PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

December 13, 2022

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held December 13, 2022 at the Mead Community Building. Chairman William Thorson called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson; Board of Trustees Jason Lee, Daniel Simon, and Richard Wielage. Absent was Trustee Jason Felty. Also present was Clerk June Moline.  Guests were Craig Schultz and Andrew Jackson.

 

The posting of the Open Meetings Law was noted as placed on the table at the entrance.

 

Motion by Lee, second by Wielage, to adopt the agenda. Vote: Felty-absent, Lee-yes Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

UNFINISHED BUSINESS:

The minutes of the November 8 Regular Meeting and Public Hearing were accepted.

 

NEW BUSINESS:

Motion by Simon, second by Lee, to approve the Certificate of Election of the November 8, 2022 General Election as certified by the County Clerk.  Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-absent; motion carried 4-0.

 

Clerk Moline gave the Oath of Office to Thorson and Wielage.

 

Motion by Lee, second by Thorson, to elect Clerk Moline as Chairman Pro Temp. Vote: Wielage-yes, Felty-absent, Lee-yes, Simon-yes, Thorson-yes; motion carried 4-0.

 

Moline called for nominations for Chairman of the Board.

 

Motion by Wielage, second by Lee, to nominate William Thorson for Chairman and call for nominations to cease. Vote: Lee-yes, Simon-yes, Thorson-abstain, Wielage-yes, Felty-absent; motion carried 3-1-1, with Thorson abstaining.

 

Chairman called for nominations for Chairman Pro Temp.

 

Motion by Lee, second by Simon, to nominate Jason Felty as Chairman Pro Temp and call for nominations to cease. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-absent, Lee-yes; motion carried 4-0.

 

Motion by Wielage, second by Simon, to approve Public Officials Bonds for Thorson and Moline. Vote: Thorson-yes, Wielage-yes, Felty-absent, Lee-yes, Simon-yes; motion carried 4-0.

 

Motion by Wielage, second by Lee, to approve the Treasurer’s Report showing $1,252,972.49 total checking/savings balance ending November 30, 2022. Vote: Thorson-yes, Wielage-yes, Felty-absent, Lee-yes, Simon-yes; motion carried 4-0.

Motion by Lee, second by Simon, to approve the following appointments: Clerk/Treasurer – June Moline; Utilities Superintendent – Shannon Luetkenhaus; Police Chief – Thomas Sackett, Water / Sewer Commissioner – City of Wahoo; Attorney – Bromm, Lindahl, Freeman-Caddy and Lausterer; Accountant – Edward Schroeder; Engineer – Olsson; Building and Zoning Administrator – Terry Miller; Building Inspector – Terry Miller; Nuisance Enforcement Officer – Thomas Sackett; Hearing Officer – Adam Miller. Motion by Wielage, second by Thorson, to approve the Bank of Mead as the Official Depository for the deposit of village funds. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-absent, Lee-yes; motion carried 4-0.

 

Motion by Lee, second by Simon, to approve Inspro Insurance as the Insurance Carrier, Retirement Plan Consultants as the 401k Administrator, and the Wahoo Newspaper as the Official Newspaper for the Village of Mead. Vote: Thorson-yes, Wielage-yes, Felty-absent, Lee-yes, Simon-yes; motion carried 4-0.

 

Motion by Wielage, second by Simon, to designate the method of posting of meetings in three public places within the Village of Mead as the Bank of Mead, Mead Post Office and Mead Village Office. Vote: Wielage-yes, Felty-absent, Lee-yes, Simon-yes, Thorson-yes; motion carried 4-0.

 

Motion by Thorson, second by Lee, to designate the manner in which the Planning Commission and Library Board are chosen is by appointment by the Village Board of Trustees. Vote: Felty-absent, Lee-yes, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

The following appointments were made: Common Facility Board – Simon and Wielage; Municipal Board of Health – Chairman Thorson; Police Chief Sackett, and Medical Provider Andrew Eckart; Board of Adjustment – Thorson, Felty, Lee, Wielage, and Planning Commission Chair Levi Durnal with Simon as Alternate.

 

Motion by Simon, second by Lee, to appoint Julie A. Ogden, Superintendent License Number S-1320, Class A, and Professional Engineering License Number E-9395, contracted as a consultant, beginning January 1, 2023.  Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-absent, Lee-yes; motion carried 4-0.

 

Thorson introduced Resolution 22-18.

 

Motion by Thorson, second by Simon, to adopt Resolution 22-18, Year-end Certificate of Village Street Superintendent 2022. Vote: Wielage-yes, Felty-absent, Lee-yes, Simon-yes, Thorson-yes; motion carried 4-0.

 

RESOLUTION 22-18

 

SIGNING OF THE

YEAR-END CERTIFICATION OF CITY STREET SUPERINTENDENT FORM

2022

 

Whereas:  State of Nebraska Statutes, sections 39-2302, and 39-2511 through 39-2515 details the requirements that must be met in order for a municipality to qualify for an annual Incentive Payment; and

 

Whereas:  The State of Nebraska Department of Transportation (NDOT) requires that each incorporated municipality must annually certify (by December 31st of each year) the appointment of the City Street Superintendent(s) to the NDOT using the Year-End Certification of City Street Superintendent form; and

 

Whereas:  The NDOT requires that such certification shall also include a copy of the documentation of the city street superintendents appointment, i.e. meeting minutes, showing the appointment of the City Street Superintendent by their name as it appears on their License (if applicable), their License Number (if applicable), and Class of License (if applicable), and type of appointment, i.e., employed, contract (consultant, or interlocal agreement with another incorporated municipality and/or county), and the beginning date of the appointment; and

 

Whereas:  The NDOT also requires that such Year-End Certification of City Street Superintendent form shall be signed by the Mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body authorizing the signing of the Year-End Certification of City Street Superintendent form by the Mayor or Village Board Chairperson.

 

Motion by Lee, second by Thorson, to approve the signing of the Year-end Certification of Village Street Superintendent for determining incentive payment January 1, 2022 to December 31, 2022. Vote: Wielage-yes, Felty-absent, Lee-yes Simon-yes, Thorson-yes; motion carried 4-0.

 

Motion by Simon, second by Lee, to adjourn to a Public Hearing at 6:15 p.m. Vote: Felty-absent, Lee-yes, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

PUBLIC HEARING:

Thorson called the hearing to order at 6:15 p.m. Answering roll call were Chairman Thorson; Trustees Lee, Simon, and Wielage.  Absent was Trustee Felty.

 

Thorson stated the purpose of the hearing was to hear testimony of support, opposition, criticism, suggestions, or observations to rezone two parcels within Frontier Industrial Park Plat 2.

 

Legal of parcel for Leland and Lynn Nygren to be rezoned Agricultural from Heavy Industrial:

Motion by Lee, second by Wielage, to adopt Ordinance No. 803, Rezone Frontier Industrial Park Replat 2, Lot 4 from Heavy Industrial District to Agricultural District and Lot 5 from Agricultural District to Heavy Industrial District. Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-absent; motion carried 4-0.

 

ORDINANCE NO. 803

 

AN ORDINACE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA TO AMEND THE OFFICIAL ZONING MAP OF THE VILLAGE OF MEAD, NEBRASKA, BY AMENDING THE FOLLOWING PROPERTY LOCATED AT­­­­­­ FRONTIER INDUSTRIAL PARK PLAT 2, MEAD, SAUNDERS COUNTY, NEBRASKA.

 

Motion by Wielage, second by Lee, to approve a two-year retainer with Bromm, Lindahl, Freeman-Caddy and Lausterer at $850.00 per year. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-absent, Lee-yes; motion carried 4-0.

Cedar street, mead, saunders county, nebraska; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH

 

Simon introduced Resolution No. 22-19.

 

Lee motioned to adopt Resolution No. 22-19, Variance for property described as Lots 9 and 10, Anderson & Carlson’s Addition to the Village of Mead, commonly known as 614 S. Cedar Street, to allow an addition to a garage to meet front yard setbacks. The motion was seconded by Wielage. Vote: Wielage-yes, Felty-absent, Lee-yes, Simon-yes, Thorson-yes; motion carried 4-0.

 

RESOLUTION 22-19

 

            WHEREAS, The Village of Mead authorizes the variance request from Mike Coyle of the following described real estate to wit:

 

Lots 9-10, Block 7, Anderson & Carlson’s Addition to the Village of Mead, Saunders County, Nebraska, also described as 614 S. Cedar Street, Mead, Saunders County, Nebraska.

 

Thorson introduced Resolution 22-20.

 

Motion by Wielage, second by Thorson, to adopt Resolution 22-20, Policy for payment of payroll and associated expenses prior to approval of claims. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-absent, Lee-yes; motion carried 4-0.

A resolution establishing a policy for the payment of payroll and associated expenses prior to the approval of claims by the village of mead board of trustees.

 

Motion by Simon, second by Wielage to approve a three-year renewal for firewall protection with Midwest Technology Specialists, LLC at a cost of $1,424.69. Vote: Thorson-yes, Wielage-yes, Felty-absent, Lee-yes, Simon-yes; motion carried 4-0.

 

POLICE REPORT:

Thorson reported activities completed by Chief Sackett as patrolling streets and schoolgrounds, monitoring a basketball game, and notification of a property owner regarding a nuisance concern.

 

UTILITIES/MAINTENANCE SUPERINTENDENT:

Thorson reported water duties, putting up Christmas lights assisted by Dan Simon, plan to have Shannon check lights on Christmas decorations prior to Thanksgiving 2023, and scheduled meeting on December 14 with Ryan Hurst to review the City of Wahoo Interlocal Agreement for water services.

 

PLANNING COMMISSION:

The minutes of the November 1 Regular Meeting and Public Hearing and November 28 Regular Meeting and Public Hearing were accepted.

 

Motion by Simon, second by Lee, to approve a Building Permit with AltEn, 1344 Co Rd 10, for lagoon maintenance with vents and geotube installation (A-1). Vote: Wielage-yes, Felty-absent, Lee-yes, Simon-yes, Wielage-yes; motion carried 4-0.

 

BUILDING AND ZONING ADMINISTRATOR:

Permit accepted was 22-17 Security Fence, 1048 Sunburst Lane to erect a pole building (M-1).

 

CLERK REPORT: June Moline

Motion by Thorson, second by Simon, to approve the purchase of a new handheld meter reader due to required update availability. Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-absent; motion carried 4-0.

 

Moline reminded the board of the January 8 Appreciation Dinner.
