PROCEEDINGS – VILLAGE OF MEAD BOARD OF ADJUSTMENT REGULAR MEETING

June 8, 2021

A Meeting of the Board of Adjustment of the Village of Mead, NE was held June 8, 2021 at the Mead Community Building.  Chairman Thorson called the meeting to order at 7:07 p.m.  Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes.  Advance notice was also provided in the Wahoo Newspaper and to the Chairman and all members of the Board of Adjustment.  All proceedings were held while the convened meeting was open to the public.  Answering roll call were Chairman William Thorson; Trustees Jason Felty, Jason Lee, Richard Wielage, and Planning Commission Vice Chairman Levi Durnal.  Also present were Board of Adjustment Alternate Daniel Simon, Clerk June Moline and Utilities/Maintenance Superintendent Nick Raver.  Guest was Jillian Spencer.

Chairman Thorson called the meeting to order at 7:07 p.m.

The posting of the Open Meetings Law was noted.

Motion by Felty, second by Lee, to adopt the agenda.  Vote: Felty-yes, Lee-yes, Durnal-yes, Thorson-yes, Wielage-yes; motion carried 5-0.

Motion by Lee, second by Wielage, to enter a public hearing at 7:07 p.m.  Vote: Lee-yes, Durnal-yes, Thorson-yes, Wielage-yes, Felty-yes; motion carried 5-0.

PUBLIC HEARING:

Thorson called the hearing to order at 7:07 p.m.  Answering roll call were Felty, Lee, Durnal, Thorson, and Wielage.

Motion by Lee, second by Wielage, to adopt the agenda.  Vote:  Durnal-yes, Thorson-yes, Wielage-yes, Felty-yes, Lee-yes; motion carried 5-0.

Chairman Thorson stated that the purpose of the hearing was to address an application for a variance of District 11-306, Section B.2. from Jillian Spencer/Bonsack. She wishes to place a shed on skids on Lots 1 & 2, Block 12, Anderson & Carlson’s Addition to Mead, Mead, Saunders County, Nebraska, commonly known as 703 S. Oak Street, Mead, Nebraska.  Section B.2 allows a maximum of two (2) detached outbuildings with the square footage of the garage no larger than the footprint of the house and the square footage of the shed no larger than one-hundred fifty (150) square feet.  The shed she wishes to place on the property is 12’ x 28’, for a total square footage of 336 sq. ft.

Thorson indicated there are several properties is town that have this same situation.  He also added that a nice-looking shed is better than several sheds on one property less than 150 sq. ft.  Durnal questioned why the shed was already in place.  Ms. Spencer/Bonsack stated that it had been ordered and arrived prior to her knowledge of the regulation.  Clerk Moline stated she would be paying the $100 penalty for placement prior to approval.

Thorson called for public input.

Motion by Lee, second by Wielage, to adjourn to regular session at 7:18 p.m.  Vote:  Thorson-yes, Wielage-yes, Felty-yes, Lee-yes, Durnal-yes; motion carried 5-0.

Following discussion, Thorson introduced and motioned to adopt Resolution 21-04, Variance on property described as 703 S. Oak Street, Mead, Nebraska.  Lee seconded the motion.  Vote:  Wielage-yes, Felty-yes, Lee-yes, Durnal-yes, Thorson-yes; motion carried 5-0.

 

RESOLUTION 21-04

 

            WHEREAS, The Village of Mead authorizes the variance request from Jillian Spencer/Bonsack of the following described real estate to wit:

 

LOTS 1 & 1, BLOCK 12, ANDERSON & CARLSON ADDITION TO MEAD, MEAD, SAUNDERS COUNTY, NEBRASKA, commonly known as 703 S. Oak Street, Mead, Nebraska.

           

Resolution sets out findings of fact based on evidence and testimony that the following conditions exist or would result in:  1) the strict application of the zoning regulation would produce undue hardship; 2) such hardship is not shared generally by other properties in the same zoning district and the same vicinity; 3) the authorization of such variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by granting of the variance; and 4) the granting of such variance is based upon reason of demonstratable and exceptional hardship as distinguished from variations for purposes of convenience, profit or caprice.

 

 WHEREAS, the applicant has requested a variance to place a storage shed

 on the property which will be greater than the allowed one hundred fifty (150) square feet.

 

WHEREAS, Variance amends Zoning Ordinance Article 3 Districts, 11-306 District (R-1); Single Family Residential, Section B. Permitted Accessory Uses, 2.  Maximum of two (2) detached outbuildings with the square footage of the garage no larger than the footprint of the house and the square footage of the shed no larger than one hundred fifty (150) square feet.  The proposed shed is greater than the allowed one hundred fifty (150) square feet.

 

WHEREAS, the variance allows for the placement of a storage shed in District (R-1) Single Family Residential District.

 

Motion by Lee, second by Wielage, to adjourn at 7:21 p.m.  Vote:  Felty-yes, Lee-yes, Durnal-yes, Thorson-yes, Wielage-yes; motion carried 5-0.
