PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

July 8, 2014

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held July 8, 2014 at the Village Office.  Chairman Guyle called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Wahoo Newspaper and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka, Adam Miller and Richard Wielage.  Absent was Trustee Rod Wimer.  Also present were Clerk June Moline and Utility/Maintenance Superintendent Nick Raver. Guest present was Phil Dawson.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Havelka to adopt the agenda.  Vote:  Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes, Wimer-absent; motion carried 4-0.

 

The minutes of the June 10 Regular Meeting and June 19 Special Meeting were approved as presented.

 

Motion by Wielage, second by Miller to approve the Treasurer’s Report showing $607,168.45 total checking/savings balance ending June 30, 2014.  Vote: Havelka-yes, Miller-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 4-0.

 

Motion by Wielage, second by Miller to approve the claims of $69,254.28 for payment.  Vote:  Miller-yes, Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 4-0. Claims being:

Motion by Havelka, second by Miller to enter a Public Hearing at 6:10 p.m.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes, Miller-yes; motion carried 4-0.

 

PUBLIC HEARING:

Chairman Guyle stated the purpose of the Public Hearing was to address rezoning 45.72 acres of land located at the village owned wastewater lagoon site.  The request is to change the zoning from the Agricultural District to Light Industrial District. 

 

Discussion was held, followed by call for public input.

 

Motion by Miller to introduce, waive three readings and approve Ordinance No. 651, Rezone 45.72 Acres of land owned by the Village of Mead where the wastewater lagoons are located from (A) Agricultural District to (M-1) Light Industrial District.  Vote:  Wimer-absent, Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes; motion carried 4-0.

AN ORDINACE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA TO AMEND THE OFFICIAL ZONING MAP OF THE VILLAGE OF MEAD, NEBRASKA, BY CHANGING THE FOLLOWING LEGALLY DESCRIBED REAL ESTATE, TO WIT:

FROM AGRICULTURAL DISTRICT (A-1) TO LIGHT INDUSTRIAL DISTRICT (M-1); TO AMEND THE MEAD COMPREHENSIVE PLAN PREVIOUSLY ADOPTED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS IT PERTAINS TO THIS AREA TO BE REZONED, AS AFORENOTED; TO AUTHORIZE THE CHAIR OF THE BOARD OF TRUSTEES AND THE CLERK OF THE VILLAGE OF MEAD TO AMEND THE OFFICIAL MAP OF THE VILLAGE OF MEAD, PURSUANT TO THIS ORDINANCE; TO PROVIDE FOR THE SERVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMHLET FORM OR VIA POSTING IN THREE (3) PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND THE EFFECTIVE DATE THEREOF; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.

Trustee Wimer entered the meeting at 6:25 p.m.

 

SCHEDULED GUEST:  Phil Dawson

Phil Dawson presented information about the CASA (Court Appointed Special Advocates) program.  He indicated CASA is made up of volunteers who play a role in the court system working with abused or neglected children.  He is looking for a volunteer from the Mead area to serve in this capacity.  Brochures and contact information was presented.

 

UTILITY / MAINTENANCE SUPERINTENDENT:  Nick Raver

Raver reported receipt of a grant through NHHS to replace the doors at the wellhouse with steel doors; replacement of roof on the village office and wellhouse; resurfacing completed at N. Third Circle, consider maintenance of Eighth St; and rock has been ordered for the streets.  Concerns expressed were ruts in softball outfield following Mead Days and low water pressure at N. Third Circle.

 

Drainage concern along First St. was addressed.  Once the ditch had been cleaned from the west, the flow of water improved.  Sod needs to be removed at a residence to allow for continued flow to the culvert north of the wastewater plant.

 

Motion by Havelka, second by Wielage to continue with the drainage project along First St. with removal of the sod obstructing the flow of water.  Vote:  Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

 

POLICE REPORT:  Jerry Carlson

The Monthly Police Report was reviewed. 

 

CLERK REPORT: June Moline  

Meter maintenance was reported.  The condition of picnic tables was discussed.  Approval was granted to order 2-3 plastic table tops / benches if the frames are still good.  Clerk reported Accountant Schroeder was in the office today to work on the budget.

 

PLANNING COMMISSION REPORT: The minutes of the June 23 Regular Meeting and June 23 Public Hearing and approved Building Permits were reviewed.  Permits approved were 14-06, Jerry and Staci Charles – construct deck; 14-07, Leo K. Sweet – demolish deck; 14-08, Jim Halbmaier – construct deck; 14-09, Todd and Kymberly Clark – construct fence.  Discussion was held on septic tank certification and request to amend penalty fees for beginning construction or demolition prior to approval of a permit.  The board advised removal of the double penalty fee from policy.

 

LIBRARY REPORT: 

Minutes of the June 18 Library Board meeting were reviewed.

 

UNFINISHED BUSINESS:

Motion by Havelka, second by Wielage to approve second reading of Ordinance No. 650, Amend Chapter 3, Article 1, Sections 3-103 and 3-105 Water Deposits and Article 2, Sections 2-203 ad 2-205 Sewer Deposits.  Vote:  Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0.

 

NEW BUSINESS:

The status of the Ford tractor was discussed.  Ken Schultz has the tractor running again, but doesn’t know for how long.  A tractor will be budgeted for the next fiscal year.

 

Motion by Wielage, second by Havelka to approve the Interlocal Agreement for the Skid Loader with Mead Public Schools.  Vote:  Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes; motion carried 5-0.

 

Havelka introduced and motioned, second by Wimer to adopt Resolution 14-10, Special Tax and Assessment on Property described as W ½ Lot 7 and W ½ S ½ Lot 8, Block 4, Anderson and Carlson Addition to the Village of Mead for delinquent water and sewer account.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes; motion carried 5-0.

RESOLUTION 14-10

 

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, LEVYING A SPECIAL TAX AND ASSESSMENT IN THE AMOUNT OF $73.01 UPON W ½ LOT 7 & W ½ S ½ LOT 8, BLOCK 4, ANDERSON & CARLSON ADDITION TO THE VILLAGE OF MEAD, ALSO KNOWN AS 522 S. VINE STREET, VILLAGE OF MEAD, sAUNDERS COUNTY, NEBRASKA, TO PAY THE COSTS OF $73.01 FOR WATER AND SEWER USAGE.

 

Annual review of Resolution 13-09, Americans with Disabilities Act Policy took place. 

 

Motion by Miller, second by Havelka to enter Executive Session at 7:43 p.m. for the prevention of needless injury to the reputation of an individual for the annual review of the Utilities / Maintenance Superintendent.  Vote:  Guyle-yes, Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes; motion carried 5 – 0.

 

Motion by Wielage, second by Wimer to return to Regular Session at 7:50 p.m.  Vote:  Havelka-yes, Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

 

Motion by Wielage, second by Wimer to approve a 4% wage increase for the Utilities / Maintenance Superintendent.  Vote:  Miller-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
