  PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

June 9, 2015

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held June 9, 2015 at the Village Office.  Chairman Guyle called the meeting to order at 6:00 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman Gary Guyle; Trustees Shawn Havelka, PJ Nicola, Richard Wielage and Rod Wimer.  Also present were Clerk June Moline, Utility / Maintenance Superintendent Nick Raver, and Library Assistant Laurie Van Ackeren. Guests present were Tanner Shaw and Andrew Dietzel.

 

The posting of the Open Meetings Law was noted.

 

Motion by Wielage, second by Havelka to adopt the agenda.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes; motion carried 5-0.  The amendment to the April 14 Regular Meeting minutes is with the addition to item J.  “Zoning Administrator Carlson is to give notice of zoning violation of site-triangle and parking spaces on property located at 1020 Co Rd M.”

 

The minutes of the May 12 Regular Meeting and May 29 Special Meeting and amended April 14 Regular Meeting stood approved as presented.   

 

Motion by Wielage, second by Wimer to approve the Treasurer’s Report showing $737,304.48 total checking/savings balance ending May 31, 2015.  Vote: Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0. 

 

Motion by Havelka, second by Wielage to approve the claims of $64,253.16 for payment.  Vote:  Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0, with Wimer abstaining on Check #3275. Claims being:

LIBRARY REPORT:  Laurie Van Ackeren

The minutes of the May 20 Library Board Meeting were reviewed. Library Assistant Van Ackeren reported successful Library Summer Reading program, upcoming events and inquired about repair of the library entry door.

 

UTILITY/MAINTENANCE SUPERINTENDENT REPORT:  Nick Raver

Raver reported weekly spraying for mosquitoes by the City of Wahoo, purchase of material for the ballfields, sewer line repair at 32 N. Vine St. and need to replace the sewer jet.  Consideration to purchase a new jetter within the current fiscal year was discussed.

 

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: 

The Monthly Police Report was presented in written form from Police Chief Carlson.  Complaints of properties requiring maintenance were discussed.

 

PLANNING COMMISSION REPORT:

The minutes of the May 18 Regular Meeting and Building Permits 15-04, Megan Bukaska to construct a deck and 15-05, Jeff Frahm to construct a deck were reviewed.

 

Motion by Wielage, second by Nicola to accept the May 20 Library Board Meeting minutes, May 18 Planning Commission minutes, re-appointment of Levi Durnal to the Planning Commission and appointment of Ruth Dobesh and Audra Wirth to the Planning Commission.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes; motion carried 5-0. 

 

CLERK REPORT:  June Moline

Moline reported meter maintenance and scheduled vacation.

 

NEW BUSINESS:

Chairperson Guyle presented the name of Alberto Silva as Hearing Officer.  Motion by Wimer, second by Wielage to appoint Alberto Silva as the villages’ Hearing Officer through December 7, 2015.  Vote:  Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes; motion carried 5-0.

 

Havelka introduced and motioned, second by Wielage to adopt Resolution 15-13, Lower Platte North Natural Resources District Multi-Jurisdictional Hazard Mitigation Plan Update.  Vote:  Nicola-yes, Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes; motion carried 5-0.

RESOLUTION NUMBER 15-13

 

WHEREAS, the Federal Disaster Mitigation Act of 2000 was signed in to law on October 30, 2000, placing new emphasis on state and local mitigation planning for natural hazards and requiring communities to adopt a hazard mitigation action plan to be eligible for pre-disaster and post-disaster federal funding for mitigation purposes; and

 

WHEREAS, a Multi-jurisdictional Hazard Mitigation Plan was prepared by Lower Platte North Natural Resources District, with assistance from JEO Consulting Group, Inc. of Lincoln, NE, which includes the jurisdiction of Mead, Nebraska.

 

WHEREAS, the purpose of the mitigation plan was to lessen the effects of disasters by increasing the disaster resistance of the Natural Resources District and participating jurisdictions located within the planning boundary by identifying the hazards that affect the Village of Mead, Nebraska and prioritize mitigation strategies to reduce potential loss of life and property damage from those hazards, and

 

WHEREAS, FEMA regulations require documentation that the plan has been formally adopted by the governing body of Mead, Nebraska in the form of a resolution and further requesting approval of the plan at the Federal Level.

 

Wielage introduced, motioned to waive three readings and adopt Ordinance No. 665, Rate for Bulk Water Sales with the amendment to Chapter 3, Article 1, Section 109.  Second by Wimer.  Vote:  Wielage-yes, Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes; motion carried 5-0.

   

ORDINANCE NO. 665                       

 

AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO AMEND CHAPTER 3 OF THE MUNICIPAL CODE OF THE VILLAGE OF MEAD, NEBRASKA, BY THE AMENDMENT OF WATER RATES THERETO OF ARTICLE 1, SECTION 3-109 AND WITH THE ADDITION OF “A SEPARATE RATE SHALL BE ESTABLISHED FOR BULK WATER SALES”; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE; TO PROVIDE THAT THE CHAIR AND THE APPROPRIATE DEPARTMENT, WHETHER ONE OR MORE, OF THE VILLAGE OF MEAD, NEBRASKA, ARE AUTHORIZED AND DIRECTED TO IMPLEMENT THIS ORDINANCE; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED WITHIN THE FIRST 15 DAYS AFTER ITS PASSAGE AND APPROVAL EITHER IN PAMPHLET FORM OR BY POSTING IN THREE PUBLIC PLACES IN THE VILLAGE OF MEAD, NEBRASKA, AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW AND AS PROVIDED HEREIN; AND TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BECOME AND BE MADE A PART OF THE MUNICIPAL CODE  OF THE VILLAGE OF MEAD, NEBRASKA. 

 

Motion by Wimer, second by Havelka to approve Agreement with AltEn, LLC to purchase water from the village at the set bulk water rate for Commercial Resident Users.  Vote:  Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes; motion carried 5-0.

 

No action on review of Wastewater Operator.  Discussion was held on collection of a delinquent water / sewer account.

 

Motion by Havelka, second by Nicola to adjourn at 6:50 p.m.  Vote:  Guyle-yes, Havelka-yes, Nicola-yes, Wielage-yes, Wimer-yes; motion carried 5-0.
