PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
November 11, 2014
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held November 11, 2014 at the Village Office. Chairman Guyle called the meeting to order at 6:00p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Wahoo Newspaper, Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Present were Chairman Gary Guyle; Trustees Shawn Havelka, Richard Wielage and Rod Wimer. Absent was Trustee Adam Miller. Also present was Clerk June Moline. Guests present were Ed Schroeder, Melissa Konecky and Don Anderson.
The posting of the Open Meetings Law was noted.
Motion by Wielage, second by Wimer to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Miller-absent, Wielage-yes, Wimer-yes; motion carried 4-0.
The minutes of the October 14 Regular Meeting and October 14 Public Hearing stood approved as presented.
Motion by Havelka, second by Wielage to approve the Treasurer’s Report showing $670,652.54 total checking/savings balance ending October 31, 2014. Vote: Havelka-yes, Miller-absent, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 4-0.
Motion by Wielage, second by Havelka to approve the claims of $23,162.37 for payment. Vote: Miller-absent, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 4-0. Claims being:

Miller entered the meeting at 6:05 p.m.
SCHEDULED GUEST:
Village Accountant, Ed Schroeder, presented the Audit Report for fiscal year October 1, 2013 through September 30, 2014. He reported the audit is a Single Audit, which required additional auditing due to the receipt of federal funds received over $500,000.00. The funds were received for the wastewater project.
Motion by Wielage, second by Wimer to approve the Audit Report for fiscal year October 1, 2013 through September 30, 2014. Vote: Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes; motion carried 5-0.
Motion by Wimer, second by Havelka to adjourn to a Public Hearing at 6:25 p.m. Vote: Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes; motion carried 5-0.
PUBLIC HEARING:
Motion by Havelka, second by Wielage to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
Guyle stated the purpose of the hearing was to address a recommendation of the Planning Commission to approve a Permitted Conditional Use Permit to AltEn for an ethanol plant and related agricultural processing facilities. Discussion followed.
Guyle called for public input. Melissa Konecky stated she had concerns about the plant. Her questions will be forwarded to Tanner Shaw for a response.
Havelka introduced, motioned to waive three readings and adoption of Ordinance No. 655 for a Permitted Conditional Use Permit to AltEn for an ethanol plant and related agricultural processing facilities. A second to the motion was made by Wielage. Vote: Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.
ORDINANCE NO. 655
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND THE OFFICIAL ZONING MAP OF THE VILLAGE OF MEAD, NEBRASKA, PERTAINING TO THE FOLLOWING-DESCRIBED REAL ESTATE, TO WIT:
1344 CO RD 10, MEAD, SAUNDERS COUNTY, NEBRASKA
BY ALLOWING THEREON A CONDITIONAL PERMITTED USE, I.E. ETHANOL PLANT AND RELATED AGRICULTURAL PROCESSING FACILITIES, TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, OR PROVISION OR PORTION OF THIS ORDINANCE FOUND UNCONSTITUTIONAL OR INVALID; TO PROVIDE FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED BY POSTING WITHIN THE FIRST FIFTEEN DAYS AFTER ITS PASSAGE AND APPROVAL, AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW, AND AS PROVIDED HEREIN; AND THAT IT IS THE INTENTION OF THE CHAIR AND BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AND IT IS HEREBY ORDAINED, THAT THE PROVISIONS OF THIS ORDINANCE SHALL NOT BE MADE A PART OF THE ZONING ORDINANCE OF THE VILLAGE OF MEAD, NEBRASKA

UNSCHEDULED GUEST:
Don Anderson, representing Draw Properties, inquired about zoning on a property he is considering purchasing. He had been approached about purchasing the property and was concerned if a zoning change would be required prior to his purchasing the property. Consideration for use of the property is to store his business equipment or possibly erect a shed to be used for storage. He was advised to present his question to the Planning Commission at their regular meeting on November 24.
UTILITY/MAINTENANCE REPORT: Nick Raver
Raver presented a paper report due to his absence. He reported recent concrete replacement on Elm Street.
POLICE REPORT: Jerry Carlson
The Monthly Police Report was presented. Carlson presented documentation of contact he had made recently with the owner of Wild West Trading Post.
PLANNING COMMISSION REPORT:
The minutes of the October 27 Meeting and Building Permit were reviewed. Permit being: 14-21, Gary Hollst – demolition of a four-season room.
LIBRARY REPORT:
The minutes of the October 15 Library Board Meeting were reviewed.
CLERK REPORT: June Moline
Moline presented meters requiring maintenance and guidelines for a board vacancy. The schedule for repayment of loan dollars for the wastewater project was reviewed.
UNFINISHED BUSINESS:
Motion by Miller, second by Havelka to donate $1,000.00 to Mead Ball Association toward a fence at the park.
NEW BUSINESS:
Discussion was held on the need for AltEn to pursue the Ingterlocal Agreement for water testing which they are seeking from the village, dump regulations, and a delinquent water/sewer account. Several written complaints were reviewed. Annexation of properties is considered a mute subject at this time. The Post-Christmas Party for employees and board members is scheduled for January 16 at Red Zone Bar and Grill. Several items the board wishes to address with Police Chief Carlson will be placed on the December 9 regular board meeting agenda.
