PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

November 8, 2022

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held November 8, 2022 at the Mead Community Building. Chairman William Thorson called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson; Board of Trustees Jason Felty, Daniel Simon, and Richard Wielage. Absent was Trustee Jason Lee. Also present was Clerk June Moline.  Guests were Ed Schroeder, Lisa Flesner, Andy Jackson, and Lynn Nygren.

 

The posting of the Open Meetings Law was noted as placed on the table at the entrance.

 

Motion by Felty, second by Wielage, to adopt the agenda. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

The minutes of the October 11 Regular Meeting and Public Hearing were accepted.

 

Motion by Simon, second by Felty, to approve the Treasurer’s Report showing $1,214,342.25 total checking/savings balance ending October 31, 2022. Vote: Lee-absent, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

 

Motion by Felty, second by Simon, to approve the claims of $64,433.13 for payment. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0. Claims being:

Motion by Thorson, second by Wielage, to adopt Ordinance No. 801, Issuance of Street Improvement Bond Anticipation Notes. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

ORDINANCE NO. 801

 

AN ORDINANCE PROVIDING FOR THE ISSUANCE OF STREET IMPROVEMENT BOND ANTICIPATION NOTES, SERIES 2023, IN THE AMOUNT OF NOT TO EXCEED NINE HUNDRED THOUSAND DOLLARS ($900,000) FOR THE PURPOSE OF PAYING THE COSTS OF CONSTRUCTING PAVING IMPROVEMENTS WITHIN THE VILLAGE OF MEAD, NEBRASKA AND NECESSARY APPURTENANCES THERETO; PROVIDING FOR A PAYING AGENT AND REGISTRAR OF THE NOTES; AGREEING TO ISSUE BONDS TO PAY THE NOTES AND ACCRUED INTEREST AT MATURITY; PRESCRIBING THE FORM OF THE NOTES; AUTHORIZING THE SALE AND DELIVERY OF THE NOTES TO THE PURCHASER.

 

SCHEDULED GUESTS:

Accountant Lisa Flesner, presented the Audit Report for the October 1, 2021 through September 30, 2022 fiscal year.  She highlighted available cash as the highest it has ever been and individual income and expenses for the individual funds. When questioned, Accountant Ed Schroeder reported the village is healthier than ever and to continue to finance projects and stay active.

 

NEW BUSINESS:

Motion by Wielage, second by Simon, to approve the October 1, 2021 through September 30, 2022 Audit Report. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0.

 

Motion by Thorson, second by Simon, to approve Amendment to Owner-Engineer Agreement No. 01 with JEO Consulting for First and Pine Street Improvements with the addition of the Pine Street Improvement for a total of $110,320.00. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0.

 

Proposals were opened for geotechnical services for the Street Improvement Project. Proposals were received from Thiele Geotech, Inc., Mid-State Engineering and Testing, and Terracon.

 

Motion by Felty, second by Wielage, to accept the proposal from Thiele Geotech, Inc. for geotechnical services. Vote: Wielage-yes, Felty-yes, Lee-absent, Simon-yes, Thorson-yes; motion carried 4-0.

 

Motion by Felty, second by Wielage, to adjourn to a Public Hearing at 6:33 p.m. Vote: Felty-yes, Lee-absent, Simon-yes, Thorson-yes, Wielage-yes; motion carried 4-0.

 

PUBLIC HEARING:

A Public Hearing was called at 6:33 p.m. Answering roll call were Chairman William Thorson; Trustees Jason Felty, Daniel Simon, and Richard Wielage.  Absent was Trustee Jason Lee.

 

The Open Meetings Posting was noted as placed on the table by the front entrance.

 

Motion by Wielage, second by Simon, to adopt the agenda. Vote: Lee-absent, Simon-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

 

Thorson stated the purpose of the hearing was to hear testimony of support, opposition, criticism, suggestions, or observations on Application for Frontier Industrial Park Replat 2.

 

Thorson called for public input.

 

There being no public input, motion by Wielage, second by Felty, to adjourn at 6:35 p.m. Vote:  Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0.

Moline presented interest rates from financial institutions for a 48-month loan in the amount of $53,154.00 to finance tarring the streets south of the railroad tracks.  Rates being: Bank of Mead 5.25%, Wahoo State Bank 6.75%, and First Bank of Nebraska 6.75%.

 

Felty introduced, second by Thorson, Resolution 22-17. Vote: Simon-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-absent; motion carried 4-0.

 

Motion by Simon, second by Felty, to adopt Resolution 22-17, Loan with the Bank of Mead in the amount of $53,154.00 for 48 months at a rate of 5.25% to finance tarring of the streets. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-absent, Simon-yes; motion carried 4-0.

 

 RESOLUTION 22-17

 

WHEREAS, the Board of Trustees of any village may by resolution provide for direct borrowing from a financial institution for the purchase of equipment, construction of improvements or refinancing of existing indebtedness upon a certification in the resolution authorizing the direct borrowing that:

 

  1. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing would be impractical;
  2. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing could not be completed within the time restraints facing the village; or
  3. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through direct borrowing would generate taxpayer savings over traditional bond financing, and

 

WHEREAS, prior to approving direct borrowing, the board of trustees shall include in any public notice required for meetings a clear notation that the resolution authorizing direct borrowing from a financial institution will appear on the agenda; and for payment to Bader’s Highway and Street for tarring the streets south of the railroad tracks in the amount of $53,154.00.

 

WHEREAS, the Board of Trustees deems it in the best interests of the Village of Mead to acquire said equipment by mutual agreement,

 

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS FOLLOWS:

 

  1. That the Board of Trustees certifies that the direct borrowing of funds for tarring of the streets south of the railroad tracks through traditional bond financing would be impractical.

 

  1. That public notice for the meeting this resolution was acted upon, was provided and a clear notation that this resolution authorizing direct borrowing from a financial institution did appear on the agenda.

 

  1. That the amount of indebtedness for the payment of work completed and described below shall be $53,154.00 at 5.25% interest for a period of four (4) years payable in the following installments: $13,288.50 principal plus interest on September 15, 2023, $13,288.50 principal plus interest on September 15, 2024, $13,288.50 principal plus interest on September 15, 2025, and $13,288.50 principal plus interest will be paid on September 15, 2026.

 

POLICE REPORT:

The board requested a Police Report be submitted periodically or for the Police Chief to attend board meetings periodically.

 

PLANNING COMMISSION:

The minutes of the September 26 Regular Board Meeting were accepted.

 

PLANNING AND ZONING ADMINISTRATOR REPORT:

Permits accepted were Permit 22-15 issued to Steve Kadavy, 409 S. Oak St. to install a deck (R-2) and 22-16 issued to Chandler Sorensen, 321 S. Oak St. to demolish a barn (R-2).

 

LIBRARY REPORT:

The minutes of the October 4 meeting were accepted.

 

CLERK REPORT: June Moline

Moline reported on a Conditional Use Permit that has been questioned by the Board, Mead Clean-up Day is scheduled for June 10, 2023, Village LMI rate, current projects undertaken, and Appreciation Dinner is scheduled for January 8, 2023.

 

Items placed in the iron / metal dumpster was discussed.
