PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
April 14, 2015
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held April 14, 2015 at the Village Office. Chairman Guyle called the meeting to order at 6:00 p.m.
Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka, PJ Nicola and Richard Wielage. Absent was Trustee Rod Wimer. Also present were Clerk June Moline, Utility/ Maintenance Superintendent Nick Raver, and Police Chief Jerry Carlson.
The posting of the Open Meetings Law was noted.
Motion by Wielage second by Havelka to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent; motion carried 4-0.
The minutes of the March 10 Regular Meeting and Public Hearing stood approved as presented.
Motion by Wielage, second by Havelka to approve the Treasurer’s Report showing $691,130.79 total checking/savings balance ending March 31, 2015. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 4-0.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported a drainage concern, storm sewers requiring maintenance, water line repair at Fourth and Spruce Streets and repair of residents’ water meters.
POLICE REPORT: Jerry Carlson
The Monthly Police Report was presented. Discussion was held on the proposed amendment to the nuisance code. He indicated he had recently conducted breathalyzer tests at Mead High School’s post prom party, recently requested a break in the train that was blocking the tracks during the night and agreed to serve as the Nuisance Enforcement Officer.
PLANNING COMMISSION REPORT:
The minutes of the March 23 Regular Meeting and permit approved was 15-02, Mead Public Schools for a bus barn addition were reviewed.
LIBRARY REPORT:
The minutes of the February 17 and March 18 Library Board Meetings were reviewed.
CLERK REPORT: June Moline
Moline reported the sale of 33 dog/cat licenses to date, Garage Sale Day on May 2 and Clean-up Day on May 30. Vacation days were requested and approved.

Motion by Havelka, second by Wielage to approve third reading and adopt Ordinance No. 657 to amend Chapter 4, Article 3, Nuisance Regulations. Vote: Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 4-0.
ORDINANCE NO. 657
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND AND RESTATE CHAPTER 4, ARTICLE 3 OF THE MEAD MUNICIPAL CODE WHICH PROVIDES FOR JURISDICTION, DEFINITIONS, DETERMINATIONS, NOTICE, HEARING, APPEAL, ABATEMENT, PENALTIES, ASSESSMENT OF COSTS AND ENFORCEMENT OF NUISANCES; TO PROVIDE THAT THE CHAIR OF THE BOARD OF TRUSTEES AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDIANNCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED WITHIN THE FIRST FIFTEEN DAYS AFTER ITS PASSAGE AND APPROVAL EITHER IN PAMPHLET FORM OR BY POSTING IN THREE PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW, AND AS PROVIDED HEREIN; AND TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, AND THE SECTIONS OF THIS ORDINANCE MAY BE RENUMBERED TO ACCOMPLISH SUCH INTENTION.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO GRANT TO QUALITY DISPOSAL, INC., A NON-EXCLUSIVE FRANCHISE TO COLLECT AND DISPOSE OF THE GARBAGE OF THE RESIDENTS OF THE VILLAGE OF MEAD, PURSUANT TO THE COMMERCIAL GARBAGE HAULERS FRANCHISE ORDINANCE OF THE VILLAGE OF MEAD, NEBRASKA, SECTION 10-403 OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA; TO PROVIDE FOR TERMS AND CONDITIONS OF SAID GRANT OF FRANCHISE; TO REPEAL ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND TO PROVIDE FOR THE EFFECTIVE DATE THEREOF.
ORDINANCE NO. 660

Havelka introduced and motioned, second by Nicola, to adopt Resolution 15-09, Nuisance Enforcement Officer and to name Jerry Carlson to serve as the Nuisance Enforcement Officer. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 4-0.
RESOLUTION NO. 15-09
WHEREAS, the Board of Trustees of the Village of Mead, Saunders County, Nebraska, has adopted Ordinance No. 15-08 which provides that the Village shall appoint an individual or organization to identify and enforce the abatement of nuisances within the zoning jurisdiction of the Village. Said individual or organization shall be identified as the nuisance officer and the appointment shall be identified by resolution of the Village;
and,
WHEREAS, said nuisance officer shall not be a person who serves on the Village Board of Trustees and shall enforce the nuisance laws as directed by the Mead Municipal Code,
NOW THEREFORE, BE IT RESOLVED BY THE CHAIR AND THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS FOLLOWS:
1. That the findings hereinabove made shall be incorporated herein.
2. That Jerry Carlson shall be appointed nuisance officer for the Village of Mead and shall enforce the nuisance provisions of the Mead Municipal Code.
It was agreed that the baling and ballfield preparation agreements with Miller Properties will remain as in 2014. The Clerk will contact the City of Wahoo for mosquito spraying this year. A complaint was discussed regarding a resident’s property. The General Obligation Bond for the wastewater project shall have a repayment period of 20 years. This item will be addressed at the May 12 meeting.
Motion by Havelka, second by Wielage to approve an application from Windstream to replace fiber optic in the alley between Vine and Elm Street, north of Second Street. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent; motion carried 4-0.
Havelka introduced and motioned, second by Wielage, to approve first reading of Ordinance No. 661 to amend the penalty clauses to numerous chapters of the Code Book. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 4-0.
Wielage introduced, second by Nicola to pay $15.00 per hour for services to an individual who helped repair a storm sewer. Vote: Nicola-yes, Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 4-0.
Motion by Havelka, second by Nicola to enter executive session at 7:05 p.m. for the prevention of needless injury to the reputation of an individual for the annual review of the Police Chief. Vote: Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 4-0.
Motion by Havelka, second by Wielage to return to regular session at 7:14 p.m. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent; motion carried 4-0.
Motion by Wielage, second by Havelka to approve a $.87 per hour wage increase to the Police Chief with the added duty of Nuisance Enforcement Officer. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 4-0.
