 PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES

December 9, 2014

 

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held December 9, 2014 at the Village Office.  Chairman Guyle called the meeting to order at 6:00p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided to the Chairman and all members of the Board of Trustees.  All proceedings were held while the convened meeting was open to the public.  Present were Chairman Gary Guyle; Trustees Shawn Havelka and Richard Wielage.  Absent were Trustee Adam Miller and Rod Wimer.  Also present were Clerk June Moline and Police Chief Carlson.  Guest present was PJ Nicola.

 

The posting of the Open Meetings Law was noted.

 

Motion by Havelka, second by Wielage to adopt the agenda.  Vote:  Guyle-yes, Havelka-yes, Miller-absent, Wielage-yes, Wimer-absent; motion carried 4-0.

 

Havelka and Wielage took the Oath of Office.  Due to Miller’s absence, a vacancy for the position of Trustee will be advertised.

 

Motion by Havelka, second by Wielage to approve the Certificate of Election for the November 4 General Election from the Saunders County Clerk.  Vote:  Havelka-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 3-0.

 

Motion by Havelka, second by Guyle to appoint Clerk Moline as Chairman Pro Tempore for election of a Chairperson.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0.

 

Clerk called for nominations for Chairperson.

 

Motion by Havelka, second by Wielage to nominate and elect Guyle as Chairman, with nominations to cease.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0.

 

Guyle assumed the role of Chairperson.

 

Motion by Havelka, second by Wielage to approve the following appointments:  Police Chief – Jerry Carlson; Clerk/Treasurer – June Moline; Utility/Maintenance Superintendent – Nick Raver; Library Director – Nancy Black; Attorney – Loren Lindahl; Accountant – Ed Schroeder; Engineer – Olsson Associates; Street Superintendent – Julie Ogden, JEO; Building Inspector – Terry Miller; Zoning Administrator – Jerry Carlson.  Vote:  Wimer-absent, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 3-0.

 

Motion by Wielage, second by Havelka to name the Bank of Mead as the official depository for all village funds.  Vote:  Guyle-yes, Havelka-yes, Wielage-yes, Wimer-absent; motion carried 3-0.

 

Motion by Wielage, second by Havelka to approve Inspro Insurance as the village’s insurance carrier, Retirement Plan Consultants as the 401k administrator, and the Wahoo Newspaper as the official newspaper.  Vote: Havelka-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 3-0.

 

Motion by Havelka, second by Wielage to approve the designated method of posting for official business as the Bank of Mead, Mead Post Office and Village Office.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0.

 

The following appointments were made:  Common Facility Board – Havelka and Wielage; Municipal Board of Health – Guyle, Police Chief Carlson and Community Health Care Provider Mary Miller; and Board of Adjustment – Havelka, Wielage, Wimer, vacant Trustee position and Planning Commission Chairperson Jody Weible; with Guyle as Alternate. 

 

The minutes of the November 11 Regular Meeting and November 11 Public Hearing stood approved as presented.

 

Motion by Havelka, second by Wielage to approve the Treasurer’s Report showing $639,014.11 total checking/savings balance ending November 30, 2014.  Vote: Havelka-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 3-0. 

 

Motion by Wielage, second by Havelka to approve the claims of $71,162.58 for payment.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0. Claims being:

Motion by Wielage, second by Havelka to approve the purchase of a tractor from Welton Auction for $13,500.00.  Vote:  Havelka-yes, Wielage-yes, Wimer-absent, Guyle-yes; motion carried 3-0.

 

Motion by Wielage, second by Havelka to approve a two-year retainer with Bromm, Lindahl, Freeman-Caddy and Lausterer law firm at a cost of $350.00 per year.  Vote:  Wielage-yes, Wimer-absent, Guyle-yes, Havelka-yes; motion carried 3-0.

 

POLICE REPORT:  Jerry Carlson

The Monthly Police Report was presented.  Discussion was held on contact with Union Pacific Railroad regarding trains parked at numerous railroad crossings for an extended period of time, exterior inspection and findings at Wild West Trading Post by the Municipal Board of Health, update on thefts at numerous residences, parking concerns at the park and duty call-in procedure.

 

UTILITY/MAINTENANCE SUPERINTENDENT REPORT:  Nick Raver

Guyle presented a report from Superintendent Raver.  Items reported were bid for a shredder and blade for the tractor and violation of a water test.

 

PLANNING COMMISSION REPORT:     

The minutes of the November 24 Meeting and Building Permit were reviewed.  Permit being:  14-22, Mead Ball Association – 6’ chain-link fence at park.

 

LIBRARY REPORT:

Donna McLaughlin has been hired as the Library Aide to replace Pat Miller during her absence.

 

CLERK REPORT:  June Moline

Moline reported numerous programs offered through the Hazard Mitigation Plan.

 

UNFINISHED BUSINESS:

Discussion was held on a delinquent water/sewer account.

 

NEW BUSINESS:

Introduction and motion by Havelka, second by Wielage to approve Resolution 14-12, Special Designated Liquor License to Mead Volunteer Fire Department to serve alcohol at a Game Feed at the Fire/Rescue/Community Building on February 21, 2015.  Vote:  Wimer- absent, Guyle-yes, Havelka-yes, Wielage-yes; motion carried 3-0.

 

RESOLUTION NO. 14-12

 

A RESOLUTION TO ADOPT A POLICY REQUIRING A SPECIAL LIQUOR LICENSE IS IN PLACE AT ALL PRIVATE OR PUBLIC FUNCTIONS HELD ON PUBLIC PROPERTY.

 

WHEREAS,                   the purchase of a Special Designated Liquor License must be obtained from the Nebraska Liquor Commission; and

 

WHEREAS,                   the applicant, Mead Volunteer Fire Department, submitted a request to submit an application to the Nebraska Liquor Control Commission for a Special Designated Liquor License for a Game Feed on Saturday, February 21, 2015, at the Mead Fire / Rescue / Community Building;

 

Wielage introduced, motioned to waive three readings and adopt Ordinance No. 656, Amend Chapter 9, Article 6, Section 9-601, Building Code; Adopted – Reference to adopt the 2009 International Building Code as the official building guideline.  Vote:  Guyle-yes, Havelka-yes, Wielage-yes, Wimer-absent; motion carried 3-0.

 

ORDINANCE NO. 656

 

An ordinance establishing the minimum regulations governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures; known as the Building Code.

 

Be it ordained by the Board of Trustees of the Village of Mead as follows:

 

Section 1.  That a certain document, three (3) copies of which are on file in the office of the Village Clerk of the Village of Mead, being marked and designated as the 2009 International Building Code, including Appendix Chapters, as published by the International Code Council, Inc., be and is hereby adopted as the Building Code of the Village of Mead in the State of  Nebraska; for the control of building and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance.

 

Section 2.  The following sections are hereby revised:

     Section 101.1  These regulations shall be known as the Building Code of the Village of Mead, Nebraska, hereinafter referred to as “this code.”

 

Section 3.  That Ordinance 656, of the Village of Mead, entitled Ordinance No. 656 and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
