PROCEEDINGS – VILLAGE OF MEAD BOARD OF TRUSTEES
July 10, 2018

A Regular Meeting of the Chairman and Board of Trustees of the Village of Mead, NE was held July 10, 2018 at the Village Office. Clerk Moline called the meeting to order at 6:00 p.m. Notice of the meeting was provided in advance thereof by posting notice at the Bank of Mead, U.S. Post Office and the Village Office as shown by the certificate of posting notice attached to these minutes. Advance notice was also provided to the Chairman and all members of the Board of Trustees. All proceedings were held while the convened meeting was open to the public. Answering roll call were Trustees Jason Felty, Gary Guyle, Richard Wielage and Rodney Wimer. Absent was Chairman Shawn Havelka. Also present were Clerk June Moline, Utility/Maintenance Superintendent Nick Raver, Police Chief Jerry Carlson, and Library Director Laurie VanAckeren. Guests were Dale Rawson, Brenda Halbmaier, Ron Raver, Jody and Kacee Weible, Bill and Patty Thorson, and Ray Loftus.

Moline called for nominations for Chairman Pro Tempore.

Motion by Wimer, second by Felty to nominate Guyle as Chairman Pro Tempore. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.

The posting of the Open Meetings Law was noted.

Motion by Wielage, second by Wimer, to adopt the agenda. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.

The minutes of the June 12 Regular Meeting and Public Hearing were accepted as presented.

Motion by Felty, second by Wielage, to approve the Treasurer’s Report showing $624,413.39 total checking/savings balance ending June 30, 2018. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.

Motion by Wielage, second by Felty, to approve the claims of $117,638.01 for payment with Wimer abstaining on Ck #3979 and Felty on Ck #131137. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0. Claims being:

SCHEDULED GUESTS:
Mead Public Schools Superintendent Dr. Rawson reported the recent receipt of a letter from the Board of Trustees indicating they are terminating the Sander Agreement and Common Facility Agreement with the school. Dr. Rawson presented a list of numerous shared projects between the school and village that he would like to see continue. It was agreed the Common Facility Board will meet in the near future to seek a continued partnership on numerous projects between the school and village.

Ron Raver expressed concerns regarding the condition of a property north of his rental property and concerns his renter has expressed with foxes and snakes appearing to live at that property. He also commented on the smell emitted from product which is continuing to be stored on the ground at AltEn and resident mowing grass clippings into the street.

UNSCHEDULED GUESTS:
Ray Loftus also expressed concerns with methane in a bladder at AltEn. Guests also reported placement of an additional lagoon at the site and improper notification when spreading of waste product. The clerk was directed to contact Attorney Freeman-Caddy as to what the village board and property owners can and cannot pursue regarding these concerns.

POLICE / ZONING ADMINISTRATOR / NUISANCE ENFORCEMENT OFFICER REPORT: Jerry Carlson
The Monthly Police Report was reviewed. Carlson reported the shed at 307 S. Cedar St. stipulated on Nuisance Abatement Resolution 17-16, is to be removed by June 20. Carlson is to contact Building Inspector Miller to seek an inspection of the property. The board asked that further investigation be made on parking on specific streets.

LIBRARY REPORT:
The minutes of the June 18 Library Board Meeting were accepted. Library Director VanAckeren presented the Annual Library Report and appealed to the board to once again consider allowing members on the Library Board that do not reside within village limits.

Motion by Felty, second by Guyle, to allow non-residents to serve on the Library Board if they reside within the 68041 postal zone. Vote: Felty-yes Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0. It was stated that VanAckeren is to first advertise and seek members within village limits prior to seeking residents living outside the village limits. No action can be taken until an ordinance has been adopted to amend the municipal code and with the additional wording that the Library Board minutes must indicate each individual vote in regard to financial action by the board.

Motion by Wielage, second by Wimer to re-appoint Layla Giorgakopoulos and Jennifer Lee to a four-year term on the Library Board. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.

UTILITY/MAINTENANCE SUPERINTENDENT REPORT: Nick Raver
Raver reported receipt acknowledging completion of the Sanitary Survey, installation of a new water line at Mead Jr.-Sr. High School, N. First Street will be temporarily closed for a week while concrete is replaced, street repairs and tarring of streets. A bid was received from CAT for a used generator for the wellhouse. Discussion showed the board wishes to pursue the purchase of a new generator rather than a used one and is to be placed in the upcoming fiscal year budget. Discussion was held on the pilot test results with Engineer Reinsch recommending a new test be completed by Tonka as AdEdge cannot obtain the necessary results from their testing. Raver reported the purchase of 200 carps at $12.00 each and 1,000 flathead minnows at $35.00 per thousand to maintain the lagoons.

PLANNING COMMISSION REPORT:
The minutes of the June 25 Regular Meeting and Permits were accepted. Permits: 18-15 Lee Daniels, 519 S. Oak – erect 4’ vinyl fence; 18-16 Perry Storm, 405 E. Fourth – construct 2 decks and back step; 18-17 Scott and Veronica Subbert, 1012 Co Rd M – erect 5’ wire fence; 18-18 Joshua and Katie Sharpe, 110 E. Seventh – construct front porch addition.

CLERK REPORT:
Moline reported that 54 pet licenses have been sold to date and that licenses were due May 1 for all dogs and cats residing within village limits. A $50.00 grant has been awarded by Saunders County Visitors Promotion and Improvement Committee toward the 2018 Easter Egg Hunt. Accountant Schroeder will be on-site on Tuesday, July 11 to complete the nine-month budget and gather information for the October 1, 2018 through September 30, 2019 budget. Following a directive by the board to purchase a new meter reader and autogun in the new fiscal year, Moline presented the cost from Core & Main as $8,500.00. Moline noted the final sign up day for incumbents to the village board is July 16 and August 1 for non-incumbents.

NEW BUSINESS:
Guyle introduced and motioned to adopt first reading of Ordinance No. 715, amend Chapter 3, Section 3-109 Water Rates.   Motion seconded by Wielage.  Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.

Guyle introduced and motioned to adopt first reading of Ordinance No. 716, amend Chapter 3 Departments, Sections 3-116.01, 3-116.02, 3-218, 3-219, and 3-901.   Motion by Wimer.  Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0.

Motion by Guyle, second by Felty, to approve annual review of Conditional Use Permits issued by the village. Permits being: Andy’s – Trailer Park; Frontier Co—op – Bulk Plant, Anhydrous Ammonia, Propane; Mike Coyle – Garage; AltEn – Cattle Feed Lot/Ethanol Plant. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.

Guyle introduced and motioned to adopt Resolution 18-05, Sale of Depot by bidding process. The motion was seconded by Wimer. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.

Motion by Wielage, second by Wimer, to approve 50% shared payment of umpires for the 2018 baseball-softball season, with the remaining 50% paid by the Mead Ball Association. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.

Motion by Guyle, second by Wielage, to approve a transfer of funds from First National Bank for payment of water project invoices. The transfer calls for $25,462.50 retained by First National Bank for the loan commitment fee, $3,637.50 to Kutak Rock for costs of issuance, and $57,857.43 to Village of Mead for payments previously made to Olsson Associates and Nebraska Department of Health and Human Services. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0.

Discussion was held on pursuing a street project. Options to resurface N. Oak Street were 1) concrete paving with earth/grass shoulders and maintain existing drainage systems $136,650.00 or 2) asphalt paving with earth/grass shoulders and maintain exiting drainage systems $98,328.00. Motion by Wielage, second by Felty, to proceed with creating a paving district. Vote: Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes; motion carried 4-0.

Motion by Wimer, second by Wielage, to enter executive session at 8:35 p.m. for the prevention of needless injury to the reputation of an individual during employee evaluations. Vote: Guyle-yes, Havelka-absent, Wielage-yes, Wimer-yes, Felty-yes; motion carried 4-0.

Motion by Wimer, second by Wielage, to reconvene in regular session at 8:52 p.m. Vote: Wielage-yes, Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent; motion carried 4-0.

Wielage introduced and motioned to waive three readings and adopt Ordinance No. 714, Increase in wages of 2% to Chief of Police, 3% Utility/Maintenance Superintendent and Park Restroom Custodian, and accepted the recommendations of the Library Board for a 5% wage increase for the Library Director and 3% for the Assistant Library Director and Library Aide. Felty seconded the motion. Vote: Wimer-yes, Felty-yes, Guyle-yes, Havelka-absent, Wielage-yes; motion carried 4-0.
