PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

February 11, 2025

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held February 11, 2025 at the Village Office. Chairman Thorson called the meeting to order at 6:00 pm. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public.  Answering roll call were Board Chairman William Thorson and Trustees Jason Felty, Daniel Simon, and Richard Wielage. Absent was Trustee Jason Lee.  Also present were Clerk June Moline, Utilities/Maintenance Superintendent Shannon Luetkenhaus, and Library Director Laurie VanAckeren.  Guests were Andrew Jackson, Jennifer Lee, and J.P. Hannan.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Felty, to adopt the agenda. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

Motion by Wielage, second by Simon, to adjourn to a Public Hearing at 6:00 pm. Vote: Lee-absent, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

 

PUBLIC HEARING

Chairman Thorson called the hearing to order at 6:00 pm. Answering roll call were Jason Felty, Daniel Simon, William Thorson, and Richard Wielage. Absent was Jason Lee.

 

Motion by Simon, second by Felty, to adopt the agenda. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0.

 

Thorson stated that the purpose of the hearing was to hear testimony of support, opposition, criticism, suggestions, or observations on a petition from J. P. Hannan for a variance to amend Zoning Regulation Article 5, Zoning Districts; Land Use Categories and Zoning Matrix; Section 5.09, (R-1) Low Density Residential District; 5.09.06 Height and Lot Requirements: Side Yard not less than five (5’) feet. Mr. Hannan is asking to place the garage on the lot line of the side yard on real estate described as:

 

PT TRACT 2 MEAD IN 35-15-8, MEAD, SAUNDERS COUNTY, NEBRASKA, also known as 116 E. First Street, Mead, Nebraska.

 

Thorson called for public input.

 

Mr. Hannan stated that he has amended his plans and will be constructing the garage on the required 5’ yard setback.

 

Motion by Wielage, second by Thorson, to adjourn to the Regular Meeting at 6:03 pm. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0.

 

NEW BUSINESS

The minutes of the January 14 Regular Meeting were accepted.

 

Motion by Thorson, second by Wielage, to approve the Treasurer’s Report showing $1,243,966.91 total checking/savings balance ending January 31. Vote: Lee-absent, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes;  motion carried 4-0.

 

Motion by Wielage, second by Simon, to approve Master Agreement Work Order with Olsson for general engineering consulting services in the amount of $26,000.00 for 2025. The allowed break-down is for General Engineering Consulting Services , SCADA On-Call Services, and GIS Map Updates. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0.

 

Motion by Thorson, second by Felty, to approve the claims of $29,443.40 for payment. Vote:  Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0. Claims being:

NEW BUSINESS

Thorson reported he had spoken to the City of Yutan regarding police protection. They will submit a proposal at the March 11 meeting.

 

Felty introduced and motioned to adopt Resolution 25-02, Interlocal Cooperation Agreement for a Mutual Finance Organization. Simon seconded the motion. Vote: Wielage-yes, Felty-yes, Lee-absent, Simon-yes, Thorson-yes; motion carried 4-0.

 

RESOLUTION # 25-02

 

            WHEREAS, certain municipalities and fire protection districts located in Saunders County, Nebraska desire to enter into an Interlocal cooperation agreement for the creation of a Mutual Finance Organization pursuant to Legislative Bill 1120, 1998;

 

            WHEREAS, the Interlocal Cooperation Agreement for a Mutual Finance Organization would be in the best interests of all participating members; and

 

            WHEREAS, the members desire to enter into a written Interlocal Cooperation Agreement for a Mutual Finance Organization.

 

            NOW, THEREFORE, BE IT RESOLVED by the Chairperson and Board of Trustees of the Village of Mead, Nebraska:

 

            Section 1.  The Chairperson of the Board of Trustees of the Village of Mead, Nebraska is merged for fire and rescue protection services with the Mead Rural Fire Protection Dist. #8 and their subdivision boundaries lie in shall not levy any property tax for the purpose of jointly funding the operations of all members of the Mutual Finance Organization and shall not have a board member;

 

            Section 2.  The Interlocal Cooperation Agreement for a Mutual Finance Organization shall not establish a separate legal entity, but rather shall be a joint and cooperative undertaking between the members and that a joint board shall be responsible for administering this joint and cooperative undertaking.

 

Thorson introduced and motioned to adopt Resolution 25-05, Easement on real estate described as A part of Tract 2 in the Village of Mead, Saunders County, Nebraska commencing at a point 1260 feet West from the Northeast Corner of the South Half of the Northeast Quarter of Section 35, Township 15, Range 8, Saunders County, Nebraska, thence running West 60 feet, thence South 277 Feet, Thence East 60 feet, Thence North 277 Feet to the Point of Beginning, also known as the West 60.00 Feet of Tract 2. The motion was seconded by Simon. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

RESOLUTION NO. 25-05

 

            WHEREAS, the Village of Mead, Saunders County, Nebraska controls the following described property: 

 

            WHEREAS, said property provides ingress and egress access to the following described property;    A part of Tract 2 in the Village of Mead, Saunders County, Nebraska commencing at a point 1260 feet West from the Northeast Corner of the South Half of the Northeast Quarter of Section 35, Township 15, Range 8, Saunders County, Nebraska, thence running west 60 feet, thence South 277 Feet, thence East 60 Feet, thence North 277 Feet to the Point of Beginning, also known as the West 60.00 Feet of Tract 2.

 

            WHEREAS, the Board of Trustees desires to provide a written and recorded easement to allow ingress and egress to the garage structure located upon the property described above for so long as a garage structure exists at said location.

 

Motion by Thorson, second by Felty, to approve an Easement Agreement with James P. Hannan and Candice K. Hannan to construct a garage within the easement approved in Resolution No. 25-05. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0.

 

Wielage introduced and motioned to adopt Resolution 25-03, Declaring intent to levy special assessments against property in Street Improvement Project No. 2022-1 of the Village and giving notice of a Public Hearing on East First Street, consisting of a single block extending from North Spruce Street to County Road 10. Felty seconded the motion. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0.

 

RESOLUTION NO. 25-03

 

A RESOLUTION OF THE BOARD OF THE VILLAGE OF MEAD, NEBRASKA, DECLARING ITS INTENT TO LEVY SPECIAL ASSESSMENTS AGAINST PROPERTY IN STREET IMPROVEMENT PROJECT NO. 2022-1 OF THE VILLAGE AND GIVING NOTICE OF A PUBLIC HEARING WITH REGARD TO THE SAME.

 

            WHEREAS, the Village has previously established by ordinance Street Improvement Project No. 2022-1 of the Village and has constructed paving and other related improvements in said Project; and

 

            WHEREAS, to pay the costs of such improvements, the Village intends to levy special assessments against the property specifically benefitted by the improvements in said Project in accordance with Neb. Rev. Stat. § 17-524; and

 

            WHEREAS, the parcels subject to special assessment for a portion of the costs of the improvements in the Project, which parcels are completely and/or partially included within the boundaries of the Project, are the following: Parcel No. 005559003 (N 96’ of Lot 12, Wilson’s Subdivision) & 005559002 (Lot 12 except N 96’, Wilson’s Subdivision), Parcel No. 005559001 (Lot 11, Wilson’s Subdivision), Parcel No. 005558501 (Lot 10, Wilson’s Subdivision), Parcel No. 005558502 (Lots 8 and 9, and the South 30’ of Lot 7, Wilson’s Subdivision), Parcel No. 005558000 (North 188.6 feet of Lot 7, Wilson’s Subdivision), Parcel No. 005557500 (Lot 6, Wilson’s Subdivision and North 14’ of Vacated 1st Street), Parcel No. 005557000 (Balance of Lot 3 and all of Lots 4-5, Wilson’s Subdivision), Parcel No.  005561000 (Tract D, Welsh’s Subdivision and North 14’ of Vacated 1st Street).             NOW THEREFORE, BE IT RESOLVED by the Village of Mead, that at a meeting to be held at 6:00 p.m. on the 8th day of April, 2025, the Village will consider and adopt a levy of special assessments in Street Improvement Project No. 2022-1.

 

Simon introduced and motioned to adopt Resolution 25-04, Declaring intent to levy special assessment against property in Street Improvement Project No. 2022-1 of the Village and giving notice of a Public Hearing on Pine Street from East First Street north approximately 270 feet to its termination point at the boundary of the property owned by Mead Public Schools. The motion was seconded by Wielage. Vote: Wielage-yes, Felty-yes, Lee-absent, Simon-yes, Thorson-yes; motion carried 4-0.

 

RESOLUTION NO. 25-04

            WHEREAS, to pay the costs of such improvements, the Village intends to levy special assessments against the property specifically benefitted by the improvements in said District in accordance with Neb. Rev. Stat. § 17-524; and

 

            WHEREAS, the parcels subject to special assessment for a portion of the costs of the improvements in the District, which parcels are completely and/or partially included within the boundaries of the District, are the following: Tracts A (Parcel No. 005559500), B (Parcel No. 005560000), C (Parcel No. 005560500), D (Parcel No. 005561000), E (Parcel No. 005561500), and F (Parcel No. 005562000), all in Welsh’s Subdivision of the Village of Mead, Saunders County, Nebraska;

 

               NOW THEREFORE, BE IT RESOLVED by the Village of Mead, that at a meeting to be held at 6:00 p.m. on the 8th day of April, 2025, the Village will consider and adopt a levy of special assessments in Street Improvement District No. 2022-1.

 

Motion by Felty, second by Simon, to approve an agreement between the Village of Mead and Mead Lawn and Hay LLC to bale alfalfa in 2025 on property belonging to the village. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

Discussion was held on two complaints from citizens.

 

UTILITIES/MAINTENANCE SUPERINTENDENT REPORT – Shannon Luetkenhaus

Luetkenhaus reported daily duties at the water plant; meter replacement; water main break between First and Second Streets on Spruce Street; frozen pump at the lift station at the water plant; Christmas decorations removed; sewer issue at a residence; salt applied to streets; flushing hydrants and working with SCADA and SECO on an issue at the water plant.

 

PLANNING COMMISSION

The minutes of the January 27 Special Meeting and Public Hearing were accepted. The Building/Demolition Permits for 2024 were reviewed.

 

LIBRARY REPORT

The minutes of the February 4 Library Board Meeting were accepted.

 

CLERK REPORT – June Moline

Moline presented the annual community newsletter for review; forthcoming increase in electrical rates; and attendance of meetings with the NRD and the Wahoo Development Foundation.

 

Discussion was held on the recent water issue and future Highway 92 improvements.
