PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

                                                            January 12, 2016                     

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held January 12, 2016 at the Village Office.  Chairman Havelka called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman Shawn Havelka; Trustees Gary Guyle, Richard Wielage and Rod Wimer.  Absent was Trustee PJ Nicola. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver and Police Chief Jerry Carlson.  Guests were Lee and Bobbie Feldhaus, Rick Miller, Melissa Konecky and Julie Ogden.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Guyle to adopt the agenda. Vote:  Guyle-yes, Havelka-yes, Nicola-absent, Wielage-yes, Wimer-yes; motion carried 4-0.

 

The minutes of the December 8, 2015 Regular Meeting and Public Hearing were approved as presented.

  

Motion by Wielage, second by Wimer to approve the Treasurer’s Report showing $698,050.13 total checking/savings balance ending December 31, 2015.  Vote: Havelka-yes, Nicola-absent, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 4-0. 

 

Motion by Wimer, second by Wielage to approve the claims of $29,714.86 for payment.  Vote:  Nicola-absent, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 4-0. Claims being:

REGULAR SESSION:

SCHEDULED GUESTS:

Street Superintendent, Julie Ogden, presented the One and Six Year Street Plan for review.  Future options for improving First Street, N. Pine Street, N. Oak Street, Second Street and storm sewer improvements were discussed.  The plan will be considered for approval at the February 9 regular meeting of the Board.

 

UTILITY/MAINTENANCE SUPERINTENDENT REPORT:  Nick Raver

Raver reported repairs at the wellhouse.  Discussion was held on a possible site for a future well / water treatment facility.

 

Motion by Wimer, second by Wielage to seek an extension of the Well / Treatment Facility CFDA #66.468 Grant.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Nicola-absent, Wielage-yes; motion carried 4-0.

 

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT:  Jerry Carlson

Officer Carlson presented the monthly police report.  The litigation case was discussed.

 

PLANNING COMMISSION REPORT:

The 2015 Building and Demolition Report was presented.

 

CLERK REPORT:  June Moline

Moline reported future sale of a property holding a utility lien, meter repair with representatives from HD Supply Waterworks is scheduled for January 25 and upcoming meetings.  Future events that have been scheduled are:  Pet Vaccination Clinic and License Day – April 9, Garage Sale Day – May 7 and Mead Days – June 17, 18 and 19.

 

UNFINISHED BUSINESS:

Motion by Guyle, second by Wimer to approve second reading of Ordinance No. 671, Building Permits and addition of Maintenance Code; Ordinance No. 672, Occupation Tax with the addition of a $50.00 tax for cell towers; and Ordinance No. 673, Zoning Regulations.  Vote:  Guyle-yes, Havelka-yes, Nicola-absent, Wielage-yes, Wimer-yes; motion carried 4-0.

 

NEW BUSINESS:

Wimer introduced and motioned to waive three readings and adopt Ordinance No. 676, Sale of personal property, second by Guyle.  Vote:  Havelka-yes, Nicola-absent, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 4-0.

AN ORDINANCE OF THE VILLAGE OF MEAD, NEBRASKA, TO CONFIRM THE SALE OF THE FOLLOWING DESCRIBED PERSONAL PROPERTY, TO WIT:  A) PORTABLE SEWER JET TRAILER, B) BOBCAT HYDRAULIC BACKHOE ATTACHMENT, AND C)  TRENCHER ATTACHMENT, FOR THE TOTAL SUM OF A) $1,620.00, B) $2,925.00, AND C) $720.00, THROUGH ACTION WITH JACK NITZ AND ASSOCIATES TO A) BID CARD #90, B) BID CARD #618, AND C) BID CARD #186; TO AUTHORIZE THE CHAIR OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AND ITS CLERK, TO EXECUTE ANY AND ALL DOCUMENTS TO EFFECTUATE THE SALE OF THE AFORENOTED PERSONAL PROPERTY TO THE BUYER; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM AND THE EFFECTIVE DATE THEREOF; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BECOME A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.

 

Guyle introduced and motioned to adopt Resolution 16-03, Special Designated Liquor License to Mead Fire/Rescue Department to host Mead Days on June 17, 18 and 19 at the Mead park, second by Wielage. Vote:  Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-absent; motion carried 4-0.

 

RESOLUTION NO. 16-03

 

A RESOLUTION TO ADOPT A POLICY REQUIRING A SPECIAL DESIGNATED LIQUOR LICENSE IS IN PLACE AT ALL PRIVATE OR PUBLIC FUNCTIONS HELD ON PUBLIC PROPERTY.

 

WHEREAS,                    the purchase of a Special Designated Liquor License must be obtained from the Nebraska Liquor Commission; and

 

WHEREAS,                    the applicant, Mead Volunteer Fire and Rescue Department, submitted a request to submit an application to the Nebraska Liquor Control Commission for a Special Designated Liquor License for Mead Days celebration on Friday, June 17, 2016, Saturday, June 18, 2016, and Sunday, June 19, 2016 at the Mead Park.

 

Motion by Havelka, second by Wimer to approve a Special Permit to the Mead Days Committee to close First Street from Elm Street to Vine Street on June 17, 18 and 19 to allow for numerous activities during Mead Days.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Nicola-absent, Wielage-yes; motion carried 4-0.

 

The resignation of Kenneth Schultz as Dumpmaster was acknowledged.

 

Motion by Wimer, second by Wielage to adjourn to Executive Session at 7:50 p.m. to prevent needless injury to a reputation for the job performance evaluation of the Clerk/Treasurer.  Vote:  Guyle-yes, Havelka-yes, Nicola-absent, Wielage-yes, Wimer-absent; motion carried 4-0.

 

Motion by Wielage, second by Guyle to return to Regular Session at 8:00 p.m.  Vote:  Havelka-yes, Nicola-absent, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 4-0.

 

Wimer introduced and motioned to waive three readings and adopt Ordinance No. 675, amend Clerk/Treasurer’s wage with a 3% increase, second by Wielage.  Vote:  Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-absent; motion carried 4-0.

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR AMENDMENT OF THE WAGE OR SALARY OF CLERK/TREASURER OF THE VILLAGE OF MEAD, NEBRASKA; TO PROVIDE DEFINITIONS; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED EITHER IN PAMPHLET FORM OR BY POSTING; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA.
