PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
April 12, 2016
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held April 12, 2016 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Gary Guyle, Richard Wielage and Rod Wimer. Also present were incoming Trustee elect Jason Felty, Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Police Chief Jerry Carlson and Library Directors Lori Moseman and Laurie VanAckeren. Guests were Dale Rawson, Ken Laferriere and Nathan Williams.
The posting of the Open Meetings Law was noted.
Motion by Wielage, second by Guyle to adopt the amended agenda by moving Item R. to Item S. and adding item R. Executive Session to discuss the result of litigation ruling. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.
The minutes of the March 3 Special Meeting, March 8 Regular Meeting and March 24 Special Meeting were approved as presented.
Motion by Wimer, second by Wielage to approve the Treasurer’s Report showing $743,370.02 total checking/savings balance ending March 31, 2016. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 4-0.
Motion by Wielage, second by Guyle to approve the claims of $28,305.15 for payment. Vote: Wielage-yes, Wimer-yes, but abstain on Check #3472, Guyle-yes, Havelka-yes; motion carried 4-0. Claims being:

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO GRANT TO WASTE CONNECTIONS, A NON-EXCLUSIVE FRANCHISE TO COLLECT AND DISPOSE OF THE GARBAGE OF THE RESIDENTS OF THE VILLAGE OF MEAD, PURSUANT TO THE COMMERCIAL GARBAGE HAULERS FRANCHISE ORDINANCE OF THE VILLAGE OF MEAD, NEBRASKA, SECTION 10-403 OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA.
Jason Felty took the Oath of Office as a member of the Village of Mead Board of Trustees.
Motion by Wielage, second by Guyle to enter a Public Hearing at 6:12 p.m. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
PUBLIC HEARING:
Motion by Havelka, second by Wielage to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
Havelka announced the purpose of the hearing was to consider Preliminary Plats presented by Mead Public Schools to subdivide property.
Mead Public Schools Superintendent, Dr. Rawson, reported Mead Public Schools Subdivision No. 1 is requesting to be split as Lot 1 and Lot 2 and Mead Public Schools Subdivision No. 2 will be split into Lot 1, Lot 2 and Lot 3. Findings of a recent appraisal set the property values at $20,000.00 (2.27 acres) for the requested Lot 2 of Mead Public Schools Subdivision No. 1 and $7,000.00 per lot of requested Mead Public Schools Subdivision No. 2. The third piece of property the school is selling is located north of N. Second Street from Elm Street to Vine Street. It is valued at $11,000.00 per each of the two lots. He indicated sealed bids would be opened on July 6 and considered at the July 11 school board meeting for purchase of the lots. If the lots do not sell, after one year the school could consider selling the lots at public auction. Dr. Rawson requested waiver of the $200.00 per subdivision fee due to the school being a governmental agency.
Motion by Wimer, second by Guyle to approve the Preliminary Plats for Mead Public Schools Subdivision No.1 and Mead Public Schools Subdivision No. 2 with no corrections noted. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

UNSCHEDULED GUESTS:
Nathan Williams, S2 Recycling and Refuse, inquired as to whether there were questions or concerns with garbage services they recently began offering residents. S2 has placed a recycling dumpster north of the Community Building for resident use at no cost.
LIBRARY REPORT: Lori Moseman and Laurie VanAckeren
The minutes of the March 16, 2016 Library Board Meeting were accepted. The Library Directors presented the Annual Library Report (Bibliostat) and activities offered by the library. The resignations of Sara Nicola and Jenny Carritt from the board were noted.
Motion by Guyle, second by Wimer to approve Dale Rawson and Viki Miller as members of the Library Board. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-no; motion carried 4-1.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
Officer Carlson presented the monthly police report.
Discussion was held on construction of an accessory building without the required permit being acquired. The Building Inspector is to investigate the setbacks and owner contacted by Zoning Administrator Carlson. A zoning violation will be pursued in the future if an application for the Building Permit is not submitted by the property owner.
Nuisance Enforcement Officer Carlson presented documentation of a complaint on a property. Wielage introduced and motioned, second by Wimer, to adopt Resolution 16-08, Declared Nuisance of property located at Lots 15, 17, 19, and 21, Block 12, Original Town Mead. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
RESOLUTION No. 16-08
The Board of Trustees of the Village of Mead, Nebraska, in Regular Session assembled at the Village Office in Mead, Nebraska on this 12th day of April, 2016, hereby make the following findings:
WHEREAS, the Nuisance Officer has presented a report setting forth alleged nuisance violations on property legally described as: Lot 15, 17, 19 and 21, Block 12, Original Town Mead, Saunders County, Nebraska and known as 218 East Second Street, Mead, Nebraska, which is located within its village limits and within its zoning jurisdiction, identifying that in his opinion a nuisance exists as defined by Village Ordinance; said report contains photographs and other evidence pertinent to the situation, and the report was presented at a regular meeting for confirmation that a nuisance exists, a copy of said report is attached hereto, and
WHEREAS, a review by the Board of Trustees of the Village of Mead was made at a Regular Meeting held on the 12th day of April, 2016, and
WHEREAS, the Board of Trustees, after review of the report and the accompanying photographs and evidence desires to declare the conditions found therein as Nuisances pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-302 and Zoning Regulation Chapter 11, Ordinance 11-411.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD that the findings hereinabove made are incorporated herein and that the Board of Trustees declares that nuisances exists upon the property so identified which is within the zoning jurisdiction of the Village; and
BE IT FURTHER RESOLVED, that the Board of Trustees orders that the nuisances found on the property described above and described in the report attached to this Resolution shall be abated and removed no later than a date certain, that date being May 15, 2016. The nuisances to be abated and removed which are shown in the attached report and photographs and specifically violate the following Code Sections:
Municipal Code:
§4-302 (A);
§4-302 (B)13; (B) 20.
and, Zoning Regulation
Chapter 11, Ordinance 11-411.
BE IT FURTHER RESOLVED, that the Village Clerk shall notify the Nuisance Officer to serve notice upon the violators; that the Nuisance Officer shall prepare and serve notice which shall describe the found nuisances and state the required date of when abatement and removal of the nuisance shall be accomplished; and shall also provide information as to how the interested parties may request a hearing before the governing body. Notice shall be given as provided in the Municipal Code; and
BE IT FINALLY RESOLVED, that the Village shall proceed as determined under the administrative procedure of Chapter 4 of the Village of Mead Municipal Code.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported drainage concerns in the storm sewers.
Motion by Havelka, second by Wielage to approve the revised Preliminary Engineering Report for a Water Project as compiled by Olsson Associates. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
PLANNING COMMISSION REPORT:
The minutes of the March 28, 2016 Regular Meeting and Public Hearing and Building Permits 16-02, Leo and Linda Sweet to erect a fence and 16-03, Jerry and Donna Lynn to erect a fence were accepted. Acknowledged were the resignations of Jason Felty and Ruth Dobesh from the Planning Commission.
Motion by Havelka, second by Wielage to approve Building Permit 16-03, Audra Kadavy to erect a fence in the B-2, Neighborhood Business District. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
Motion by Havelka, second by Wielage to approve Matthew Bratsburg as a member of the Planning Commission. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.
CLERK REPORT: June Moline
Moline reported upcoming events, payment received and therefore release of a lien for water / sewer usage on a property, sale of forty-eight pet licenses to date, meters requiring maintenance, process to condemn a house and approval of a letter to send to residents.
NEW BUSINESS:
Park restrooms were discussed. Motion by Wimer, second by Wielage to contract Loftus Septic Pumping to supply two portable restrooms at the park for this summer. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
Motion by Wielage, second by Felty to approve an Agreement with Miller Properties to bale alfalfa at the lagoon site during 2016. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
There have been no applicants to prepare the ballfields or clean the park restrooms this summer. Marilyn Jensen has volunteered to maintain the median at the northwest entrance into Mead. A request was read from MAPA seeking financial support. No action was taken on the request.
Wielage introduced, motioned to waive three readings and adopt Ordinance No. 682, Acquisition of Tract in Huddle’s Addition for $95,000.00. Second by Wimer. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO ACQUIRE AN INTEREST IN THE FOLLOWING REAL ESTATE BY PURCHASE OR EMINENT DOMAIN, TO WIT: A TRACT OF LAND LOCATED IN HUDDLES ADDITION TO MEAD, SAUNDERS COUNTY, NEBRASKA MORE SPECIFICALLY DEFINED HEREIN, FOR THE PURPOSE OF SURVEYING, CONSTRUCTING, RECONSTRUCTING, RELOCATING, ALTERING, INSPECTING, REPAIRING, REPLACING, ADDING TO, MAINTAINING AND OPERATING AT ANY TIME, OVER, ACROSS, AND UNDER THE ABOVE DESCRIBED REAL ESTATE, A WELL AND/OR WATER TREATMENT PLANT OR OTHER PUBLIC USE FOR THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, WITH APPURENANCES AND ACCESSORIES THERETO; THAT THE INTEREST TO BE ACQUIRED IN THE ABOVE-DESCRIBED REAL ESTATE SHALL BE FEE SIMPLE TITLE; TO PROVIDE THAT THE CHAIR OF THE BOARD OF TRUSTEES AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED WITHIN THE FIRST FIFTEEN DAYS AFTER ITS PASSAGE AND APPROVAL; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.
WHEREAS, it is in the best interests of the citizens of the Village of Mead, Saunders County, Nebraska, to acquire fee simple title, for the purpose of constructing and maintaining a well and/or water treatment facility thereon or other public purpose, with appurtenances and accessories thereto, the following-described real estate, to wit:

Motion by Wimer, second by Wielage to authorize the Village Clerk and Chair to make monetary offer for purchase of Tract in Huddle’s Addition pursuant to Ordinance. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
Clerk Moline presented several options with financial institutions to seek a loan for the purchase of the Tract in Huddle’s Addition. The Village is seeking a $95,000.00 loan with four annual payments to begin October 15, 2016. Options are: Wahoo State Bank, Wahoo 6%; Great Western Bank, Wahoo 4.75%; Union Bank and Trust, Wahoo 4.75%; and Bank of Mead, Mead 2.75%.
Guyle introduced, second by Wimer to adopt Resolution 16-07, Loan with the Bank of Mead for $95,000.00 at 2.75% over four years for a Tract in Huddle’s Addition. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.
RESOLUTION 16-07
WHEREAS, the board of trustees of any village may by resolution provide for direct borrowing from a financial institution for the purchase of real property, construction of improvements or refinancing of existing indebtedness upon a certification in the resolution authorizing the direct borrowing that:

Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing would be impractical;
-
Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing could not be completed within the time restraints facing the village; or
-
Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through direct borrowing would generate taxpayer savings over traditional bond financing, and
WHEREAS, prior to approving direct borrowing, the board of trustees shall include in any public notice required for meetings a clear notation that the resolution authorizing direct borrowing from a financial institution will appear on the agenda; and
WHEREAS, the total amount of indebtedness from direct borrowing as provided herein, shall not exceed twenty percent (20%) of the municipal budget of the village, and
WHEREAS, there exists a parcel of real property which is available for purchase which is located at the site the Board of Trustees has identified as a location to place a well and/or water treatment plant, or could be used for other public purpose and said property may be acquired by agreement rather than by Eminent Domain, and
WHEREAS, the Board of Trustees deems it in the best interests of the Village of Mead to acquire said property by mutual agreement in order to save the cost, time and expense of litigation,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS FOLLOWS:

That the Board of Trustees certifies that the direct borrowing of funds for purchase of the property through traditional bond financing would be impractical, or not be completed within the time restraints facing the Village for acquisition of the property.

That public notice for the meeting this resolution was acted upon, was provided and a clear notation that this resolution authorizing direct borrowing from a financial institution did appear on the agenda.

That the amount of indebtedness for the purchase of the property to be acquired and described below shall be $95,000.00 at 2.75% interest for a period of four years payable in the following installments: $23,750.00 on October 15, 2016, $23,750.00 on October 15, 2017, $23,750.00 on October 15, 2018 and $23,750.00 on October 15, 2019.

That said indebtedness does not exceed twenty percent (20%) of the municipal budget of the Village.

That prior to approving this resolution, the Village did consider, to the extent possible, proposals from multiple financial institutions and determined to borrow the funds directly from the Bank of Mead, Mead, Nebraska, a financial institution included in the definition provided for in the findings set forth above.
