 

A TRACT OF LAND IN TRACT 10 IN THE SOUTHEAST QUARTER NORTHEAST QUARTER, SECTION 35, TOWNSHIP 15 NORTH, RANGE 8 EAST OF THE 6TH P.M., IN THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, MORE PARTICULARLY DESCRIBED AS FOLLOWS:

 

COMMENCING AT A POINT 210 FEET NORTH AND 47.25 FEET WEST OF THE SOUTHEAST CORNER OF SAID SOUTHEAST QUARTER NORTHEAST QUARTER; THENCE WEST PARALLEL WITH THE CENTERLINE OF SAID SECTION 35, A DISTANCE OF 153 FEET; THENCE NORTH PARALLEL WITH THE EAST LINE OF SAID SECTION 35, A DISTANCE OF 235 FEET; THENCE EAST PARALLEL WITH THE CENTERLINE OF SAID SECTION 35, 152.71 FEET; THENCE SOUTH 235 FEET TO THE POINT OF BEGINNING.

 

FROM MULTIPLE-FAMILY RESIDENTIAL DISTRICT (R-2) TO LIGHT INDUSTRIAL DISTRICT (M-1); TO AMEND THE MEAD COMPREHENSIVE PLAN PREVIOUSLY ADOPTED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS IT PERTAINS TO THIS AREA TO BE REZONED, AS AFORENOTED; TO AUTHORIZE THE CHAIR OF THE BOARD OF TRUSTEES AND THE CLERK OF THE VILLAGE OF MEAD TO AMEND THE OFFICIAL MAP OF THE VILLAGE OF MEAD, PURSUANT TO THIS ORDINANCE; TO PROVIDE FOR THE SERVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMHLET FORM OR VIA POSTING IN THREE (3) PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND THE EFFECTIVE DATE THEREOF; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.

 

Motion by Miller, second by Havelka to adjourn at 6:35p.m.  Vote:  Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0.

 

UTILITY/MAINTENANCE REPORT: 

Raver indicated that property to drill a test well had been selected by Olsson Associates.  Discussion was held on possible results / scenarios of the test well findings.  He reported original tapping of waterlines at N. Third Circle.  Two residences’ waterlines have been corrected.  He expressed concerns of how the board wants him to correct storm sewer issues.  The jetter and wellhouse roof are in need of repairs.  A final report on the purchase of wellhouse equipment under the Safety Grant was provided.

 

POLICE REPORT: 

The Monthly Police Report was presented.  Discussion was held on a nuisance concern at a property and nuisance / zoning concern at a second property and reported plan to conduct breathalyzer tests for Mead Public School’s Homecoming dance.

 

PLANNING COMMISSION REPORT:     

The minutes of the September 22 Regular Meeting, September 22 Public Hearing and October 1 Special Meeting and Building Permits were reviewed.  Permits being:  14-19, Bob Bice to erect a fence. 

Motion by Havelka, second by Miller to approve Building Permit 14-20, Draw Property for an addition on their warehouse / shop building.  Vote:  Wielage-yes, Wimer-abstain, Guyle-yes, Havelka-yes, Miller-yes; motion carried 4-0, 1 abstention.  The Planning Commission agreed to a request to hold a special meeting on October 1 for the project due to a report that the project was started prior to approval of the building permit, therefore a penalty will be assessed.

 

LIBRARY REPORT:

The minutes of the July 16 and September 17 Library Board Meetings were reviewed. 

 

CLERK REPORT:

Moline reported completion of the audit by Ed Schroeder, receipt of letter from Mead Public Schools regarding use of the Skidloader and vacation.  

 

NEW BUSINESS:

Motion by Miller, second by Wielage to approve “Scope of Services” to drill a test well.  Vote:  Wimer-abstain, Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes; motion carried 4-0, with 1 abstention.

 

Motion by Havelka, second by Wielage to accept the proposal of $18,349.00 to drill a test well.  Vote:  Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes, Wimer-abstain; motion carried 4-0, with 1 abstention.

 

Motion by Wimer, second by Wielage to transfer $396.85 from the Landfill Fund to the General Fund per Accountant Schroeder’s recommendation.  Vote:  Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

 

Miller introduced, motioned to waive three readings and adopt Ordinance No. 654,Establish a no parking zone along Elm Street and Highway 92.  Second by Wielage.  Vote:  Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0. 

ORDINANCE NO. 654

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO ESTABLISH A NO PARKING ZONE, AT ALL TIMES, EXCEPT FOR VEHICLES TEMPORARILY DISCHARGING OR TAKING ON FREIGHT, AND EXCEPT FOR EMERGENCY VEHICLES, IN THE FOLLOWING AREAS, TO WIT:

 

            (1) NEBRASKA HIGHWAY 92, FROM THE INTERSECTION OF   ELM STREET TO THE INTERSECTION OF COUNTY ROAD 10, ON      BOTH SIDES (NORTH AND SOUTH), OF NEBRASKA HIGHWAY        92;

 

            (2) ELM STREET FROM THE INTERSECTION OF FIRST STREET          TO THE INTERSECTION OF NEBRASKA HIGHWAY 92, ON BOTH    SIDES (EAST AND WEST); 

 

TO DECLARE THE OWNER OF ANY MOTOR VEHICLE FOUND IN VIOLATION OF THIS ORDINANCE TO BE DEEMED TO BE RESPONSIBLE FOR THE VIOLATION OF THIS ORDINANCE; TO PROVIDE THAT APPROPRIATE SIGNS SHALL BE ERECTED GIVING NOTICE OF THIS ORDINANCE; TO PROVIDE THAT THE CHAIR OF THE BOARD OF TRUSTEES AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDIANNCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED WITHIN THE FIRST FIFTEEN DAYS AFTER ITS PASSAGE AND APPROVAL EITHER IN PAMPHLET FORM OR BY POSTING IN THREE PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW, AND AS PROVIDED HEREIN; AND TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, AND THE SECTIONS OF THIS ORDINANCE MAY BE RENUMBERED TO ACCOMPLISH SUCH INTENTION.

 

It was agreed not to pursue a private / public partnership with Gretna Sanitation for removal of tree branches from the dump.  A citizen’s complaint was reviewed.

 

Discussion was held on the court case regarding the land purchase where the lagoons are located.
