  PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

July 14, 2015

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held July 14, 2015 at the Village Office.  Chairman Guyle called the meeting to order at 6:17 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka and PJ Nicola.  Absent were Richard Wielage and Rodney Wimer.  Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Library Director Lori Moseman and Planning Commission Chair Jody Weible.  Guests present were Greg Larson and Jon Meier.

 

The posting of the Open Meetings Law was noted.

 

Motion by Havelka, second by Guyle to adopt the agenda.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-absent; motion carried 3-0.

 

The minutes of the June 9 Regular Meeting stood approved as presented.  

 

Motion by Havelka, second by Guyle to approve the Treasurer’s Report showing $734,266.26 total checking/savings balance ending June 30, 2015.  Vote: Havelka-yes, Nicola-yes, Wielage-absent, Wimer-absent, Guyle-yes; motion carried 3-0. 

 

Motion by Havelka, second by Nicola to approve the claims of $581,821.46 for payment.  Vote:  Nicola-yes, Wielage-absent, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0. Claims being:

Wimer entered the meeting at 6:24 p.m.

 

Motion by Havelka, second by Guyle to enter a Board of Adjustment Special Meeting at 6:24 p.m.  Vote:  Wielage-absent, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 4-0.

 

The board returned to regular session at 6:30 p.m. 

 

UTILITY/MAINTENANCE SUPERINTENDENT REPORT:  Nick Raver

Raver reported receipt of letter from DEQ granting an extension of the Water Study Project through December 31, 2015; discussed replacement of the sidewalk in the downtown area; heard a request from a resident to replace the curb that had previously been cut; meters requiring maintenance and have discontinued spraying for mosquitoes on a weekly schedule and placed on an as-needed basis by the City of Wahoo. Clerk Moline presented a survey of municipalities for rates  charged if the municipality has to mow residence and commercial properties.

 

Raver presented bids for a sewer jetter.  Bids being:  Spartan Tool $17,895.00 and Durand-Wayland $59,950.00.  Payment for a sewer jetter will be made with the budgeted amount remaining in Debt Service equipment purchases for the fiscal year. 

 

Motion by Wimer, second by Havelka to purchase a sewer jetter from Spartan Tool at a cost of $17,895.00.  Vote:  Wielage-absent, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 4-0.

 

Havelka introduced and motioned, second by Nicola to adopt Resolution 15-14, Loan with the Bank of Mead for $14,000.00 to purchase a sewer jetter.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent; motion carried 4-0.

 

RESOLUTION 15-14

 

WHEREAS, the Village of Mead Board of Trustees, Mead, Saunders County, Nebraska, authorizes that a loan be taken with the Bank of Mead to purchase a Spartan Model 758 Sewer Jetter.

 

WHEREAS, a loan shall be drawn with the Bank of Mead for the purchase of a Spartan Model 758 Sewer Jetter;

 

WHEREAS, payment has been made for the purchase of the Spartan Model 758 Sewer Jetter from Spartan Tool in the amount of $16,995.00, with $14,000.00 paid through a loan with the Bank of Mead;

 

WHEREAS, a loan with the Bank of Mead shall be drawn for the amount of $14,000.00;

 

WHEREAS, the following loan repayment schedule to the Bank of Mead by the Village of Mead, Saunders County, Nebraska, shall be established:

 

                        $7,000.00 principal plus interest, due September 1, 2016

                        $7,000.00 principal plus interest, due September 1, 2017

 

WHEREAS, a rate of 2.25% interest rate has been established with a maturity due date of the loan being September 1, 2017.

 

PLANNING COMMISSION REPORT:

Building Permits 15-06, Mario Sagastume to erect a deck and 15-07, Dennis Berry for a house addition were reviewed. 

 

Motion by Havelka, second by Wimer to accept the June 22, 2015 Board Meeting minutes.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes; motion carried 4-0.

 

Motion by Havelka, second by Wimer to approve Jason Felty as a member of the Planning  Commission.  Vote:  Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes; motion carried 4-0.

 

LIBRARY REPORT: 

Motion by Wimer, second by Nicola to approve the minutes of the June 17, 2015 meeting of the Library Board.  Vote:  Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 4-0.

 

CLERK REPORT:  June Moline

Moline presented items from the Mead Ball Association to consider for the October 1, 2015 through September 30, 2016 budget.  Review of the requests was held.  Moline reported on progress of the Community Survey and amended report of Land Use forwarded to Saunders County Farmer Services Agency.

 

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: 

The Monthly Police Report was presented in written form from Police Chief Carlson.  Concerns from residents regarding a house requiring paint, roof covering on a garage, and shrub obscuring sight of vision were discussed.

 

Motion by Wimer, second by Nicola to direct Nuisance Enforcement Officer and Zoning Administrator Carlson to forward documents to Attorney Freeman-Caddy to file nuisance and zoning violations with the court against a property located at 1020 Co Rd M.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent; motion carried 4-0.

 

NEW BUSINESS:

Annual review of Conditional Use Permits took place with all permits approved for renewal.  Moline presented to the board that they consider not renewing the Animal Control Facility at an annual cost of $150.00 due to lack of animals housed at the facility.  It was agreed not to renew the permit.  Action was discussed on a delinquent water / sewer account. Moline presented rates from Credit Bureau, Fremont to pursue delinquent accounts.  No action at this time to contract with the Credit Bureau.  Moline reported recycling fees with Recycling Enterprises of Nebraska will be increasing from $125.00 per pull to $175.00 per pull.  An alternative from Waste Connections to provide roll-offs at a cost of $145.00 per pull or door-to-door totes at a cost to the consumer of $8.00 per month for co-mingled products and a second tote at $4.00 per month with collection every other week.  No decision was reached at this time.

 

Motion by Wimer, second by Nicola to table action on Resolution, 15-15, Use of Section 8 Housing Choice Vouchers.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes; motion carried 4-0.

 

Havelka introduced and motioned, second by Wimer to adopt Resolution 15-17, Special Designated Liquor License to Michael Beckman to sponsor a wedding reception/dance at the Community Building on September 12, 2015.  Vote:  Havelka-yes, Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes; motion carried 4-0.

 

RESOLUTION NO. 15-17

Village of Mead

 

A RESOLUTION TO ADOPT A POLICY REQUIRING A SPECIAL DESIGNATED LIQUOR LICENSE IS IN PLACE AT ALL PRIVATE OR PUBLIC FUNCTIONS HELD ON PUBLIC PROPERTY.

 

WHEREAS,                   the purchase of a Special Designated Liquor License must be obtained from the Nebraska Liquor Commission; and

 

WHEREAS,      the applicant, Michael Beckman, submitted a request to submit an application to the Nebraska Liquor Control Commission for a Special Designated Liquor License to host a Wedding Reception / Dance at the Mead Community Building on Saturday, September 12, 2015.

 

Havelka introduced and motioned to waive three readings, second by Wimer to adopt Ordinance No. 667, Set pay rate for Substitute Dumpmaster at $9.30 per hour.  Vote:  Nicola-yes, Wielage-absent, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 4-0.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR AMENDMENT OF THE WAGE OR SALARY OF WASTEWATER SUPERINTENDENT OF THE VILLAGE OF MEAD, NEBRASKA; TO PROVIDE DEFINITIONS; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED EITHER IN PAMPHLET FORM OR BY POSTING; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.

 

            WHEREAS, Whereas, Chapter 1, Article 9, Section 901 of the Municipal Code of the Village of Mead, Nebraska, and specifically, the last sentence thereof, provides as follows:

 

“All salaries shall be set by Ordinance of the Governing Body and will be available for public inspection at the office of the Municipal Clerk.”

 

and,

 

            WHEREAS, it is necessary to establish said salaries for certain officers, appointees, and employees of the Village of Mead, Nebraska, and set forth the effective date of the same.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, as follows:

 

            Section 1.  That the findings here and above should be, and they are hereby made a part of this Ordinance, as fully as if set out at length herein.

 

            Section 2. That the following shall be the wage or salary for the specified officers, appointees, and employees of the Village of MEAD, Nebraska, effective as of the date indicated for each, to wit:
