PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
July 11, 2023

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held July 11, 2023 at the Village Office. Chairman William Thorson called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman William Thorson; Board of Trustees Jason Felty, Jason Lee, and Richard Wielage. Absent was Trustee Daniel Simon. Also present were Clerk June Moline and Utilities/Maintenance Superintendent Shannon Luetkenhaus. Guests were Sara Tanner, Patrick O’Connor and Melissa Burke

The posting of the Open Meetings Law was noted as posted at the entrance.

Motion by Wielage, second by Lee, to adopt the agenda. Vote: Felty-yes, Lee-yes, Simon-absent, Thorson-yes, Wielage-yes; motion carried 4-0.

The minutes of the June 13 Regular Meeting and July 10 Special Meeting were accepted.

Motion by Wielage, second by Felty, to approve the Treasurer’s Report showing $1,255,419.28 total checking/savings balance ending June 30, 2023. Vote: Lee-yes, Simon-absent, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

SCHEDULED GUEST:
Sara Tanner, representing AGT, reported on the process of Keno. She indicated the village is the licensee and Mead Me at the Goat is the location, with Advanced Gaming Technologies, Inc. as the owner/operator with John Hassett and June Moline named as signers of form 50G licensing form for the Keno writers. AGT will provide the equipment with 8% retained by the village, 2% to the State of Nebraska, and 6% of the fund going to Mead Me at the Goat. Keno will be random number generated with the pay out rate set as the same rate as the City of Yutan. ATG serves seventy locations, with forty to fifty of those serving municipalities and counties. She indicated Mead Me at the Goat opened July 7.

Lee introduced Resolution 23-07, second by Thorson. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-absent, Thorson-yes; motion carried 4-0.

Motion by Felty, second by Lee, to adopt Resolution 23-07, The Village of Mead endorsing a lottery game in conjunction with Advanced Gaming Technologies, Inc. and approving Mead Me at the Goat as its outlet location. Vote: Felty-yes, Lee-yes, Simon-absent, Thorson-yes, Wielage-yes; motion carried 4-0.

RESOLUTION NUMBER 23-07

A RESOLUTION OF THE VILLAGE OF MEAD ENDORSING A LOTTERY GAME IN CONJUNCTION WITH ADVANCED GAMING TECHNOLOGIES, INC., AND APPROVING MEAD ME AT THE GOAT AS ITS OUTLET LOCATION.
WHEREAS, the Mead Village Board of Trustees approves the contract between the Village of MEAD and Advanced Gaming Technologies Inc.; and
WHEREAS, the Mead Board of Trustees approves the Qualification Standards for sales outlets as outlined by Nebraska statutes; and
WHEREAS, the location of said sales outlet shall be “Mead Me at the Goat” located at 420 S Vine St, Mead, NE 68041; and
WHEREAS, the Mead Village Board of Trustees approves the attached player eligibility requirements; and
WHEREAS, the keno records shall be stored electronically via website provided by Advanced Gaming Technologies Inc.; and
WHEREAS, John Hassett and June Moline are signers of form 50G licensing forms for the lottery workers (keno writers).

Thorson introduced Resolution 23-08, second by Felty. Vote: Lee-yes, Simon-absent, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

Motion by Lee, second by Felty, to adopt Resolution 23-08, Approve the qualification standards of sales outlets by Nebraska Statutes Section 9-642.01. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-absent; motion carried 4-0.

RESOLUTION #23-08

A RESOLUTION OF THE VILLAGE OF MEAD OF THE COUNTY OF SAUNDERS, NEBRASKA APPROVING THE QUALIFICATION STANDARDS OF SALES OUTLETS BY NEBRASKA STATUTES SECTION 9-642.01

A. The lottery operator (Advanced Gaming Technologies Inc.) with whom the Village of MEAD contracts to conduct its lottery shall not operate the lottery at a sales outlet location without prior approval of the sales outlet location by the Village of MEAD. The Village Council of MEAD shall approve or disapprove each sales outlet location and individual, sole proprietorship, partnership, limited liability company, or corporation which desires to conduct the lottery at its sales outlet location solely on the basis of the qualification standards prescribed in division (B) of this section.

Motion by Thorson, second by Lee, to adopt the Player Eligibility Requirements. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-absent, Thorson-yes; motion carried 4-0.

Annual review of the Conditional Use Permits was held.

Wielage introduced and motioned to waive three readings of Ordinance No. 816, Set rate for sale of bulk water. Thorson seconded the motion. Vote: Felty-yes, Lee-yes, Simon-absent, Thorson-yes, Wielage-yes; motion carried 4-0.

Motion by Lee, second by Wielage, to adopt Ordinance No. 816, Set rate for sale of bulk water as $20.00 fee per day plus $.01 per one gallon of water. Vote: Lee-yes, Simon-absent, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

ORDINANCE NO. 816

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 3, DEPARTMENTS; ARTICLE 1, WATER DEPARTMENT; SECTION 3-109, MUNICIPAL WATER DEPARTMENT; MINIMUM RATES; OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT OF WATER RATES; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE.

Interest rates from financial institutions for a loan of $48,654.00 for LED lights and setting the lights at the ballfield at the park were reviewed. Rates being: Bank of Mead 5%, Wahoo State Bank 5.95%, and First Bank of Nebraska 5.95%.

Thorson introduced Resolution 23-06, second by Felty. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-absent; motion carried 4-0.

Lee motioned to adopt Resolution 23-06, Loan with the Bank of Mead for $48,654.00 for LED lights and setting the lights at the ballfield at the Mead Park at the rate of 5% interest. Felty seconded the motion. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-absent, Thorson-yes; motion carried 4-0.

RESOLUTION 23-06

WHEREAS, the Board of Trustees of any village may by resolution provide for direct borrowing from a financial institution for the purchase of equipment, construction of improvements or refinancing of existing indebtedness upon a certification in the resolution authorizing the direct borrowing that:

a. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing would be impractical;
b. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through traditional bond financing could not be completed within the time restraints facing the village; or
c. Financing the purchase of property, construction of improvements or refinancing of existing indebtedness through direct borrowing would generate taxpayer savings over traditional bond financing, and

WHEREAS, prior to approving direct borrowing, the board of trustees shall include in any public notice required for meetings a clear notation that the resolution authorizing direct borrowing from a financial institution will appear on the agenda; and for payment to SECO Electric for new LED lighting and setting the lights at the ballfield located at the Mead Park in the amount of $48,654.00.

WHEREAS, the Board of Trustees deems it in the best interests of the Village of Mead to acquire said equipment by mutual agreement,

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, AS FOLLOWS:

1. That the Board of Trustees certifies that the direct borrowing of funds for new LED lighting and setting the lights at the ballfield located at the Mead Park through traditional bond financing would be impractical.

2. That public notice for the meeting this resolution was acted upon, was provided and a clear notation that this resolution authorizing direct borrowing from a financial institution did appear on the agenda.

3. That the amount of indebtedness for the payment of work completed and described below shall be $48,654.00 at 5% interest for a period of three (3) years payable in the following installments: $17,170.69 principal plus interest on September 15, 2023, $17,170.69 principal plus interest on September 15, 2024, and $17,170.69 principal plus interest on September 15, 2025.

Approval was granted for Scarlet Foley to place a portable library at the park as part of her Girl Scout project. She is looking for donations of new or used books and building materials. She is targeting late August as the date to have the library in place.

Questions have been raised as to starting a Park Committee.

Motion by Felty, second by Thorson, to table discussion for a Park Committee. Vote: Felty-yes, Lee-yes, Simon-absent, Thorson-yes, Wielage-yes; motion carried 4-0.

Discussion was held on damage to a 6” water main while a contractor was digging for Frontier Coop’s new storage bins. Several ideas for replacement of the main were presented. The village will pay the cost to repair the main but have required Frontier Coop pay to have the main rerouted. Frontier Coop will submit in writing their plan and action for rerouting of the main. Repair of the Civil Defense siren will be paid by the village. Use of the old wellhouse on Fourth Street was discussed. Repair of a water line at 17 N. Elm Street was noted.

UTILITIES/MAINTENANCE SUPERINTENDENT REPORT: Shannon Luetkenhaus
Luetkenhaus reported upkeep at the park and municipal properties around town; equipment maintenance; removing brackets from Christmas decorations; organizing the Quonset; and dirt work at the dumpsite. She requested the purchase of new Christmas decorations and noted receipt of four new water hydrants.

Motion by Felty, second by Lee, to approve the purchase of eleven Christmas assorted pole-mount decorations at a total cost of $1,825.96. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-absent; motion carried 4-0.

BUILDING AND ZONING ADMINISTRATOR REPORT:
Motion by Thorson, second by Felty, to approve Building Permit 23-09, AltEn LLC – Installation of Treatment Plant for Site Wastewater. This will be a temporary structure and has been approved by NDEE. Vote: Lee-yes, Simon-absent, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

PLANNING COMMISSION REPORT:
The minutes of the June 12 Special Meeting were accepted.

LIBRARY REPORT:
The minutes of the July 6 Library Board Meeting were accepted. Discussion was held on the Workmen’s Comp case with surgery planned for August 17th.

CLERK REPORT: June Moline
Moline reported a letter to be sent to the Nebraska Public Service Commission in support of Charter Communications application for the NBBP grant to improve broadband.

Motion by Felty, second by Lee, to enter Executive Session at 7:38 p.m. for staff evaluations to prevent needless injury to the reputation of the persons and if such persons have not requested a public hearing. Vote: Wielage-yes, Felty-yes, Lee-yes, Simon-absent, Thorson-yes; motion carried 4-0.

The board reconvened in regular session at 8:03 p.m.

Wielage introduced and motioned to waive three readings of Ordinance No. 817. Lee seconded the motion. Vote: Lee-yes, Simon-absent, Thorson-yes, Wielage-yes, Felty-yes; motion carried 4-0.

Motion by Wielage, second by Thorson, to adopt Ordinance No. 817, Wage increase for the following employees: Utilities Maintenance Superintendent 7%; Police Chief 3%; Dumpmaster and Substitute Dumpmaster 3%; Building/Zoning Administrator / Building Inspector 20%; and the Library Board approved wage increases: Library Director 13.5%; Assistant Librarian 11.5%; and Library Aide 3%. Vote: Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Simon-absent; motion carried 4-0.

ORDINANCE NO. 817

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR AMENDMENT OF THE WAGE OR SALARY OF THE UTILITIES/MAINTENANCE SUPERINTENDENT, POLICE CHIEF, LIBRARY DIRECTOR, ASSISTANT LIBRARIAN, LIBRARY AIDE, DUMPMASTER AND SUBSTITUTE
DUMPMASTER, AND BUILDING/ZONING ADMINISTRATOR / BUILDING INSPECTOR OF THE VILLAGE OF MEAD, NEBRASKA.

Discussion was held on reimbursement at a special rate to Utilities Superintendent for week-end hours. Clerk is to contact NE Clerks for their policies.
