PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
August 11, 2015
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held August 11, 2015 at the Village Office. Chairman Guyle called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka, PJ Nicola and Rod Wimer. Absent was Richard Wielage. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Police Chief Jerry Carlson, Library Director Lori Moseman and Assistant Library Director Laurie Van Ackeren. Guests present were Ed Schroeder, Dale Rawson, Denise Patocka and Andy and Jenny Carritt.
The posting of the Open Meetings Law was noted.
Motion by Wimer, second by Havelka to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
The minutes of the July 14 Regular Meeting and July 14 Board of Adjustment Special Meeting stood approved as presented.
Motion by Havelka, second by Nicola to approve the Treasurer’s Report showing $751,452.04 total checking/savings balance ending July 31, 2015. Vote: Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes; motion carried 4-0.
Motion by Wimer, second by Havelka to approve the claims of $33,064.73 for payment. Vote: Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 4-0. Claims being:

BUDGET WORKSHOP:
Accountant Ed Schroeder reviewed the proposed budget for fiscal year October 1, 2015 through September 30, 2016. Discussion was held with the board and public.
Motion by Wimer, second by Nicola to adjourn at 6:45 p.m. with the budget finalized at a future budget workshop. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
SCHEDULED GUESTS: Dale Rawson and Andy Carritt
Mead Public Schools Superintendent Rawson and Board Chairman Carritt reported that the Board of Education had recently voted to explore the possibility of selling school land that would be used for future housing development. Dr. Rawson explained that the development would have four stages: 1) north of N. Oak Street to the wellhouse; 2) north of N. Second Street from Elm Street to Vine Street; 3) east of N. Vine Street from N. First Street to N. Second Street; and 4) north of the Jr.-Sr. High School. They asked for village support with village utility services, streets and lighting.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported water volume concerns at N. Third Street. He stated the main concern is tearing up property and that this has been an issue for some time with two of the properties previously repaired. Letters will be sent to N. Third Circle residents seeking their concerns. Meter maintenance, DHHS Deficiencies Notice, repairs at wellhouses, street repair, 2 and 10 Year Water System Plan and burn site evaluation were discussed. A bid was received from Big Red Home Improvement to replace a sidewalk and reset the four decorative lights in the downtown area. Wimer reported the test well samples have been taken and results expected in the near future. Guyle reported Jerry Johnson has requested a future meeting to discuss property located at 1020 Co Rd M.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT:
Officer Carlson presented the monthly police report. Discussion was held on a zoning violation.
PLANNING COMMISSION REPORT:
The minutes of the July 27 Regular Meeting and Building Permits 15-09, Alma Lutheran Church – Demolish and Construct Garage at the Parsonage and 15-10, Aaron and Sherri Seamann – Erect Privacy Fence were reviewed.
LIBRARY REPORT:
The minutes of the July 15 Library Board Meeting were reviewed.
CLERK REPORT: June Moline
Moline reported status of Community Survey and need to amend work hours for a month.
UNFINISHED BUSINESS:
Due to increased prices and use by non-residents, motion by Wimer, second by Havelka to discontinue recycling within the village. Vote: Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes; motion carried 4-0.
NEW BUSINESS:
Havelka introduced and motioned to adopt Resolution 15-15, Use of Section 8 Housing Choice Vouchers, second by Wimer. Vote: Nicola-yes, Wielage-absent, Wimer-yes, Guyle-abstain, Havelka-yes; motion carried 3-1. Fremont Housing Authority operates the HUD program that provides housing assistance to eligible low income families.
RESOLUTION 15-15
A RESOLUTION ADOPTING AND APPROVING A POLICY TO ALLOW THE USE OF SECTION 8 HOUSING CHOICE VOUCHERS IN THE VILLAGE OF MEAD, NEBRASKA.
Whereas, there is a shortage of adequate and / or affordable housing in the Village of Mead, Nebraska, available to families of low income, or elderly / handicapped persons of low income at rentals they can afford; and,
Whereas, it is in the best interest of the Fremont Housing Agency and the Village of Mead to offer the Section 8 Housing Choice Voucher Program to residents of the Mead community; therefore,
BE IT RESOLVED by the Village Board of Trustees of Mead, Nebraska:
- The Mead Village Board of Trustees agrees to enter into a Memorandum of Agreement for the Fremont Housing Agency Section 8 Housing Choice Voucher Program provision of vouchers in the Mead Community.
- The Chairperson and Mead Village Board of Trustees considers the Fremont Housing Agency as a means of providing low income families with rental subsidy funds in the Mead Community.
Motion by Havelka, second by Wimer to approve the hire of Jerome Moline as Substitute Dumpmaster. Vote: Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent; motion carried 4-0.
Havelka introduced and motioned, second by Nicola to adopt Resolution 15-18, set rate of $150.00 per hour, one hour minimum, for mowing residential and commercial properties. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes; motion carried 4-0.
RESOLUTION 15-18
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, TO SET VILLAGE COST TO MOW PRIVATE RESIDENTIAL OR COMMERCIAL PROPERTY
WHEREAS, the Village of Mead Board of Trustees, Mead, Saunders County, Nebraska, recognizes that Village of Mead Code 8-106 Municipal Property; Weeds, states that any weeds growing in excess of twelve (12”) inches shall be considered a violation;
WHEREAS, if the owner of the property does not maintain the property after being provided proper notice of violation, it shall be the duty of the Utilities Superintendent or his agent to post a copy of the notice on the premise and then to cut or cause the weeds to be cut as therein provided and report the cost to the Governing Body.
WHEREAS, The cost shall then be audited and paid by the Village of Mead and the amount shall be assessed against the lot or parcel of land as a special tax and shall be collected as are other taxes of the Municipality or may be recovered by civil suit brought by the Village of Mead against the owner of the parcel of land;
WHEREAS, The cost for the Village of Mead to cut the weeds shall be $150.00 per hour, with a minimum of one hour.
Wimer introduced, motioned to waive three readings and adopt Ordinance No. 668, amend Chapter 3, Article 1, Section 3-116.02, Placement of water wells. Second by Havelka. The amendment was a mandatory requirement from the Nebraska Department of Health and Human Services. Vote: Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes; motion carried 4-0.
ORDINANCE NO. 668
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 3, DEPARTMENTS, OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT TO ARTICLE 1, WATER DEPARTMENT; SECTION 3-116.02, MUNICIPAL WATER DEPARTMENT: PLACEMENT OF WATERWELLS; PREVENTION OF CONTAMINATION, TO AMEND THE DISTANCE REQUIRED TO PLACE, MAINTAIN, CONSTRUCT, OR REPLACE ANY STRUCTURES WITHIN THE DISTANCE SPECIFIED FROM AN EXISTING MUNICIPAL WATER WELL.
Havelka introduced, motioned to waive three readings and adopt Ordinance No. 669, 25-year agreement with Omaha Public Power District to conduct a retail electric energy supply business with the village. Second by Wimer. Vote: Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes, Nicola-yes; motion carried 4-0.
ORDINANCE NO. 669
AN ORDINANCE ACCEPTING THE PROPOSAL OF THE OMAHA PUBLIC POWER DISTRICT, ITS SUCCESSORS AND ASSIGNS (HEREINAFTER “GRANTEE”) TO CONTINUE TO CONDUCT A RETAIL ELECTRIC ENERGY SUPPLY BUSINESS WITHIN THE VILLAGE OF MEAD, NEBRASKA (HEREINAFTER “VILLAGE”), AND GRANTING A FRANCHISE TO GRANTEE TO GENERATE, DISTRIBUTE AND DELIVER AN ADEQUATE AND CONTINUOUS SUPPLY OF ELECTRIC ENERGY TO THE VILLAGE, EXCEPT FOR INTERRUPTIONS BEYOND GRANTEE’S CONTROL; TO ERECT POLES AND INSTALL WIRES AND CABLES THEREON; TO CONSTRUCT UNDERGROUND CONDUITS AND MANHOLES AND TO INSTALL CABLES IN UNDERGROUND CONDUITS OR BURIED DIRECTLY IN THE GROUND, AND TO INSTALL SUCH FACILITIES ALONG, OVER, UPON, UNDER OR ACROSS PRESENT OR FUTURE STREETS, ALLEYS, AVENUES, HIGHWAYS AND OTHER PUBLIC RIGHTS‑OF‑WAY OF THE VILLAGE, AND TO CONSTRUCT, OWN, OPERATE AND MAINTAIN ALL OTHER ELECTRIC TRANSMISSION AND DISTRIBUTION SYSTEMS NECESSARY TO SUPPORT AND CONDUCT A RETAIL ELECTRIC ENERGY SUPPLY BUSINESS WITHIN THE VILLAGE.
A concern of a delinquent water / sewer account, request from Bob Hannan to employ the older generation to help with maintenance, complaint of tree blocking the view at an intersection and payment for tires delivered prior to Mead Days were discussed.
Motion by Havelka, second by Nicola to accept the bid of $9,000.00 from Big Red Home Improvement to replace a sidewalk along the east side of Vine Street from Third Street to Fourth Street and reset four decorative lights. Vote: Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent; motion carried 4-0.
