PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
February 13, 2018
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held February 13, 2018 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle and Rodney Wimer. Absent was Trustee Richard Wielage. Also present was Clerk June Moline. Guests were Ben Day and Jody Weible.
The posting of the Open Meetings Law was noted.
Motion by Guyle, second by Wimer, to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
The minutes of the January 9 Regular Meeting were accepted as presented.
Motion by Guyle, second by Wimer, to approve the Treasurer’s Report showing $580,482.13 total checking/savings balance ending January 31, 2018. Vote: Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes; motion carried 4-0.
Motion by Guyle, second by Felty, to approve the claims of $21,280.94 for payment. Vote: Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-yes; motion carried 4-0. Claims being:

PUBLIC HEARING:
Roll call showed the following board members present: Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle and Rodney Wimer. Absent was Trustee Richard Wielage.
Motion by Guyle, second by Havelka, to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
Havelka reported the purpose of the hearing was to address the One and Six Year Plan for the Street Improvement Program. Discussion by the board was held, followed by a call from Havelka for public input.
Motion by Wimer, second by Havelka, to adjourn at 6:06 p.m. Vote: Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes; motion carried 4-0.
Havelka introduced and motioned to adopt Resolution 18-01, One and Six Year Street Plan for the Street Improvement Program. The motion was seconded by Felty. Vote: Havelka-yes, Wielage-absent, Wimer-yes, Felty-yes, Guyle-yes; motion carried 4-0.
VILLAGE OF MEAD
RESOLUTION NO. 18-01
The following resolution was introduced by Haveka, who moved its adoption, and
seconded by Felty,
“WHEREAS, the Village Street Superintendent has prepared and presented a
One Year and Six Year Plan for Street Improvement Program for the Village of Mead,
Nebraska, and
WHEREAS, a public hearing was held on the 13thday of February 2018, to
present this plan and there were no objections to said plan;
THEREFORE, BE IT RESOLVED BY THE Chairman and Village Board of
Trustees of Mead, Nebraska that the plans and data as furnished are hereby in all
things accepted and adopted.”
SCHEDULED GUESTS:
Ben Day, Olsson Associates, reported on the status of the water project. Since submitting the required reports to USDA the expectation is to release bids for the water treatment plant and equipment in early March. Following acceptance of the bid a pilot test will be completed in late April with a 30-day wait period for the results of the test. A holding tank will be an addition at the water treatment facility due to the lack of elevation at the site. The well sites were approved on January 4. The recommendation is to seek several contracts to complete the project. Therefore Amendment 3 for financial services by Olsson Associates was submitted due to additional multiple contractors for the project. The board tabled the amendment until additional information can be provided by Engineer Reinsch.
Planning Commission Chair Jody Weible presented additions to the zoning regulations. These being storage containers to Section 11-202 Terms; storage containers under Permitted Conditional Uses in Section 11-305 Suburban Residential 11-306 Single Family Residential, 11-307 Multiple Family District, and 11-308 Mobile Home Park District; performance standards to Section 11-314 Agricultural Industrial District; and Section 11-416 Propane Tanks. Upon discussion the board agreed to forward to the Planning Commission to consider action upon the additions to the regulations.
Motion by Havelka, second by Wimer, to enter executive session at 6:43 p.m. for protection of public interest. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-absent; motion carried 4-0.
Motion by Havelka, second by Wimer, to reconvene to regular session at 6:48 p.m. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
Felty exited the meeting at 6:48 p.m.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Clerk to prepare an ordinance for the March 13 meeting with an addition to Section 3-116.01 Municipal Water Department: Drilling Prohibited and a resolution for a lien on a property.
PLANNING COMMISSION REPORT:
The minutes of the January 29 Regular Meeting were accepted.
LIBRARY REPORT:
The minutes of the January 15 Library Board Meeting were accepted.
Motion by Havelka, second by Wimer to approve Jennifer Lee as a member of the Mead Library Board. Vote: Guyle-yes, Havelka-yes, Wielage-absent-Wimer-yes, Felty-absent; motion carried 3-0.
CLERK REPORT:
Moline reported the Dog and Cat Vaccination and License Day will be held at the Community Building on April 7 from 1:30 p.m. until 3:00 p.m. Dr. Ron Dobesh will be present to provide vaccinations and sell products. Clerk Moline will be present to sell dog and cat licenses. Mead Garage Sale Day is scheduled for May 5 from 8:00 a.m. until 2:00 p.m. Moline inquired about the collection of occupation taxes on towers which encompasses wireless service facilities, radio and television transmission towers, microwave towers, common carrier towers, cellular telephone towers or personal communications services towers, alternative tower structures, and the like that were in place prior to passage of the regulation. Street Superintendent Julie Ogden will meet with Havelka in the near future to discuss a future street project.
Motion by Wimer, second by Guyle to approve a contract with 92West to design a village website at a cost of $1,500.00. Vote: Havelka-yes, Wielage-absent, Wimer-yes, Felty-absent, Havelka-yes; motion carried 3-0.
UNFINISHED BUSINESS:
Motion by Havelka, second by Wimer to approve second reading of Ordinance No. 703 to amend Section 3-109, Municipal Water Department; Minimum Rates. Vote: Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 3-0.
NEW BUSINESS:
Guyle introduced and motioned to approve first reading of Ordinance 704, No. 705, and No. 706, Non-exclusive franchise to collect and dispose of garbage to the residents of Mead to Waste Connections, Roadrunner Transportation and S2 Recycling and Refuse, with a second by Wimer. Vote: Felty-absent, Guyle-yes, Havelka-yes, Wielage-absent, Wimer-yes; motion carried 3-0.
Havelka introduced and motioned to adopt, second by Wimer, Resolution 18-02, Interlocal Cooperation Agreement for a Mutual Finance Organization for certain municipalities and fire protection districts located in Saunders County, Nebraska. Vote: Havelka-yes, Wielage-absent, Wimer-yes, Felty-absent, Guyle-yes; motion carried 3-0.
RESOLUTION # 18-02
WHEREAS, certain municipalities and fire protection districts located in Saunders County, Nebraska desire to enter into an Interlocal cooperation agreement for the creation of a Mutual Finance Organization pursuant to Legislative Bill 1120, 1998;
WHEREAS, the Interlocal Cooperation Agreement for a Mutual Finance Organization would be in the best interests of all participating members; and
WHEREAS, the members desire to enter into a written Interlocal Cooperation Agreement for a Mutual Finance Organization.
NOW, THEREFORE, BE IT RESOLVED by the Chairperson and Board of Trustees of the Village of Mead, Nebraska:
Section 1. The Chairperson of the Board of Trustees of the Village of Mead, Nebraska is merged for fire and rescue protection services with the Mead Rural Fire Protection Dist. #8 and their subdivision boundaries lie in shall not levy any property tax for the purpose of jointly funding the operations of all members of the Mutual Finance Organization and shall not have a board member;
Section 2. The Interlocal Cooperation Agreement for a Mutual Finance Organization shall not establish a separate legal entity, but rather shall be a joint and cooperative undertaking between the members and that a joint board shall be responsible for administering this joint and cooperative undertaking.
Motion by Havelka, second by Guyle to permit Mead Days Committee to close First Street from Elm Street to Vine Street during Mead Days on June 15, 16 and 17. Vote: Wielage-absent, Wimer-yes, Felty-absent, Guyle-yes, Havelka-yes; motion carried 3-0.
Discussion of private well permit fees was tabled. Discussion on summer positions was discussed. Clerk to contact garbage carriers for prices for roll-offs for Mead Clean-up Day.
