PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
October 11, 2016
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held October 11, 2016 at the Village Office. Clerk Moline called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Trustees Jason Felty, Gary Guyle, Richard Wielage and Rod Wimer. Absent was Chairman Shawn Havelka. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Police Chief Jerry Carlson and Library Director Laurie VanAckeren. Guests were Craig Reinsch, Janice Stopak and Brooke Lamprecht.
The posting of the Open Meetings Law was noted.
Motion by Wielage, second by Felty to adopt the agenda. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.
Clerk Moline called for nominations for Chairman Pro-tempore.
Wimer nominated Guyle as Chairman Pro-tempore and motioned for nominations to cease, second by Felty. Vote: Guyle-no, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 3-1.
The minutes of the September 13 Regular Meeting and Budget Hearing were approved as presented.
Motion by Wimer, second by Wielage to approve the Treasurer’s Report showing $746,715.33 total checking/savings balance ending September 30, 2016. Vote: Havelka-absent, Wielage-yes, Wimer- yes, Felty-yes, Guyle-yes; motion carried 4-0.
Motion by Wielage, second by Wimer to approve the claims of $89,139.96 for payment. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0.

SCHEDULED GUESTS:
Janice Stopak with USDA Rural Development, presented a funding proposal for the anticipated water project. The proposal calls for loan assistance in the amount of a $2,590,000.00 loan. The loan would be secured by a Bond and payable in annual installments of $92,619.00 with a reserve payment of $9,662.00 per year and a Short Lived Asset Reserve of $20,600.00 per year. The loan has a repayment period of 40 years at a 1.875% interest rate. Grant assistance will be in the amount of $877,000.00.
Craig Reinsch, Olsson Associates, presented Amendment #2 for professional services with Olsson Associates for the water project. He indicated the provisions were required prior to approval of funding.
Motion by Guyle, second by Wielage to approve Amendment #2 for professional services with Olsson Associates for the water project. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.
Brooke Lamprecht reported that her insurance carrier is requesting that the burned house/garage located at 420 S. Cedar Street be demolished by November 7 so that the claim may be settled. Brooke was provided a copy of the bid received from Lierman Excavating to demolish the house. She was also given an Application for Demolition Permit. She was encouraged to submit the permit to the Planning Commission by their October 24 meeting for approval. Once approval is obtained she was advised to have the house/garage demolished.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
Carlson presented a written Monthly Police Report. He reported the nuisance concern at 410 S. Oak Street will be addressed once a date has been set with the Mead Fire Department to burn the garage. Guyle presented a concern with vehicles parked along N. First St. Carlson was directed to speak to residents about parking further east of the intersection of Elm Street and N. First Street toward the alley or only parking vehicles in the driveways. Carlson reported he is a member of Mead Public School’s Crisis Plan Safety Committee.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported receipt of the new pickup and XUV and upcoming inspection by ISO.
PLANNING COMMISSION REPORT:
Motion by Guyle, second by Wimer, to approve the minutes of the September 26, 2016 Regular Meeting. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.
Building Permits accepted were: 16-17, Lauren & Vera Kuhr to erect a privacy fence; 16-18, Curtis Pearson to construct a garage addition and erect chain-link and wood fences; and 16-19, Brad Howell to construct a garage addition.
LIBRARY REPORT:
Motion by Wimer, second by Wielage to approve the minutes of the September 21, 2016 Library Board Meeting. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.
Motion by Guyle, second by Wielage to approve Mary Mayfield as a member of the Library Board. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.
VanAckeren invited the board and employees to read a story to children during Story Hour for the month of November in honor of “Read Aloud Month”.
CLERK REPORT:
Moline reported that Accountant Schroeder had completed the audit for fiscal year October 1, 2015 through September 30, 2016 and reported concerns received from residents regarding odors.
NEW BUSINESS:
Guyle introduced and motioned to waive three readings and adopt Ordinance No. 687 amending Chapter 4, Health and Nuisances, Article 4 Nuisances, Section 4-305 Expenses. The motion was seconded by Felty. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.
ORDINANCE NO. 687
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 4 OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT OF NUISANCES; EXPENSES THERETO OF ARTICLE 3, SECTION 4-305; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE.
Felty motioned, second by Wimer, to authorize the Village Clerk and Chairman to approve the purchase of a pick-up and XUV pursuant to resolution. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.
Clerk Moline presented interest rates from several financial institutions seeking a loan in the amount of $30,763.00 to purchase a pick-up and XUV with three annual payments beginning September 15, 2017. Rates obtained were: Wahoo State Bank, Wahoo 4.5%, Bank of Mead, Mead 2.5% and Union Bank, Wahoo 4.39%.
Motion by Wimer, second by Wielage to adopt Resolution 16-16 to obtain a loan of $30,763.00 from the Bank of Mead to purchase a 2016 Ford F350 pick-up and John Deere XUV 855D. The interest rate is 2.5% with three annual payments beginning September 15, 2017. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0.
RESOLUTION 16-16
WHEREAS, the board of trustees of any village may by resolution provide for direct borrowing from a financial institution for the purchase of equipment, construction of improvements or refinancing of existing indebtedness upon a certification in the resolution authorizing the direct borrowing that:
-
Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing would be impractical;
-
Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing could not be completed within the time restraints facing the village; or
-
Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through direct borrowing would generate taxpayer savings over traditional bond financing, and
WHEREAS, prior to approving direct borrowing, the board of trustees shall include in any public notice required for meetings a clear notation that the resolution authorizing direct borrowing from a financial institution will appear on the agenda; and
WHEREAS, the total amount of indebtedness from direct borrowing as provided herein, shall not exceed twenty percent (20%) of the municipal budget of the village, and
WHEREAS, a bid has been received from Lee Sapp Ford, Ashland, Nebraska, to purchase a 2016 Ford F350 4×4 Pick-up for $38,228.00 less $17,000.00 trade-in value of a 2011 Ford SRW Super Duty F250 Pick-up less $7,965.00 Government Rebate for a total cost of $13,263.00;
WHEREAS, a bid has been received from Platte Valley Equipment, Fremont, Nebraska, to purchase a John Deere XUV 855D, 45 gallon High Performance Sprayer and 150 inch Precision Boom at a cost of $17,500.00.
Motion by Wimer, second by Wielage to approve an Agreement for Professional Services with Olsson Associates for services from January 1, 2017 through December 31, 2019. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.
