PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
December 10, 2019

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held December 10, 2019 at the Village Office. Chairman Guyle called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Gary Guyle, Trustees William Thorson, Richard Wielage, and Rodney Wimer. Absent was Trustee Jason Felty. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, and Police Chief Jerry Carlson. Guests were Craig Reinsch and Josh Girmus.

The posting of the Open Meetings Law was noted.

Motion by Wielage, second by Wimer, to adopt the agenda. Vote: Felty-absent, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 4-0.

Motion by Wimer, second by Thorson, to appoint Clerk Moline as Chairman Pro-tempore. Vote: Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

Moline called for nominations for chairman.

Motion by Guyle, second by Wimer, to nominate Thorson as chairman. Vote: Thorson-abstain, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 3-0, with 1 abstention.

Motion by Wielage, second by Guyle, that nominations for chairman cease and Thorson be elected chairman. Vote: Wielage-yes, Wimer-yes, Guyle-yes, Felty-absent, Thorson-yes; motion carried 4-0.

Chairman Thorson called for nominations for Chairman Pro-tempore to serve as chairman in the absence of the chairman.

Motion by Thorson, second by Guyle, to nominate Wimer as Chairman Pro-tempore. Vote: Wimer-yes, Felty-absent, Guyle-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

The minutes of the November 12 Regular Meeting and December 9 Special Meeting were approved.

Motion by Guyle, second by Wielage, to approve the Treasurer’s Report showing $762,378.50 total checking/savings balance ending November 30, 2019. Vote: Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-absent; motion carried 4-0.

Motion by Guyle, second by Thorson, to approve Certificate of Payment #8 to Maquire Iron LLC in the amount of $38,250.00 for painting and fence. Vote: Thorson-yes, Wielage-yes, Wimer-yes, Felty-absent, Guyle-yes; motion carried 4-0.

RESOLUTION 19-19

SIGNING OF THE
YEAR-END CERTIFICATION OF CITY STREET SUPERINTENDENT FORM
2019

Whereas: State of Nebraska Statutes, sections 39-2302, and 39-2511 through 39-2515 details the requirements that must be met in order for a municipality to qualify for an annual Incentive Payment;

Whereas: The State of Nebraska Department of Transportation (NDOT) requires that each incorporated municipality must annually certify (by December 31st of each year) the appointment of the City Street Superintendent to the NDOT using the Year-End Certification of City Street Superintendent form;

Whereas: The NDOT requires that such certification shall also include a copy of the meeting minutes showing the appointment of the City Street Superintendent by their name as it appears on their License (if applicable), their License Number and Class of License (if applicable), and type of appointment, i.e., employed, contract (consultant, or interlocal agreement with another incorporated municipality and/or county), and the beginning date of the appointment; and

Whereas: The NDOT also requires that such Year-End Certification of City Street Superintendent form shall be signed by the Village Board Chairperson and shall include a copy of a resolution of the governing body authorizing the signing of the Year-End Certification of City Street Superintendent form by the Village Board Chairperson.

Be it resolved that the Village Board Chairperson of Village of Mead is hereby authorized to sign the attached Year-End Certification of City Street Superintendent form.

Thorson stated an application had been received from Audra Wirth to rezone her property located at 416 S. Vine Street. The property is currently zoned Neighborhood Business. The current zoning makes it difficult to sell the property due to requirements by loan institutions. The property currently abuts property to the east that is zoned Multiple-family Residential.

Thorson called for public input.

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
The Monthly Police Report was reviewed.

Motion by Thorson, second by Wielage, that Police Chief clock in and out on the village timeclock and with the Saunders County Sheriff’s Department while on duty. Vote: Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported on recent violation of the dump and stated that he would contact the Department of Environment and Energy that the site will be used to conduct training for the Fire Department and will not seek renewal of the burn permit issued by the DEE. He indicated he has stopped draining the lagoon site and that all paperwork had been submitted to the DEE regarding the project. Discussion was held on process when water leaks occur at a property.

SCHEDULED GUESTS:
Craig Reinsch, Olsson, presented the one bid received for Phase II. Since the bid was $1M over the anticipated estimate Olsson could not recommend acceptance of the bid. He also stated the USDA did not have the additional funds to support the bid. He indicated he could contact contractors who may be interested in submitting a bid within the next four to six months for the project. He indicated contractors are busy with projects due to the 2019 flooding and major development within the Omaha-Lincoln area. Discussion was held on bidding the project to separate contractors with a general contractor overseeing all of the contractors who would work with the engineer, USDA, and NDHHS to meet guidelines. Erection of the fence by Maquire will resume as planned, as well as water samples being taken.

Motion by Thorson, second by Wimer, to approve Change Order 1, erection of the fence around the perimeter of the water site by Maquire Iron. Vote: Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

POLICE REPORT: Jerry Carlson
Carlson highlighted items from his monthly report including parking and warning tickets issued following a snowstorm.

PLANNING COMMISSION REPORT:
The minutes of the November 25 Regular Meeting and Public Hearing were accepted.

Motion by Guyle, second by Wimer, to approve Building Permit 19-23 to Girmus Investments to erect two pole buildings with doors at 1058 Sunburst Lane. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes; motion carried 5-0.

Josh Girmus also inquired as to whether the board would accept a donation of several types of trees he has available.

LIBRARY REPORT:
The minutes of the November 18 Library Board meeting were accepted.

CLERK REPORT: June Moline
Moline noted the Appreciation Dinner will be held on January 5 with RSVP’s due to the office by December 30.

UNFINISHED BUSINESS:
Motion by Wimer, second by Wielage, to approve second reading of Ordinance No. 737, Unsafe Buildings. Vote: Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

NEW BUSINESS:
Motion by Thorson, second by Felty, to approve the Common Board Facility Agreement with Mead Public Schools. Vote: Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

Motion by Wimer, second by Wielage, to approve the Master Agreement for Professional Services with Olsson. Vote: Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

Discussion was held on spilling of contents from the recycling containers located south of the Fire Station during recent high winds. The neighbors were concerned as to who was going to clean their yard. The board requested Moline to contact S-2 to pick up the four recycling bins and that recycling would no longer be available. Damage to a trailer borrowed from AWS was discussed. A claim has been filed by AWS.

Motion by Thorson, second by Wielage, to introduce, waive three readings, and adopt Ordinance No. 739, Wage increase to the Library Aide. Vote: Thorson-yes, Wielage-no, Wimer-no, Felty-yes, Guyle-no; motion failed 2-3.
