PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
November 8, 2016
A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held November 8, 2016 at the Village Office. Chairman Havelka called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Chairman Shawn Havelka; Trustees Jason Felty, Richard Wielage and Rod Wimer. Absent was Trustee Gary Guyle. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, and Police Chief Jerry Carlson. Guests were Ed Schroeder and Colleen Morrissey.
The posting of the Open Meetings Law was noted.
Motion by Wielage, second by Wimer to adopt the agenda. Vote: Felty-yes, Guyle-absent, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.
The minutes of the October 11 Regular Meeting were approved as presented.
Motion by Wimer, second by Wielage to approve the Treasurer’s Report showing $715,859.41 total checking/savings balance ending October 31, 2016. Vote: Havelka-yes, Wielage-yes, Wimer- yes, Felty-yes, Guyle- absent; motion carried 4-0.
Motion by Wielage, second by Wimer to approve the claims of $57,101.63 for payment with Wimer abstaining on Check #3609. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes; motion carried 4-0.

Village Accountant Ed Schroeder reviewed the October 1, 2015 through September 30, 2016 Audit Report.
Motion by Wielage, second by Felty to approve the October 1, 2015 through September 30, 2016 Audit Report.
Colleen Morrissey inquired about her recent water / sewer bill and rates. Up until last month’s reading she was using 1 – 2 units per month. The reading for October 24 showed 8 units or 8,000 gallons of usage. The board suggested that she have someone investigate as it appears to be a water leak. She did state that she recently had a plumber do work at her house. She was also told that when the new rates for non-resident users was adopted, that all non-resident users were charged the additional $10.00 usage fee for both water and sewer.
She inquired what and when the board plans to address the standing water issue on her property. This problem was first addressed in 2011 which resulted in a study of the drainage issue conducted by JEO Consulting Group. Chairman Havelka indicated that he had recently spoken to Jerry Charles to have the property shot to get the slope of the drainage ditch. An answer to her question may lie in the small culvert that was placed under the driveway on a neighboring residents’ property. She indicated that she was unhappy that the board in the past had cleaned the drainage ditch on her property to allow better water flow but that they had not sought permission to do so. She also stated that the weeds growing in the ditch does not prevent the water from draining nor does anything on her property prevent the proper flow of the water to drain, but the board disagreed. Her concern was that she recently had replaced an egress window in her basement and also has a second one but that the water still seeps into her basement. The egress windows are located on the south and east sides of her house. Her basement has sustained damage and twenty small evergreens have died in the past as well as recurring health issues to herself and mold in her house. She indicated that water stands on her property. She is also concerned that water drains onto her property from a neighbor’s property. The board suggested that she consider having her property surveyed to find the degree of slope as her house sits on the highest elevation of the subdivision. The board told her that the findings of the 2012 study indicated that the water cannot clear the culvert located under Co Rd 10 thereby preventing clearing of water from the subdivision. They asked that she address the culvert issue with the Saunders County Department of Roads and that they will pursue the issue of the smaller culvert located at the neighbors driveway.
POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
The Monthly Police Report was reviewed. Felty reported that Carlson indicated he had spoken to
the residents who reside along N. First St. and they are willing to not park along the street or park their vehicles further to the east of the intersection of N. First and Elm Street (near the alley). Discussion was held on unlicensed utility-type vehicles and golf carts driving on the streets of Mead.
UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported completion of cleaning the sewer lines located north of the Union Pacific Railroad tracks and recent homeowner’s sewer back-up.
PLANNING COMMISSION REPORT:
The minutes of the October 24, 2016 Regular Meeting and Building Permits were accepted. Permits being: 16-20, Jeff Getzschman, 1543 Co Rd 10 – erect chain-link fence; 16-21, Bryce Anderson – remove storage shed at Andy’s Mobile Home Park; 16-22, Bryce Anderson – erect wood storage shed at Andy’s Mobile Home Park; and Brooke Lamprecht, 420 S. Cedar Street – demolish house/garage.
LIBRARY REPORT:
The minutes of the October 19, 2016 Library Board Meeting were accepted.
Havelka introduced and motioned to waive three readings and adopt Ordinance No. 690 to set Library Aide wage at $9.00 per hour. Vote: Felty-yes, Guyle-absent, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.
ORDINANCE NO. 690
AN ORDINANCE OF THE VILLAGE OF MEAD, SAUNDERS COUNTY, NEBRASKA, TO PROVIDE FOR AMENDMENT OF THE WAGE OR SALARY OF LIBRARY AIDE OF THE VILLAGE OF MEAD, NEBRASKA.
CLERK REPORT:
Moline reported the process on the demolition house / garage at 420 S. Cedar Street and consideration of a radar speed sign.
NEW BUSINESS:
Motion by Wimer, second by Wielage to approve a $2,590,000.00 loan at $1.875% and $877,000.00 grant with the United State Department of Agriculture for a water project. Vote: Havelka-yes, Wielage-yes, Wimer-yes, Felty-yes, Guyle-absent; motion carried 4-0.
Wielage introduced and motioned to adopt Resolution 16-17, financial assistance from the United States Department of Agriculture Rural Development Financial Assistance in the amount of $3,467,000.00. The motion was seconded by Wimer. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-absent, Havelka-yes; motion carried 4-0.
RESOLUTION 16-17
VILLAGE OF MEAD
AUTHORIZING THE CHAIRPERSON AND THE CLERK OF THE VILLAGE OF MEAD, MEAD, NEBRASKA, TO EXECUTE DOCUMENTS REQUIRED TO RECEIVE UNITED STATES DEPARTMENT OF AGRICULTURE RURAL DEVELOPMENT FINANCIAL ASISTANCE.
The following motion was introduced and adopted this 8th day of November, 2016, by the Board of Trustees of the Village of Mead, Mead, Nebraska.
NOW, THEREFORE, BE IT RESOLVED BY:
The Board of Trustees of the Village of Mead, Mead, Nebraska, resolves that the Chairperson and Clerk are authorized and directed to execute any and all documents and security instruments or other memoranda between the Board of Trustees of the Village of Mead, Mead, Nebraska and the USDA Rural Development so as to effect the Water Project application(s) for assistance.
If the Chairperson or the Clerk should change because of an election or other reasons during the processing of the USDA Rural Development application(s), the Board of Trustees of the Village of Mead, Mead, Nebraska will not need to amend this resolution so the Chairperson and the Clerk can sign any form(s) and security instrument(s) to finalize the USDA Rural Development financial assistance.

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MEAD, NEBRASKA, LEVYING A SPECIAL ASSESSMENT IN THE AMOUNT OF $6,283.36 UPON THE PROPERTY BENEFITTED THEREBY, 1020 CO RD M, MEAD, sAUNDERS COUNTY, NEBRASKA, as described more fully herein, FOR abatement of A nuisance.
WHEREAS, the Village of Mead undertook the abatement of nuisances found to exist by the District Court of Saunders County, Nebraska, upon the real property described as:

WHEREAS, in the event the full payment is not received on or before November 16th, 2016
(two months after notice has been sent), a Special Assessment shall be levied and Notice of Special Assessment filed in the office of the Register of Deeds of Saunders County.
Motion by Felty, second by Wielage to approve first reading of Ordinance No. 689, amend Chapter 8, Public Ways and Property; Article 4, Curb and Gutter; Section 8-401, Curb and
Gutter; Cutting Curb. Vote: Felty-yes, Guyle-absent, Havelka-yes, Wielage-yes, Wimer-yes; motion carried 4-0.
The Annual Christmas Party was discussed.
