PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

October 11, 2022

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held October 11, 2022 at the Mead Community Building. Chairman William Thorson called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson; Board of Trustees Jason Felty, Jason Lee, Daniel Simon, and Richard Wielage. Also present were Clerk June Moline and Utilities/Maintenance Superintendent Shannon Luetkenhaus.  Guests were Julie Ogden, Jay Spearman, and Connie Schliffke.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Lee, to adopt the agenda. Vote:  Felty-yes, Lee-yes, Simon-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

 

The minutes of the September 13 Regular Meeting, Public Hearing, Budget Hearing, and Special Budget Hearing were accepted.

 

Motion by Simon, second by Felty, to approve the Treasurer’s Report showing $1,280,722.81 total checking/savings balance ending September 30, 2022. Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 5-0.

 

Motion by Lee, second by Felty, to approve the claims of $214,752.41 for payment. Vote:  Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-yes; motion carried 5-0. Claims being:

SCHEDULED GUEST:

Street Superintendent Julie Ogden of JEO will pursue the design amendment to include paving of Pine Street since there were no written or vocal comments from property owners. She will present the GEO results and plans at the November 8 meeting with plans to advertise for bids in December and open bids in January.

 

Motion by Simon, second by Lee, to adjourn to a Public Hearing at 6:09 p.m. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-yes; motion carried 5-0.

 

PUBLIC HEARING:

Thorson called the hearing to order. Answering roll call were Chairman William Thorson; Trustees Jason Felty, Jason Lee, Daniel Simon, and Richard Wielage.

 

Motion by Lee, second by Felty, to adopt the agenda. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-yes, Thorson-yes; motion carried 5-0.

 

Chairman stated the purpose of the hearing was to hear testimony of support, opposition, criticism, suggestions, or observations for Street Improvement District 2022-1.

 

Public input was called.

 

Motion by Simon, second by Lee, to adjourn at 6:10 p.m. Vote: Felty-yes, Lee-yes, Simon-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

 

NEW BUSINESS:

Wielage introduced Resolution 22-14.

 

Motion by Felty, second by Thorson, to adopt Resolution 22-14, Intent to Incur Indebtedness for Street Improvements. Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 5-0.

 

RESOLUTION NO. 22-14

 

A RESOLUTION DECLARING INTENT TO INCUR INDEBTEDNESS FOR STREET IMPROVEMENTS.     

 

BE IT RESOLVED BY THE CHAIRPERSON AND VILLAGE BOARD OF THE VILLAGE OF MEAD, IN THE STATE OF NEBRASKA: 

 

Section 1. The Chairperson and Board hereby find and determine that it is necessary and appropriate to declare an official intent to issue tax-exempt street improvement bond anticipation notes or general obligation various purpose bonds or other tax-exempt bonds or notes of the Village and, in addition, to declare the Village’s reasonable expectation to reimburse certain expenditures with the proceeds of such bonds or notes issued by the Village in connection with the construction of paving and related infrastructure improvements on East First Street (from North Spruce Street to County Road 10) and on Pine Street (north from East First Street to its termination point), together with engineering, legal, financing and other related project costs. 

 

Section 2.  This resolution is a statement of the official intent of the Village under Treasury Regulation § 1.150-2 and for such purpose the following information is hereby stated: 

 

(a)        The project for which expenditures may be made is paving and related infrastructure improvements, and including engineering, legal, financing and other related project costs.

 

Lee introduced Resolution 22-16.

 

Motion by Wielage, second by Thorson, to adopt Resolution 22-16, Notice Provided on Creation of Street Improvement District No. 2022-1. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-yes, Thorson-yes; motion carried 5-0.

 

RESOLUTION NO. 22-16

 

BE IT RESOLVED BY THE CHAIRPERSON AND VILLAGE BOARD OF THE VILLAGE OF MEAD, NEBRASKA AS FOLLOWS:

 

The Chairperson and Village Board hereby find and determine:

 

That an Ordinance creating Street Improvement District No. 2022-1 was previously adopted by the Chairperson and Village Board; that notice has been given in accordance with law to the owners of record title of the property directly abutting the streets to be improved in said District, advising said owners of their right to timely object to the creation of the District; and that the written objections to the creation of Street Improvement District No. 2022-1 of the Village of Mead, Nebraska, are insufficient to cause repeal of the ordinance creating said District. 

 

Accordingly, the Village will commence construction of improvements in Street Improvement District No. 2022-1 and will levy assessments on the lots abutting on or adjacent to the street in the District in proportion to the benefits to such lots.

 

Felty introduced Resolution 22-15.

 

Motion by Thorson, second by Simon, to adopt Resolution 22-15, Amend Employee Handbook with the Addition of the Duties of the Building and Zoning Administrator and Building Inspector. Vote: Lee-yes, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 5-0.

 

RESOLUTION NO. 22-15

 

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, TO AMEND THE EMPLOYEE HANDBOOK WITH THE ADDITION OF THE DUTIES OF THE BUILDING AND ZONING ADMINISTRATOR AND BUILDING INSPECTOR.

 

Motion by Wielage, second by Thorson, to approve a project to install a water line and hydrant at the Water Treatment Plant.  This will be supported using USDA grant dollars. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-yes; motion carried 5-0.

 

Annual review of the Conditional Use Permits took place. Questioned was Ordinance No. 648.  Clerk will investigate.

 

UTILITIES/MAINTENANCE SUPERINTENDENT REPORT:  Shannon Luetkenhaus

Luetkenhaus reported the storm sewer and concrete on Eighth Street has been repaired by Big Red Home Improvement, streets south of the railroad tracks have been tarred by Bader’s Highway and Street Maintenance, maintenance at the lagoons have been completed to allow equal amounts of water to flow into the system, and Velodyne repaired the polymer system at the Water Treatment Plant.

PLANNING AND ZONING ADMINISTRATOR REPORT:

Building Permit 22-13 issued to Robert Morin to construct a wood deck at 1069 Co Rd L (SR) was reported.

 

Motion by Lee, second by Simon, to approve a Building Permit Application from Kim and Wayne Thorson to install a well at Todd Valley Farms, 950 Co Rd M (Ag). Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-yes; motion carried 5-0.

 

LIBRARY REPORT:

The minutes of the September 6 meeting were accepted.  Discussion was held on a possible Workmen’s Compensation case.

 

CLERK REPORT: June Moline

Moline reported Village accountants will be in-house on October 17 and 18 to complete the October 1, 2021 through September 30, 2022 audit, asked if concerns for route of Cedar and Eighth Street for pick-up during St. James Catholic Church’s Annual Pancake Feed on November 6th, and approved to contact Farmer Brown’s for the Annual Appreciation Dinner.
