PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
September 13, 2016
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held September 13, 2016 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle, Richard Wielage and Rod Wimer. Also present were Clerk June Moline and Utility / Maintenance Superintendent Nick Raver. Guest was Craig Reinsch.
The posting of the Open Meetings Law was noted.
Motion by Wimer, second by Felty to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
The minutes of the August 9 Regular Meeting and Budget Workshop and August 22 Public Meeting were approved as presented.
Motion by Havelka, second by Wielage to approve the Treasurer’s Report showing $727,737.02 total checking/savings balance ending August 31, 2016. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer- yes, Felty-yes; motion carried 5-0.
Motion by Havelka, second by Wielage to approve the claims of $84,845.34 for payment, with Wimer abstaining on Check # 3579. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

The board reconvened to Regular Session at 6:11 p.m.
SCHEDULED GUEST:
Craig Reinsch, Olsson Associates, presented a preliminary plan for construction of a new well, new 150,000 gallon water tower, water treatment facility, site piping, well modifications and existing water tower demolition. He discussed the bidding process, use of contractors, seeking of easement; lighting and fencing options around the site, building construction and estimated deadlines for completion of the project. Rod Wimer and Gary Guyle will serve as planning liaisons for the board.
Motion by Wimer, second by Wielage to approve Letter Agreement Amendment #1 with Olsson Associates for professional services for a water project. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
Carlson presented a written Monthly Police Report. Discussion was held on the current status of a declared nuisance at 420 S. Cedar Street. The board agreed to reimburse stored equipment to the owner that had been collected in July and August during the abatement process at 1020 Co Rd M.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported repairs of several water meters, completion and findings from jetting a storm sewer at 619 S. Vine Street, and drainage concerns.
PLANNING COMMISSION REPORT:
The minutes of the August 22 Regular Meeting were accepted. Building Permits approved were: Demolition Permit 16-12 to Cyndie Barris to demolish a garage (the Mead Fire Department plans to burn the garage); and Building Permits 16-13 to Cyndie Barris to erect a polyethylene steel frame shelter; 16-14 to Jeremy Harnish to erect a 6’ privacy fence (previously erected with penalty fee paid August 9); 16-15 to Allison Leimer to erect a fence; and 16-16 to Gary and Laurie Guyle for an addition to their house.
LIBRARY REPORT:
The minutes of the August 17 Library Board Meeting were accepted.
NEW BUSINESS:
The Mead Ball Association presented projects they have recently completed in the Mead Park and submitted an application for a grant through the Wahoo Chamber of Commerce. Projects completed are removal of five tree stumps for $400.00 and $500.00 to cut a handicap curb. Plans are to purchase five trees at a total of $1,345.00; repair shed for $1,000.00, with repairs being completed by Mead Public Schools’ Shop Class; and to replace the current doors on the west restrooms with steel doors for $2,000.00, with work to be completed and time donated by Bill Thorson. Total cost of the projects is $5,245.00. An additional request is to contact SECO to check out the electrical circuits at the pavilion and concession stand.
Wimer introduced and motioned, second by Wielage to adopt Resolution 16-14, Rate for Storage at $10.00 per day. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
RESOLUTION 16-14
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, TO SET VILLAGE COST TO STORE A VEHICLE ON PROPERTY OWNED BY THE VILLAGE OF MEAD
WHEREAS, the Village of Mead Board of Trustees, Mead, Saunders County, Nebraska, recognizes that Village of Mead Code 4-305 Health and Sanitation, Nuisances, Expenses; Code 5-311.1 Traffic Regulations, Parking, Parking; Removal of Improperly Parked Vehicle or of Parked Vehicles Obstructing the Removal of Snow or the Repair of a Street or Alley and 6-309 Police Regulations, Miscellaneous Misdemeanors, Misdemeanors; Abandoned Automobiles, states that the Nuisance Enforcement Officer or Police Officer shall remove any vehicle and store the vehicle.
WHEREAS, when a vehicle is removed from a property due to a nuisance violation, vehicle being abandoned or a parking violation, the Nuisance Enforcement Officer or Police Officer shall make arrangements to have the vehicle removed;
WHEREAS, arrangements to remove the vehicle in violation are to be made with the Village of Mead Utility / Maintenance Superintendent or a private towing company;
WHEREAS, if the vehicle in violation is towed to property owned by the Village of Mead a set rate shall be assessed for storage of the vehicle;
WHEREAS, the owner of the towed vehicle shall be charged a rate of $10.00 per day for the vehicle to be stored on property owned by the Village of Mead;
WHEREAS, the Board of Trustees of the Village of Mead, Saunders County, Nebraska, has approved the rate set by resolution.
Havelka introduced and motioned, second by Felty to adopt Resolution 16-15, Special Designated Liquor License to Michael Beckman to sponsor a Poker-Night for Mead Public Schools Post Prom on October 14 at the Mead Community Building. The Mead Post Prom Committee will serve as hosts. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
RESOLUTION NO. 16-15
A RESOLUTION TO ADOPT A POLICY REQUIRING A SPECIAL DESIGNATED LIQUOR LICENSE IS IN PLACE AT ALL PRIVATE OR PUBLIC FUNCTIONS HELD ON PUBLIC PROPERTY.
WHEREAS, the purchase of a Special Designated Liquor License must be obtained from the Nebraska Liquor Commission; and
WHEREAS, the applicant, Michael Beckman, submitted an application to the Nebraska Liquor Control Commission for a Special Designated Liquor License to sponsor a fundraiser on October 14, 2016 at the Mead Community Building. The fundraiser will be hosted by Mead Post Prom Committee members.
WHEREAS, the Village Board of Trustees received board approval to submit the application at the September 13, 2016 Regular Board Meeting; and
WHEREAS, the approved application shall be submitted to the Nebraska Liquor Commission by the Village Clerk ten (10) days prior to the event; and
WHEREAS, a fee of $40.00 shall be submitted to the Commission along with the application.
Discussion was held on future payments of the loan to complete the water project. Considerations are to share the cost between user fees and property taxes. Clerk is to contact Accountant Schroeder as to what the best options are although he has stated in the past that payments from both sources are possible but water should be self-supporting. A list from numerous municipalities was presented of current wages for Board of Trustees Chairpersons and Trustees. A letter was received from USDA indicating that the property at 309 W. Second Street has been determined as used for nonagricultural use.
