PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

November 10, 2020

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held November 10, 2020 at the Mead Community Building.  Chairman Thorson called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office, and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson, Trustees Jason Felty, Gary Guyle, Richard Wielage, and Rodney Wimer.  Also present was Clerk June Moline. Guests were Josh Sharpe, Ed Schroeder, Lisa Flesner, Julie Ogden, and Melissa Burke.

The posting of the Open Meetings Law was noted.

Motion by Wimer, second by Guyle, to adopt the agenda.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

The minutes of the October 13 Regular Meeting and Public Hearing were accepted.

Motion by Guyle, second by Felty, to approve the Treasurer’s Report showing $936,623.84 total checking/savings balance ending October 31, 2020.  Vote: Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

Motion by Thorson, second by Wimer, to approve Certificate of Payment #4 to Neuvirth Construction in the amount of $102,225.57 for building construction and site utilities work. Vote:  Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

Motion by Wielage, second by Guyle, to approve the claims of $155,498.84 for payment.  Vote: Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes; motion carried 5-0.  Claims being:

SCHEDULED GUESTS:

Ed Schroeder and Lisa Flesner presented the October 1, 2019 through September 30, 2020 Audit Report. Highlighted concern with possible late property tax payments, concern of sufficient sewer Fund income, maintaining balance for the Debt Service, and positive cash flow in all accounts with a small loss of the Sewer Fund.

Motion by Thorson, second by Felty, to approve the October 1, 2019 through September 30, 2020 Audit Report.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

Julie Ogden, JEO Consulting Group, updated the board on the N. Oak Street Paving Project.  An updated schedule was presented.  She indicated that she reported at the Pre-con meeting there were two crews required to complete the project.  One was to complete the sewer and pipe work and the other the paving.  The preparation for paving is expected to begin Monday, November 16. Major completion of the project is planned by Thanksgiving, November 26.  The board expressed concern with a drainage tube under the drive/access road at station 13+72.  The concern at the northwest corner of First and Oak Street which was excavated for repair will be filled and graded to drain to the west.  She noted there is a one-year warranty on the project and a bond in place.

Motion by Wimer, second by Thorson, to approve Pay Certificate #1 to ME Collins Construction in the amount of $18,418.50 for sanitary sewer, culvert, and manhole work.  Vote:  Wielage-no, Wimer-yes, Felty-yes, Guyle-no, Thorson-yes; motion carried 3-2.

Josh Sharpe inquired why a 6’ solid vinyl fence was permitted at a residence near his home.  He stated the south breeze and view from his deck is blocked by the white fence. Thorson indicated the fence meets zoning regulations for the (R-1) Single Family zoning district.

 

UNFINISHED BUSINESS:

Motion by Thorson, second by Felty, to waive second reading and adopt Ordinance No. 756, Amend Chapter 9 Building Regulations, Section 9-601 Building Code; Adopted – Reference and amend section subject to the applicable statutes of the State of Nebraska.  Vote:  Felty-yes, Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes; motion carried 5-0.

ORDINANCE NO. 756

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND SECTION 601 OF ARTICLE 6, CHAPTER 9 OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, PERTAINING TO THE BUILDING CODE AND TO AMEND SAID SECTION SUBJECT TO THE APPLICABLE STATUTES OF THE STATE OF NEBRASKA.

Motion by Felty, second by Wimer, to waive second reading and adopt Ordinance No. 757, Amend Chapter 3 Departments, Section 3-103 Municipal Water Department; Water Contract.  Vote:  Guyle-yes, Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes; motion carried 5-0.

 

ORDINANCE NO. 757 

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 3 DEPARTMENTS; ARTICLE 1 WATER DEPARTMENT; SECTION 3-103 MUNICIPAL WATER DEPARTMENT; CONSUMER’S APPLICATION.

 

NEW BUSINESS:

Motion by Wielage, second by Wimer, to permit Raver to purchase a 2020 Hiniker snowblade from Midwest Service and Sales at approximately $3,500.00, which includes credit for trade-in of the current blade.  Vote:  Thorson-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes; motion carried 5-0.

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT

The Monthly Police Report was reviewed.  A letter was reviewed from a property owner requesting an extension of Resolution 20-10 Nuisance Declaration.

Motion by Thorson, second by Felty, to grant an extension of Resolution 20-10 Nuisance Declaration deadline until April 1, 2021 at which time documentation must be presented showing bid accepted and anticipated start and completion dates of the project.  Vote:  Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Thorson-yes; motion carried 5-0.

SCHEDULED GUEST: 

Melissa Burke appeared before the board to discuss the bar.  She indicated she has no date as to when the bar will open.  The board’s concern is the family residing at the apartment above the bar which at present is not an operating business, which is a requirement within the (B-2) Neighborhood Business zoning district.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: 

Thorson reported contact with the manager of Frontier Cooperative, Mead asking that they replace a section of concrete at the intersection of Third and Elm Streets as well as the sidewalk at that location by the south railroad track.  The street and sidewalk were damaged this summer when semi-trucks were entering Elm Street from the rock road south of the railroad tracks while hauling white rock.

PLANNING COMMISSION REPORT:

The minutes for the October 26 meeting and building permits were accepted.  Permits being:  20-21, Eric Johnson to erect 4’ chain-link fence; 20-22, Gene Janecek to remove and construct a larger deck; 20-23, Jeff and Tara Frahm to remove and construct a larger garage.

LIBRARY REPORT:

No meeting.

CLERK REPORT:  June Moline

Discussion was held on holding the Annual Appreciation Dinner for village boards and employees.  The decision was reached to cancel the meal this year due to Covid-19.

Chairman Thorson thanked Trustees Guyle and Wimer for their dedicated eight years of service on the Board of Trustees.
