PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
December 12, 2017
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held December 12, 2017 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty, Gary Guyle, Richard Wielage and Rod Wimer. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver and Police Chief Jerry Carlson. Guests were Matt Bratsburg, Rick Miller, Levi Durnal, Jim Halbmaier, Craig Jones, Cort Silliman, and Cody and Jenea Sweeter.
The posting of the Open Meetings Law was noted.
Motion by Guyle, second by Felty to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
The minutes of the November 14 Regular Meeting were accepted as presented.
Motion by Guyle, second by Wielage to approve the Treasurer’s Report showing $566,142.93 total checking/savings balance ending November 30, 2017. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer- yes, Felty-yes; motion carried 5-0.

Havelka assumed the role of Chairman.
Motion by Havelka, second by Felty, to approve the following appointments: Police Chief, Zoning Administrator and Nuisance Enforcement Officer – Jerry Carlson; Clerk/Treasurer – June Moline; Utility/Maintenance Superintendent – Nick Raver; Attorney – Bromm, Lindahl, Freeman-Caddy, Lausterer Law Firm; Accountant – Ed Schroeder; Engineer – Olsson Associates; Street Superintendent – Julie Ogden; Building Inspector – Terry Miller, Hearing Officer – Alberto Silva. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
Motion by Havelka, second by Wielage, to approve the Bank of Mead as the official depository for the deposit of all funds of the village. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
Motion by Wielage, second by Wimer, to approve Inspro Insurance as insurance carrier; Retirement Plan Consultants as 401k administrator; and the Wahoo Newspaper as the official newspaper. Vote: Havelka-yes, Wielage-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
Motion by Wimer, second by Wielage, to designate the method of posting of meetings to be at the Bank of Mead, Mead Post Office and Village Office. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
Motion by Havelka, second by Felty, to designate that members of the Planning Commission and Library Board are chosen by appointment. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.
The following designations were made: Common Facility Board – Wielage and Wimer; Municipal Board of Health – Havelka; Police Chief Carlson and Mary Miller; Board of Adjustments – Felty, Havelka, Wielage, Wimer and Planning Commission Chair Weible, with Guyle as alternate.
Motion by Havelka, second by Wimer, to approve a retainer for 2018 at $350.00 for services with Bromm, Lindahl, Freeman-Caddy, Lausterer Law Firm. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
SCHEDULED GUEST:
Members of the Mead Planning Commission, Matt Bratsburg, Rick Miller and Levi Durnal, were present to discuss proposed amendments to the zoning ordinance. Proposed are additions of containers, propane and Performance Standards to A/I Agricultural/Industrial District. The discussion on containers appeared that opinions were unclear regarding dumpsters used for clean-up purposes and semi-containers without wheels commonly referred to as pods. The concern of propane tanks is listing of the Mead Fire Chief as the inspector of the proposed location. Levi indicated guidelines of the Nebraska Fire Marshall’s department and their final inspection is required. Location guidelines are based on gallon size of the tank. The concern with the performance standards is the octave range in the noise section. Following discussion by the Planning Commission at their January 22, 2018 regular meeting, the proposals will once again be presented to the board for their review.
PLANNING COMMISSION REPORT: The minutes of the November 27 Regular Meeting and permits were accepted. Buidling permits: 17-21, Jeremy Harnish to construct a deck; 17-22, Brooke Koehler to construct a 4’ fence; and 17-24, Lee Feldhaus to place two trailers; and Demolition Permit: 17-23, Lee Feldhaus to remove two trailers. The 2017 Permit Report was reviewed.
SCHEDULED GUESTS:
Jenea and Cody Sweeter sought consideration to amend Municipal Code 6-202 to allow chickens within village limits. They were raised in rural communities, like farm fresh eggs and the chickens keep the bugs down in the yard and garden. They would keep the chickens in an enclosed area on a concrete slab. The board will seek advisement from the Planning Commission on going forward.
Craig Jones, First National Bank, discussed the interim construction loan process for the water project. He had spoken to Janice Stopak with the USDA and she said the loan cannot move forward until she receives the Preliminary Design color coded map and the Final Design Property Docket from Olsson Associates. A requirement prior to funding by the USDA is that the village expends the funds invested in cd’s at the Bank of Mead prior to receipt of loan dollars.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
Carlson presented the Monthly Police Report and reviewed the nuisance abatements currently in place. He indicated Resolutions 17-06, 17-13 and 17-15 have met the required abatement requirements.
Motion by Havelka, second by Felty, to approve closure of the nuisance abatements on properties described in Resolutions 17-06, 17-13 and 17-15. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
Three nuisance complaints were presented. Following discussion and sharing of photographs, motion by Guyle, second by Felty, to declare nuisance abatements on properties described by Resolutions 17-16, 17-17 and 17-18. Vote: Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.
RESOLUTION No. 17-16
The Board of Trustees of the Village of Mead, Nebraska, in Regular Session assembled at the Village Office in Mead, Nebraska on this 12th day of December, 2017, hereby make the following findings:
WHEREAS, the Nuisance Officer has presented a report setting forth alleged nuisance violations on property legally described as Lots 7, 9, and 11, Block 25, Original Town Mead, Mead, Saunders County, Nebraska, also described as 307 S. Cedar Street, Mead, Nebraska, which is located within its village limits and within its zoning jurisdiction, identifying that in his opinion a nuisance exists as defined by Village Ordinance; said report contains photographs and other evidence pertinent to the situation, and the report was presented at a regular meeting for confirmation that a nuisance exists, a copy of said report is attached hereto, and
WHEREAS, a review by the Board of Trustees of the Village of Mead was made at a Regular Meeting held on the 12th day of December, 2017, and
WHEREAS, the Board of Trustees, after review of the report and the accompanying photographs and evidence desires to declare the conditions found therein as Nuisances pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-302.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD that the findings hereinabove made are incorporated herein and that the Board of Trustees declares that nuisances exists upon the property so identified which is within the zoning jurisdiction of the Village.
RESOLUTION No. 17-17
The Board of Trustees of the Village of Mead, Nebraska, in Regular Session assembled at the Village Office in Mead, Nebraska on this 12th day of December, 2017, hereby make the following findings:

Oak Street, Mead, Nebraska, which is located within its village limits and within its zoning jurisdiction, identifying that in his opinion a nuisance exists as defined by Village Ordinance; said report contains photographs and other evidence pertinent to the situation, and the report was presented at a regular meeting for confirmation that a nuisance exists, a copy of said report is attached hereto, and
WHEREAS, a review by the Board of Trustees of the Village of Mead was made at a Regular Meeting held on the 12th day of December, 2017, and
WHEREAS, the Board of Trustees, after review of the report and the accompanying photographs and evidence desires to declare the conditions found therein as Nuisances pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-302 and Zoning Regulation Chapter 11, Ordinance 11-202.

Oak Street, Mead, Nebraska, which is located within its village limits and within its zoning jurisdiction, identifying that in his opinion a nuisance exists as defined by Village Ordinance; said report contains photographs and other evidence pertinent to the situation, and the report was presented at a regular meeting for confirmation that a nuisance exists, a copy of said report is attached hereto, and
WHEREAS, a review by the Board of Trustees of the Village of Mead was made at a Regular Meeting held on the 12th day of December, 2017, and
WHEREAS, the Board of Trustees, after review of the report and the accompanying photographs and evidence desires to declare the conditions found therein as Nuisances pursuant to the Village Code of Ordinances (Ordinance No. 657), 4-302 and Zoning Regulation Chapter 11, Ordinance 11-202.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported replacement of water meters; inspection of Well 92-1; concern of a well located at a residence; repair to the sewer pump; and consideration of adding geothermal regulations and requirement that all residences/businesses located within village limits be required to be connected to village services. A concern was reported about having the ditch drained south of 320 W. First St. A bid from Big Red Home Improvement for $400 to repair the decorative lamp post at 413 S. Vine Street was presented. A bid of $2,862.28 from NMC was presented for four rubber tires for the skidloader. Discussion of both bids will take place at the January 9, 2018 board meeting.
UNSCHEDULED GUEST:
Matt Bratsburg presented a concern regarding the water quality and pressure at his residence. He said the pressure is low and he presented numerous filters from his water softener. Since the filters show what is collected after flowing through the water softener the board suggested he have the softener checked. He stated he would do so. Rod reminded Matt that the more filters you have the more your pressure will be slowed. He will try and by-pass the softener to see if pressure improves. He had checked with area residents and they had indicated that they have good pressure.
LIBRARY REPORT:
The minutes of the November 15 Library Board meeting were accepted.
Motion by Havelka, second by Felty, to approve amending Library Board meeting dates from the third Wednesday of the month to the third Monday of the month. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.
CLERK REPORT: June Moline
Approval was granted for Moline to attend Clerk Academy in Grand Island on March 27 and 28, 2018. Noted was the Appreciation Dinner for board members, spouses and their guests at G&L Café on January 7, 2018. Havelka will contact Troy Kadavy regarding webpage design.
NEW BUSINESS:
Havelka introduced, motioned to waive three readings and to adopt Ordinance No. 701, amend Chapter 8, Section 8-103 Municipal Property Sale and Conveyance. Action is directed by Legislative Bill 315. A second to the motion was made by Guyle. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes; motion carried 5-0.
ORDINANCE NO. 701
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 8, PUBLIC WAYS AND PROPERTY; ARTICLE 1 MUNICIPAL PROPERTY; SECTION 8-103 MUNICIPAL PROPERTY; SALE AND CONVEYANCE; OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT OF THE SALE OF PROPERTY; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE.
Motion by Guyle, second by Wimer, to approve an application to the Nebraska Liquor Control Commission from Mead Days Association to serve alcohol at the Mead park during Mead Days, June 15, 16 and 17, 2018. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 5-0.

Volunteer Fire Department to the Nebraska Liquor Control Commission to serve alcohol at the Mead Community Building on February 17, 2018 for a Wild Game Feed. Vote: Felty-yes, Guyle-yes, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
