PROCEEDINGS – VILLAGE OF MEAD BOARD OF ADJUSTMENT
July 14, 2015
A Special Meeting of the Board of Adjustment of the Village of Mead, NE was held July 14, 2015 at the Village Office. Chairman Guyle called the meeting to order at 6:24 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided in the Wahoo Newspaper and to all members of the Board of Adjustment. All proceedings were held while the convened meeting was open to the public. Present were Chairman Gary Guyle; Board Members Shawn Havelka, PJ Nicola, Jody Weible and Rodney Wimer. Also present were Clerk June Moline and Utility/Maintenance Superintendent Nick Raver. Guests present were Greg Larson and Jon Meier.
Chairman Guyle called the meeting to order.
The posting of the Open Meetings Law was noted.
Motion by Havelka, second by Guyle to adopt the agenda. Vote: Wimer-yes, Guyle-yes, Havelka-yes, Nicola-yes, Weible-yes; motion carried 5-0.
Chairman Guyle reported the purpose of the meeting was to address a request from Jon Meier, 1061 Co Rd L, Mead, for a variance for a sidewall height of 14’ to construct a storage shed. Jon indicated the camper he wishes to store in the shed has a height with the air conditioner included, measuring 13’1”. The maximum height required in the Suburban Residential District is 12’. Weible stated the request is a hardship due to the size of equipment. The Planning Commission is in the process of reviewing the Comprehensive Plan with a future recommendation of 14’ sidewalls for outbuildings for storage in this district.
Discussion was held, followed by call for public input.
Havelka introduced, and motioned, second by Nicola, to adopt Resolution 15-16, Variance to Jon Meier to amend Zoning Ordinance 11-305, C.1. on property described as Lot 3, Sheldon Cohen Subdivision, PT NW 2-14-8, 5.04 acres, also known as 1061 Co Rd L, Mead, to allow sidewalls of 14’ on an outbuilding for storage. Vote: Guyle-yes, Havelka-yes, Nicola-yes, Weible-yes, Wimer-yes; motion carried 5-0.
RESOLUTION 15-16
WHEREAS, The Village of Mead authorizes the variance request from Jon Meier of the following described real estate to wit:
Lot 3 of Sheldon Cohen Subdivision PT NW 2-14-8, 5.04 acres, Mead, Saunders County, Nebraska;
Resolution sets out findings of fact based on evidence and testimony that the following conditions exist or would result in: 1) the strict application of the zoning regulation would produce undue hardship; 2) such hardship is not shared generally by other properties in the same zoning district and the same vicinity; 3) the authorization of such variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting of the variance; and 4) the granting of such variance is based upon reason of demonstratable and exceptional hardship as distinguished from variations for purposes of convenience, profit or caprice.
WHEREAS, Variance amends Zoning Ordinance 11-305, District (SR), Suburban Residential that requires sidewalls for detached accessory building shall not exceed eight (8’) feet in height.
WHEREAS, the variance allows the sidewalls of garages and outbuildings for storage uses and other structures customary and appurtenant to the permitted uses not exceed twelve (12’) feet in height to fourteen (14’) feet in height in District (SR) Suburban Residential District.
Motion by Havelka, second by Wimer to approve a Building Permit to Jon Meier to construct a storage shed. Vote: Havelka-yes, Nicola-yes, Weible-yes, Wimer-yes, Guyle-yes; motion carried 5-0.
