PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
May 12, 2015
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held May 12, 2015 at the Village Office. Chairman Guyle called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka, PJ Nicola and Rod Wimer. Absent was Trustee Richard Wielage. Also present were Clerk June Moline, Utility/ Maintenance Superintendent Nick Raver, and Police Chief Jerry Carlson. Guests present were John Trecek, Tanner Shaw and Andrew Dietzel.
The posting of the Open Meetings Law was noted.
Motion by Havelka second by Wimer to adopt the agenda. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes; motion carried 4-0.
The minutes of the April 14 Regular Meeting stood approved as presented.
Wielage entered the meeting at 6:02 p.m.
Motion by Wimer, second by Havelka to approve the Treasurer’s Report showing $709,879.98 total checking/savings balance ending April 30, 2015. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.
Motion by Wielage, second by Havelka to approve the claims of $19,523.14 for payment. Vote: Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0, with Wimer abstaining on Check #’s 3256 and 3268. Claims being:

SCHEDULED GUESTS:
John Trecek, Ameritas, presented the consideration of the village to purchase General Obligation Sewer Bonds in the amount of $515,000 for the wastewater lagoon project over a 20-year payback period. The current bonds used for the construction of the wastewater lagoon project expire June 15. The village has the option to call in bonds in $5,000 increments if they wish to pay them off earlier. The longer repayment period results in higher interest.
Motion by Wimer, second by Wielage, to introduce and waive three readings of Ordinance No. 662, Purchase General Obligation Sewer Bonds. Vote: Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 5-0.

ORDINANCE NO. 662
AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION SEWER BONDS, SERIES 2015, OF THE VILLAGE OF MEAD, NEBRASKA, IN THE PRINCIPAL AMOUNT OF FIVE HUNDRED FIFTEEN THOUSAND DOLLARS ($515,000) TO CONSTRUCT ADDITIONS AND IMPROVEMENTS TO THE SEWER PLANT AND SYSTEM OF THE VILLAGE; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE LEVY AND COLLECTION OF TAXES TO PAY THE SAME; PROVIDING FOR THE SALE OF THE BONDS; AUTHORIZING THE DELIVERY OF THE BONDS TO THE PURCHASER; PROVIDING FOR THE DISPOSITION OF THE BOND PROCEEDS AND ORDERING THE ORDINANCE PUBLISHED IN PAMPHLET FORM
Tanner Shaw, AltEn, requested the purchase of potable water from the village for AltEn. AltEn’s needs are estimated to be 1,500-3,000 gallons of water per month. Plans are for their water operator to pump the water into a mounted poly tank on a flatbed. Wimer will contact Tim Thayer with the Nebraska Department of Health and Human Services for his approval of the request. Concerns the board expressed were treatment at AltEn’s site, point of pick up, bulk rate and measurement for units used. This request will be addressed at an upcoming special meeting.
UNSCHEDULED GUEST:
Andrew Dietzel, expressed concerns with vehicles not stopping or rolling through the stop sign at Fifth and Elm St. intersection. Alma Lutheran Church is located at the intersection and his concern is for the many children involved in programs at the church. Police is to patrol the area and issue tickets for not stopping or rolling through the intersection and Clerk will post flyers at businesses, mail flyers with utility invoices and ask Mead Public Schools to announce a reminder with their daily announcements at the Jr.-Sr. High School of enforcement of law for not stopping or rolling through stop signs.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT:

The Monthly Police Report was presented. A complaint was heard regarding yards requiring mowing. A zoning violation has been delivered to the owners of a property. The board instructed the Enforcement Officer to proceed with nuisance violation of a property.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported the Intergovernmental Agreement between NDEQ and the village for a water evaluation and potential treatment project will expire June 30, condition of water, purchase of a grass sweeper, and storm sewer issues thus resulting in drainage issues. The board discussed possible sale and auction of unused equipment.
PLANNING COMMISSION REPORT:
The minutes of the April 27 Regular Meeting were reviewed.
LIBRARY REPORT:
The minutes of the April 14 Library Board Meeting were reviewed. New hires are Lori Moseman, Library Director and Laurie Van Ackeren, Library Assistant.
CLERK REPORT: June Moline
Moline reported sale of 52 dog/cat licenses to date, Community Survey to be distributed within days to all households, and sought permission to purchase frames for two picnic tables. The request was denied. She noted that Mead Clean-up Day is scheduled for May 30; with labor provided by the Board of Trustees and employees.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT THERETO TO THE VIOLATION PROVISIONS OF CHAPTERS 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 BY INCREASING THE MAXIMUM FINE FROM $100.00 to $500.00; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED WITHIN THE FIRST 15 DAYS AFTER ITS PASSAGE AND APPROVAL EITHER IN PAMPHLET FORM OR BY POSTING IN THREE PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW AND AS PROVIDED HEREIN; AND TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BECOME AND BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.

Motion by Wimer, second by Wielage, to approve an Interlocal Agreement with the City of Wahoo to spray mosquitoes for 2015 at a cost of $285.00 per application. Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

RESOLVE: That in order to provide for a coordinated response to a disaster or emergency in Saunders County, the Village of Mead and other cities and villages in Saunders County, the Mead Village Board deems it advisable and in the best interests of the community and the County to approve the attached Saunders County Local Emergency Operations Plan.

RESOLUTION No. 15-11
DECLARED NUISANCE
The Board Chairman and Village Board of the Village of Mead (hereinafter the Village), in regular session assembled at the Village Office in Mead, Nebraska on this 12th day of May, 2015, hereby resolve as follows:
WHEREAS, the Village of Mead desires to declare Nuisance pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-301 through 4-306 and 4-401 through 4-402.
NOW THEREFORE:
BE IT RESOLVED that the following property located within the nuisance jurisdiction of the Village of Mead, Nebraska has been submitted to the Village Board at its regular meeting on May 12, 2015; 1020 Co Rd M, Mead, Nebraska; and
BE IT RESOLVED, that the Village Board found at said meeting that the following property is declared to have nuisances upon it contrary to Mead Village’s Code of Ordinances and that said nuisance is ratified by this resolution:

BE IT FINALLY RESOLVED, that the Village shall proceed as determined under the administrative procedure of 4-301 through 4-306 and 4-401 through 4-402.
